Update: Kauai Mayor Vetoes Pesticide Use Disclosure Bill; Fight for Protections Not Over

(Beyond Pesticides, November 4, 2013)   The hard-fought victory of Kauai residents to protect their homes, children, and natural environment from the chemical and agricultural industry’s excessive and secretive applications of pesticides was threatened last week.  Bill 2491,  passed earlier this month  and crafted to  rein in the ecosystem-threatening development of genetically  engineered crops  with their excessive reliance on pesticides, has been vetoed by Kauai’s Mayor Bernard Carvalho. The bill established much-needed disclosure, notice, and reporting mandates for commercial-scale pesticide applications, required pesticide application buffer zones for schools, hospitals, residences, public spaces, waterways, and parks, and mandated that the County perform and Environmental and Public Health Impacts Study (EPHIS). (See previous Daily News coverage for a more expanded history and discussion of the evolution of the bill.) A critical component of the bill is the inclusion of a penalties provision. Acting as a strong industry- incentive to comply with the bill’s mandates and protective measures, the penalties provision permitted civil fines of between $10,000 and $25,000 per day per violation and potential misdemeanor criminal sanctions. Investigative Report Finds Soaring Pesticide Use and Poisoning Linked to GE Crop Production

(Beyond Pesticides, October 22, 2013) Nearly a week after plant geneticists from the world’s largest agrichemical companies accepted the World Food Prize, an Associated Press (AP) investigation links the effect of their work to soaring pesticide use and resulting health problems.  According to the  AP, the advent of “no-till” farming methods in Argentina with the use of genetically engineered (GE) crops and companion pesticides has caused significant health impacts in farming towns abutting GE fields. Since the introduction of these practices in Argentina by agrichemical companies such as Monsanto, cancer rates have skyrocketed and the number of birth defects has quadrupled. Argentina was an early adopter of GE technology in 1996, when it was billed as the silver bullet to solve world hunger with increased crop  productivity, and improved human and environmental health resulting from decreased pesticide use. The most widely used GE crops, such as Monsanto’s Roundup Ready line of corn and soybeans, allow farmers to apply the herbicide glyphosate during and after seed plantings in order to kill weeds without risk of the main crop dying off. The Planting of Genetically Engineered Corn Stopped by a Mexican Court

(Beyond Pesticides, October 18, 2013) On October 10, a judge in Mexico issued an injunction against  the planting and selling of genetically engineered (GE) corn seed, effective immediately,  within the country’s borders. The decision comes nearly two years after the Mexican government temporarily rejected the expansion of GE corn testing, citing the need for more research. The decision prohibits agrichemical biotech companies, including Monsanto, DuPont Pioneer, Syngenta, PHI Mexico, and Dow AgroSciences, from planting or selling GE corn seed in Mexico, though imports of GE food will still be allowed. This move follows the filing of a class action lawsuit on July  5 by farmers, beekeepers, environmentalists, and scientists, in total representing 53 citizens and 20 civil associations. “The action encompasses what we have been calling for over the past fifteen years: the protection of maize as the staple food of Mexicans and the preservation of our country, free of transgenic crops”¦” said Adelita San Vicente, representing seed interest group FundaciĂłn Semillas de Vida A.C. Community Concerns Lead to Landmark Pesticide Protections in Kauai County

(Beyond Pesticides, October 17, 2013) Early yesterday morning, the Kauai County (Hawaii) Council ended a grueling 19-hour session by approving new protections from pesticides and genetically engineered (GE) crops in a 6 to 1 vote on Bill 2491. After enduring years of pesticide abuse from agrichemical giants Syngenta, Dow, DuPont Pioneer, and BASF, the residents of Kauai will finally receive simple protections they and future generations on the “Garden Isle” deserve. The legislation is a major victory for the local community, which engaged in numerous non-violent rallies and demonstrations urging the council to “Pass the Bill!” Local leaders crafted Bill 2491 in response to public outcry from residents, many of whom live, work, or have children that go to school near agricultural fields leased by chemical corporations. “The people in my community have asked for help,” said Kauai County Councilmember Gary Hooser. “People are concerned.” Many in the community assert that the passage of Bill 2491 is only the beginning of local efforts to reign in excesses and abuses of agrichemical companies operating on the island. Moms Fined $10,000 in Genetically Engineered Labeling Counterattack

(Beyond Pesticides, October 11, 2013) A group of mothers working to disclose donors of the No-on-522 campaign, which opposes genetically engineered (GE) labeling in Washington State, has been fined $10,000 plus attorney’s fees for bringing a suit against Grocery Manufacturers Association (GMA) for allegedly violating state campaign finance disclosure laws in Washington. Washington State’s Initiative 522, which is on the November ballot, will require the labeling by July 1, 2015 of genetically engineered  crops and processed foods. The grassroots group, Moms for Labeling, filed the suit against GMA and the No-on-522 campaign on September 17, asserting that GMA is falsely labeled as a top donor for the campaign, in order to conceal the identities of large out of state corporations who are against GE labeling. Last year, many of GMA members who contributed against labeling efforts in California prompted negative publicity and widespread consumer boycotts. The lawsuit was initially dismissed on a technicality because the group ””newly formed and made up of a handful of moms”” violated state filing procedures by not waiting 55 days after giving notice of an action to sue. Oregon Passes Bill to Limit GE Oversight

(Beyond Pesticides, October 7, 2013) A controversial agriculture bill that would bar counties in Oregon from regulating genetically engineered (GE) crops has passed in the state legislature to the dismay of many organic and environmental groups. Senate Bill 863 also includes an emergency clause, which would allow the bill to go into effect immediately, precluding opponents from referring the bill to voters. The Oregon Senate passed S.B. 863 17-12 last week after three-days of a special session to debate a controversial five-bill package. S.B. 863 declares that “regulation of agricultural seed, flower seed, nursery seed and vegetable seed and products of agricultural seed, flower seed, nursery seed and vegetable seed be reserved to the state, thereby preempting   local governments from adopting any of their own GE policies.” The bill precludes efforts in Benton and Lane counties to restrict GE agriculture, but excludes Jackson County, which already has a GE ban up for vote. This GE bill is part of a package of five bills aimed at giving schools more money, freezing college tuition, and reining in escalating costs of the public pension system. Kauai County, Hawaii Pesticide and GE Measure Passes Council Committee

(Beyond Pesticides, October 1, 2013) Kauai’s Committee on Environmental Development, Agriculture, and Sustainability approved a bill that requires large agricultural companies in the county to disclose the pesticides they  use. The legislation will now go to the full council for a vote. The measure, County Bill 2491, which Beyond Pesticides supported with testimony, would provide transparency and restrict the operations of DuPont Pioneer, Syngenta, Dow AgroSciences, BASF and Kauai Coffee, on the island. In a 4-1 vote, the majority of Kauai’s council members demonstrated support for the need to improve pesticide regulations to protect the  community health and the local ecosystem. The bill, introduced by Kauai County Councilmen Gary Hooser and Tim Bynum, provides long overdue protections from chemical exposure occurring on the island, requiring a 500-foot buffer zone near schools, hospitals, residential areas, public roadways and sensitive ecological sites, such as streams, rivers and shorelines. “Monsanto Protection Act” Stripped from Senate Bill

(Beyond Pesticides, September 26, 2013) The controversial legislative rider added at the behest of Monsanto to the U.S. Department of Agriculture (USDA) budget bill  last spring, dubbed the “Monsanto Protection Act,”  will no longer be effective after Sept. 30 under a new stopgap government funding bill being drafted by Senate Democrats. Just last week, to the dismay of many concerned groups and individuals, the House approved the extension of the provision, which protects genetically-engineered (GE) seed manufacturers  from  litigation. The provision  was included in last spring’s 6-month continuing resolution (CR) spending bill to fund the government  through the end of the month. The House approved a three-month extension to the rider in its own short-term FY14 Continuing Resolution (CR) spending bill, which was approved last week to fund the federal government past September. But the Senate version, overseen by Senate Appropriations Committee Chairwoman Barbara Mikulski (D-MD), will explicitly say that the Monsanto-backed provision will end this month on September 30 before sending the bill back to the House for final approval. USDA Refuses to Investigate GE Alfalfa Contamination

(Beyond Pesticides, September 25, 2013) Five days after genetically engineered (GE) alfalfa was confirmed to have contaminated non-GE alfalfa in Washington State, the U.S. Department of Agriculture (USDA) announced it would not investigate the incident. Conventional and organic farmers have long been concerned with the economic impacts of GE adulteration, and this incident represents the latest in a long string of contamination events that have brought a global spotlight on the United States’ loose regulatory structure for these controversial crops. GE alfalfa is engineered by Monsanto to be resistant to glyphosate, or “Roundup Ready,” and is the first engineered perennial crop. The contamination could either be a result of cross-pollination or direct contamination of purchased seed. Cross- contamination is highly likely as alfalfa is pollinated by bees that can fly and cross-pollinate between fields and wild sources miles apart. According to a December 2011 report by Stephanie Greene, a Ph.D. geneticist with the USDA Agricultural Research Service (ARS), after Roundup Ready alfalfa was first deregulated in 2005 industry testing of conventional seed lots found levels of contamination as high as  two percent. Despite Public Opposition, House Extends Monsanto Protection Act

(Beyond Pesticides, September 13, 2013) A three-month  extension of the  controversial budget provision protecting genetically-modified seed manufacturers  from litigation  was included in the  U.S. House of Representatives’ spending bill  on Tuesday evening.  Public interest and responsible business advocates say the provision  undermines the  federal courts’ ability to safeguard farmers and the environment from potentially hazardous genetically engineered (GE) crops. The controversial corporate earmark, also known as the “Monsanto Protection Act,” or “Biotech Rider,” was included in last spring’s 6-month Continuing Resolution (CR) spending bill, which funds the government until the end of this month. Beyond Pesticides joined Center for Food Safety (CFS)  and over 120 of the nation’s top organizations and businesses sent a letter to Senate Majority Leader Reid and Senate Appropriations Chairwoman Mikulski Thursday calling on them to strip the rider from the bill on Thursday. Monsanto Funds Anti-GE Labeling Efforts in Washington

(Beyond Pesticides, September 12, 2013) Monsanto recently made a multi-million dollar contribution to an organization fighting to stop a ballot initiative in Washington State that would force food processors to label genetically engineered (GE) ingredients. Monsanto has poured millions of dollars into multiple anti-labeling efforts, previously contributing over $7 million against a similar proposition in California last year. In spite of being out fundraised, support for labeling GE ingredients remains strong in Washington State, and consumers across the country are becoming increasingly aware of the problems associated with GE crops. Washington State’s Initiative 522 (I-522), which will be voted on this coming November, will require manufactured raw agricultural products that are genetically engineered, and processed foods with GE ingredients to be labeled by July 1, 2015. However, in the past week Monsanto contributed nearly $4.6 million to the ‘No on 522’ campaign. With this recent contribution by Monsanto, the No on 522 campaign, which opposes GE labeling, has raised close to $7.9 million, $3.5 million more than the Yes on 522 campaign. Another Study Finds Rootworms Resistant to Genetically Engineered Corn

(Beyond Pesticides, September 3, 2013) For the past several years, corn rootworms  have  been widely reported to exhibit resistance  to corn genetically engineered (GE) with the Bacillus thuringiensis (Bt) toxin. A  new report by  University of Illinois researchers found the resistant corn rootworm  in two of the state’s counties significantly damaged by western corn rootworm. The increasing lack of efficacy of GE corn, developed with the claim that it  is specifically designed to protect corn from rootworm, calls into question the efforts of agrichemical companies to patent new forms of GE crops. The report by Joe Spencer, PhD, and Michael Gray, PhD,  identifies significant damage from western corn rootworms in farm field that were planted with GE corn that contain a Bt protein referred to as “Cry3Bb1,” which has been inserted into nearly one-third of the corn planted in the United States. This version of Bt corn was introduced by Monsanto in 2003, and was touted as a way to reduce insecticide use against rootworm pests. Lawsuit Filed to Halt GE Crops on Wildlife Refuges in the Midwest

(Beyond Pesticides, August 29, 2013) A federal lawsuit was filed on Tuesday to stop the planting of genetically engineered (GE) crops and restrict the widespread use of pesticides in national wildlife refuges in the Midwest Region. The lawsuit seeks to  enforce the legal requirement  that the U.S. Fish and Wildlife Service (FWS), which operates the refuges, conducts a comprehensive environmental review  and halts GE crops on these sites until environmental compliance standards are fully met. The lawsuit was filed in the U.S. District Court for the Northern District of California by Beyond Pesticides, Center for Food Safety (CFS), Public Employees for Environmental Responsibility (PEER), and the Sierra Club. Groups Call on USDA to Improve Oversight of GE Crops

(Beyond Pesticides, August 23, 2013) Beyond Pesticides, along with upwards of 150 U.S. farm and food businesses and organizations, sent a letter to the U.S. Department of Agriculture (USDA) calling on the department to strengthen their oversight of field trials of experimental, genetically engineered (GE) crops. The letter comes in response to the USDA’s announcement in May 2013, that unapproved GE wheat developed by Monsanto was discovered in a farmer’s field in eastern Oregon. GE material drifts  and contaminates non-GE   and organic fields, economically crippling these farmers. The letter, which was addressed to USDA Secretary Tom Vilsack, is supported by food and farming organizations calling for tighter regulations and oversight of GE crops, particularly for experimental field trials. “Current U.S. policy includes neither mandatory contamination prevention measures nor an adequate system for monitoring the success of containment following trials,” charged the Organic Seed Alliance and the Rural Advancement Foundation International in a recent press release. Oregon Blocks Canola Planting in Willamette Valley to Prevent GE Contamination

(Beyond Pesticides, August 20, 2013) In a victory for consumers and Willamette Valley’s $50 million vegetable seed industry, Oregon Governor John Kitzhaber signed HB 2427 last week, banning the commercial production of canola in the region until at least 2019. Supporters of the law assert that the moratorium is necessary to maintain the integrity of the region’s internationally recognized organic vegetable seed industry. Farmers in Oregon’s specialty seed and organic vegetable industries, valued at well over $50 million in annual sales, have been fighting the planting of  canola, an oilseed plant in the brassica family, in the Willamette Valley because it readily cross-pollinates with specialty crops grown there, the brassica specialty seed crops like broccoli, kale, and cabbage. Canola can  spread plant diseases and pests to brassica vegetable and seed crops; and can contaminate pure lots of vegetable and clover seed, rendering them unsalable in international and local markets. Additionally, genetically engineered (GE)  herbicide resistant varieties of canola can further cross-pollinate with weeds, creating new invasive species problems as herbicide resistant traits spread to native weed populations. Genetically Engineered Food Labeling Supported Widely in Washington State, Industry Pushes Back

(Beyond Pesticides, August 13, 2013) Despite the defeat of California’s Proposition 37 at the polls last November, it’s evident that advocates of labeling genetically engineered (GE) foods have not let the loss slow them down. In fact, Prop 37 has acted as a rallying point, lifting the issue to national attention and highlighting the GE industry’s vain attempts to quash the national grassroots movement. Recent victories with high-profile supermarkets such as Whole Foods, states including Connecticut and Maine, and the introduction of a federal GE labeling bill in both Houses of Congress set the backdrop for the biggest food fight of the year, Washington State’s Initiative 522 (I-522). Washington State’s I-522 would require manufacturers selling foods containing GE ingredients to disclose their presence conspicuously on the front of a product’s package. Giant Corps Have Set Up Shop in Hawaii, and They’re Wrecking the Place

(Beyond Pesticides, July 15, 2013) They’re wrecking the place; the chemicals they produce are  polluting groundwater  and  poisoning schoolchildren. In the absence of federal and state action, local communities are rising up to confront these agrichemical giants. As a testament to the power of local change, two Hawaiian counties, Kauai and the “Big Island” of Hawaii, have introduced legislation to restrict these practices.  Monsanto, Dow, BASF, DuPont Pioneer and Syngenta are using the Hawaiian Islands as their private testing grounds for experimental pesticides and genetically engineered (GE) crops, but they don’t want residents to know where these fields are and what chemicals they are spraying on them; they don’t think they have that right. Federal and state governments have, in effect, sanctioned these practices and provided cover for these corporations to spray tons of restricted use pesticides  across the islands (18 tons annually— and that’s just on the island of Kauai). Amidst Criticism, New Study Reveals GE Crops Inflame Digestive Tract

(Beyond Pesticides, June 14, 2013) Researchers based out of Australia have found that pigs fed genetically engineered (GE) soy and GE corn are more likely to have severe stomach inflammation and higher uterine weight. Although the study, published in the peer-reviewed Journal of Organic Systems, has been criticized  for its methodology, it underscores the need for more research on the long term impacts of GE consumption, especially considering the pig digestive system is physiologically similar to humans. The study, “A long-term toxicology study on pigs fed   combined genetically modified (GM) soy and GM maize diet,” led by Judy Carman, PhD., associate professor in health and the environment at Flinders University, Australia, found that GE-fed pigs had much higher rates of stomach inflammation. Researchers fed 84 pigs GE soy and corn and 84 pigs non-GE feed for a period of 22.7 weeks, approximately the lifespan of a commercial pig from weaning to slaughter. While there were no differences in terms of other organ weight, feeding changes, mortality and blood biochemistry, 32% of GE-fed pigs contracted severe stomach inflammation in comparison to only 12 percent of pigs fed with non-GE feed. Monsanto Promises Not to Sue for GE Contamination

(Beyond Pesticides, June 12, 2013) A three-judge panel  of the Court of Appeals for the Federal Circuit ruled Monday that a group of organic and otherwise non-GE farmer and seed company plaintiffs are not entitled to bring a lawsuit to protect themselves from Monsanto’s transgenic seed patents after Monsanto made binding assurances that it will not take legal action against growers whose crops might inadvertently be contaminated with traces of Monsanto biotech genes. Organic farmers and others have worried for years that they will be sued by Monsanto for patent infringement if their crops get contaminated with Monsanto genetically engineered (GE) material from GE crops. Organic and non-GE farms get contaminated when pollen or seed migrate from neighboring GE farms. Even though wind or insect transfer of pollen is a natural process, Monsanto has been suing farmers for infringing on their patents if contamination is found on their farms. Multiple Lawsuits Filed Against Monsanto for Transgene Contamination of Wheat

(Beyond Pesticides, June 11, 2013) Several different lawsuits have been filed against the agrichemical giant Monsanto after the recent discovery of illegal Genetically Engineered (GE) glyphosate-resistant wheat plants  in an Oregon wheat field. The GE wheat was first found in early May when field workers in eastern Oregon noticed a volunteer patch of wheat that survived a dousing with glyphosate. Ernst Barnes, a Kansas wheat farmer, brought the first lawsuit against Monsanto. Soon after, a separate lawsuit was filed by the Center for Food Safety on behalf of Pacific Northwest wheat farmers. The lawsuits allege that the presence of GE wheat crops spurred top wheat importers, such as Japan, South Korea, and the European Union, to enact damaging restrictions on American wheat. These restrictions could lead to lower wheat imports and will cause devastating economic effects to wheat farmers. While the world’s largest wheat importer, Egypt, has not signaled it would stop importing U.S. wheat, Japan has cancelled its order to buy U.S. western white wheat. Senator Stabenow Pledges Opposition to the “Monsanto Protection Act”

(Beyond Pesticides, June 7, 2013) U.S. Senator Debbie Stabenow (D-MI), Chairwoman of the Senate Agriculture Committee, has announced her intent to oppose an extension of the “Monsanto Protection Act,” or “Biotech Rider.” Senator Stabenow announced her opposition in a conversation (“colloquy”) with Senator Jeff Merkley (D-OR) on the Senate floor. Senator Merkley had been pushing for a vote on an amendment to the Farm Bill that would have repealed the Biotech Rider, which was surreptitiously added to the House’s 6 month continuing resolution (H.R. 933 -Sec. 735) earlier this year. Senator Roy Blunt (R-MO), who wrote the provision and whose state is home to Monsanto’s headquarters, blocked the Senate’s vote on the measure, and shortly thereafter the Senate moved to end debate on the Farm Bill and move towards final passage. Connecticut Challenges States to Label GE Food

(Beyond Pesticides, June 5, 2013) Connecticut passed a bill on Monday that requires food manufacturers to label products that contain genetically engineered (GE) ingredient, but only  if other states do the same. This means people in Connecticut and other parts of the country will still have to wait to see GE labeling on their food. On Monday, the state House of Representatives passed an amended version of a labeling bill that the state Senate approved two weeks ago, and Gov. Dannel Malloy has said he will sign it. House Bill 6527 — An Act Concerning Genetically-Engineered Food, will require producers to label genetically engineered food in Connecticut. The bipartisan bill passed unanimously in the Senate and 134-to-3 in the House. The bill will go into effect when, “Four states, not including this state, enact a mandatory labeling law for genetically-engineered foods that is consistent with the provisions of this subsection, provided one such state borders Connecticut; and (2) the aggregate population of such states located in the northeast region of the United States that have enacted a mandatory labeling law for genetically-engineered foods that is consistent with this subsection exceed twenty million based on 2010 census figures.” Connecticut will now […]

Study Finds GE Salmon Able to Cross-Breed with Brown Trout

(Beyond Pesticides, June 3, 2013) A new study, published in Proceedings of the Royal Society, found that genetically engineered (GE) AquaBounty AquaAdvantage salmon can successfully cross-breed with brown trout, a closely related species. GE salmon, created by the biotech company AquaBounty, are designed to reach maturity faster than their wild counterparts and would be the first GE animal approved for human consumption in the United States. As a result of this study, the authors “…suggest that interspecific hybridization be explicitly considered when assessing the environmental consequences should transgenic animals escape to nature.” The study not only found that GE salmon can cross-breed with brown trout, but also that their GE hybrid offspring could outgrow wild salmon, non-GE hybrid offspring, and even GE salmon. The GE hybrids also out-competed wild salmon and GE salmon in simulated stream environments, further stunting the growth of other fish.
