Timberland Pesticide Spray Investigation Records Ordered Released in Oregon

(Beyond Pesticides, March 31, 2014) On March 24 the Oregon Department of Justice (ODJ) ordered the Oregon Department of Agriculture (ODA) to turn over records that are part of an investigation of an aerial herbicide spraying over timberland in southwestern Oregon. This public disclosure of records may allow residents to have a better understanding of the chemicals associated with ongoing exposure incidents.  This recent spray event is just one in line of many that have led environmental groups and federal agencies to call into question the effectiveness of Oregon’s regulation of pesticide use on timberland. ODA began its investigation in November of 2013 after complaints that herbicides sprayed from a helicopter on commercial timberlands near Gold Beach drifted on to residential areas. ODA is investigating five herbicide active ingredients: 2,4-D, triclopyr, glyphosate, imazapyr, and  metsulfuron methyl.  However, ODA has not released information about the specific products it believes were used or their potential toxicity. Fifteen residents filed complaints with the department after they experienced rashes, headaches, asthma, and stomach cramps directly after the application. Citing Continuing Failure to Protect Endangered Species, Lawsuit Challenges EPA Registered Pesticide

(Beyond Pesticides, March 26, 2014) Conservation and food-safety groups filed a formal notice of intent to sue the U.S. Environmental Protection Agency (EPA) on Monday for failing to protect hundreds of endangered fish, butterflies and other species from a new, toxic pesticide, cyantraniliprole. The suit claims EPA violated the Endangered Species Act (ESA) by approving the widespread agricultural and residential use of the new pesticide in January without input from the U.S. Fish and Wildlife Service and National Marine Fisheries Service, the two federal agencies in charge of protecting endangered species. The Notice of Intent to Sue is being filed by the Center for Biological Diversity,  Center for Food Safety, and Defenders of Wildlife. Cyantraniliprole, a new, systemic insecticide, was formally registered by the EPA earlier this year. Despite evidence that cyantraniliprole is toxic to honey bees, EPA’s registration document for cyantraniliprole finds that, “There is a reasonable certainty that no harm will result from aggregate exposure to the pesticide residue.” According  to EPA’s assessment the pesticide is also slightly to very highly toxic to aquatic organisms. Town Asks MA Supreme Court to Affirm Right to Stop Private Pesticide Use in Sensitive Pond

(Beyond Pesticides, February 20, 2014) The town of Chilmark located on Martha’s Vineyard, Massachusetts is not backing down from its decision to challenge property owners and the local conservation commission’s attempts to introduce a toxic herbicide directly into the waters of the only enclosed, great pond of the well-known, destination island. While one might assume that the litigation centers around whether or not the herbicide proposed for use in the local water source poses as a danger, this issue is only a sideline debate. Instead, the central dispute highlights one of the greatest challenges facing local governments surrounding pesticide control and a locality’s authority to protect both its citizens and its local environment from the hazards that these chemicals bestow: preemption. Preemption is the ability of one level of government to override laws of a lower level. While local governments once had the ability to restrict the use of pesticides on all land within their jurisdictions, pressure from the chemical industry led many states to pass legislation that prohibits municipalities from adopting local pesticide ordinances affecting the use of pesticides on private property that are more restrictive than state policy. Endocrine Disrupting Chemicals May Target Fish Hearts

(Beyond Pesticides, February 5, 2014) According to a new study published in Environmental Health Perspectives, chemical contaminants in waterways that mimic estrogen -endocrine disruptors- target developing heart valves in fish and impair the growth of fish hearts. The study illustrates that these hormone-mimicking compounds, which include some pesticides, pharmaceuticals, and other household chemicals often found in sewage effluent and runoff that flows into waterways, are being linked to mounting science that show serious human and environmental adverse effects. Researchers from the Fish Health Branch of the U.S. Geological Survey (USGS) and the Carnegie Institution for Science exposed zebrafish embryos to water from 19 sites in the Susquehanna, Delaware, Allegheny and Shenandoah watersheds. Water from 16 of the sites triggered proteins in the fish that were estrogen receptors, indicating that the rivers contained endocrine disrupting chemicals. These receptors are attached to DNA, which turn genes on and off. While such activity is common in the liver, this is the first experiment to show estrogenic activity in heart valves. “This tells us that endocrine-disrupting chemicals could lead to improper heart development. Oregon Group Uses Mushrooms for Bioremediation

(Beyond Pesticides, January 23, 2014) Putting ideas into action, an Oregon-based restoration nonprofit group, Ocean Blue Project, is harnessing the power of mushrooms to clean up pesticides and other pollutants that plague Oregon and national waterways. Yes, mushrooms. The test project launched Sunday, January 19 on the banks of Sequoia Creek, a tributary to the Willamette River. Using recycled burlap bags filled with used coffee grounds, straw, and yellow oyster mushroom spawn, the purpose of the unusual potpourri will be to harness the extremely effective filtering capabilities of mycelium. A kind of root system for fungi, mycelium demonstrate a wide variety of biological powers, from breaking down oil, pesticides, and harmful bacteria to acting as natural pesticides against some of the most problematic pests. Paul Stamets, a leading expert on the power of mushrooms and former speaker at Beyond Pesticides’ National Pesticide Forum in 2006, has a word for the natural properties of fungi to fight human-made pollution: mycorestoration. Atrazine Ban Will Result in an Economic Benefit to Farmers

(Beyond Pesticides, January 17, 2014) A new economic study, Would banning atrazine benefit farmers?, published in the International Journal of Occupational and Environmental Health demonstrates that eliminating the herbicide atrazine, widely used on U.S. corn crops, will economically benefit corn growers. The study examines the research produced by the Atrazine Benefits Team (ABT), a group assembled by atrazine manufacturer Syngenta, revealing that the industry-funded studies significantly overestimate the benefits of atrazine without considering the value of nonchemical weed management techniques. Research, led by Frank Ackerman, PhD., professor at Tufts University in the Global Development and Environment Institute, questions the economic viability of atrazine in Syngenta’s study. Researchers critically review five papers released by ABT in 2011, which claim that the withdrawal of atrazine would diminish corn yields by 4.4%, increasing corn prices by 8%. Using these assumptions, Dr. Ackerman and his team calculated that corn growers’ revenue would actually increase by 3.2%, providing a total of $1.7 billion to farmers and the U.S. economy with minimal price changes for consumers. Fed To Require Strengthened State Protection from Nonpoint Pesticide Pollution

Beyond Pesticides, December 23, 2013) The Environmental Protection Agency (EPA) and the National Oceanic and Atmospheric Administration (NOAA)  in a  Federal Register notice  has found that the state of Oregon’s program to reduce nonpoint coastal pollution is inadequate. Both federal agencies state that Oregon’s program does not adequately protect streams that provide habitat for Coho Salmon, an endangered species, and drinking water from herbicides that are aerially sprayed by lumber companies. This notice comes just after a recent report was released by Beyond Toxics on the health and environmental problems caused by aerial herbicide application on timber forests near Triangle Lake. EPA and NOAA’s proposed disapproval action of Oregon’s Coastal Nonpoint Program finds that the state has failed to adequately protect certain waterways within the state. Under the Coastal Zone Act Reauthorization Amendments (CZARA) of 1990, states are required to submit an approvable Costal Nonpoint Pollution Control Program to NOAA and EPA. In 1998, federal agencies approved the Oregon Nonpoint Program with conditions that the state meet certain water pollution issues. Beyond Pesticides’ Decade-Long Campaign Leads FDA to Bar Antibacterial Soaps

(Beyond Pesticides, December 17, 2013) A new rule proposed by the U.S. Food and Drug Administration (FDA) requires manufacturers of antibacterial hand soaps, body washes, and other consumer goods to prove that their products are both safe for long-term use and more effective than regular bar soap in order to remain on the market. This announcement, though long-delayed, represents a positive step towards reining in the unnecessary use of antibacterial chemicals at a time when top-level government scientists at the U.S. Centers for Disease Control and Prevention (CDC) have asserted that we’ve reached “the end of antibiotics.”  With the publication of its article The Ubiquitous Triclosan: A common antibacterial agent exposed  in 2004, Beyond Pesticides began a campaign to ban triclosan because of it cross resistance with antibiotics, endocrine disrupting effects, and lack of benefits. “Numerous studies have shown that antibacterial soaps cause more harm than any of their perceived benefits,” said Nichelle Harriott, staff scientist  at Beyond Pesticides. “For the protection of human health and the environment, we urge the FDA to move quickly to get these products off of the market.” FDA’s new rule, announced Monday, will be open for public comment for 180 days and manufacturers will […]

Unregulated Contaminants Found Widespread in U.S. Drinking Water

(Beyond Pesticides, December 13, 2013) A recent survey conducted by researchers at the U.S. Geologic Survey (USGS) and the U.S. Environmental Protection Agency (EPA) found traces of 18 unregulated chemicals in drinking water from more than one third of U.S. water utilities. Of the 21 total chemicals found, researchers discovered among them 11 perfluorinated chemicals, an herbicide, two solvents, caffeine, an antibacterial chemical, a metal and an antidepressant. Preliminary findings were presented by scientists at an annual toxicology conference held by the Society of Environmental Toxicology and Chemistry last month in Nashville. Federal researchers took samples from 25 U.S. utilities from around the nation who voluntarily participated in the study, providing samples of treated and untreated water. Disturbingly, 18 of the chemicals found are not regulated under the Safe Water Drinking Act, meaning utility companies are not required to treat, limit, or even monitor for their presence. “The good news is the concentrations are generally pretty low,” said USGS research hydrologist Dana Kolpin, PhD. to Environmental Health News. “But,” he continued “there’s still the unknown. House Farm Bill Provision Would Make Eating Fish More Dangerous

And as conferee members saddle up to the negotiation table to attempt yet another meeting of the minds before the winter recess, most of the public watching and waiting for word on a resolution are focused on issues like food stamps and milk. What most are not waiting for and has not been at the forefront of the media and public discussion concerning the pending farm bill negotiations are the small but dangerous provisions of the House bill concerning the Federal Water Pollution Control Act (expanded and overhauled  as the Clean Water Act (CWA) in 1972) and the U.S. Environmental Protection Agency’s (EPA) ability to regulate pesticides used near, over, and in water. Synthetic Nitrogen Fertilizer Leaches from Soils to Groundwater over Decades

(Beyond Pesticides, November 21, 2013) Scientists in France and at the University of Calgary say that nitrogen fertilizer applied to crops lingers in the soil and for decades leaches toward groundwater —much longer than previously thought. The study was led by researcher Mathieu Sebilo, Ph.D. at the UniversitĂ© Pierre et Marie Currie in Paris, France, and by Bernhard Mayer, Ph.D. in the U of C’s Department of Geoscience, and included several research organizations in France. The study, Long-term fate of nitrate fertilizer in agricultural soils, was published in the Proceeding of the National Academy of Sciences in the U.S. in October. The study shows that the loss of synthetic nitrogen (N) fertilizer in groundwater occurs at low rates over many decades, which means it could take years to reduce nitrate contamination in groundwater, including in aquifers that supply drinking water. The researchers recommend that as a result of the “legacies of past applications of synthetic fertilizers in agricultural systems,” mitigation or restoration measures must take into account this delay. White Paper Outlines New Approach to Endangered Species Act Pesticide Review

(Beyond Pesticides, November 19, 2013) Last week, the Environmental Protection Agency (EPA), the U .S. Department of Agriculture (USDA), Fish and Wildlife Service (FWS), and National Marine Fisheries Service (NMFS) released a white paper identifying how they plan to reconfigure the pesticide review process to meet the pesticide approval requirements for the Endangered Species Act (ESA). The new approach outlined in the white paper incorporates suggestions from the National Academy of Sciences’ Research Council (NRC) report released last May. The white paper is a step towards overhauling a deeply flawed process, though there will be several challenges to implementing this new approach for the agencies moving forward. Under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), before a pesticide can be sold, distributed, or used in the U.S., EPA is required to determine that the pesticide does not cause unreasonable adverse effects on the environment. However, in the case of species listed as endangered or threatened under the ESA, all federal agencies, including EPA, are required to ensure that their actions will not jeopardize the continued existence of a listed species by diminishing the species’ numbers and reproduction. Task Force Provides Recommendations to Halt Lake Erie’s Algal Blooms

(Beyond Pesticides, November 15, 2013) Recommended measures to reduce Lake Erie’s phosphorous, a fertilizer ingredient that feeds algae and steals aquatic oxygen, was released Wednesday by the Lake Erie Task Force II. The collaboration of officials, scientists, and interest groups identified agriculture as the primary contributor to phosphorous loading in Lake Erie, recommending that the nutrient runoff into northwestern Ohio tributaries and to the lake be cut by 40 percent. Fertilizer runoff not only causes unsightly and odiferous algal blooms, it can also severely harm aquatic wildlife. Once algae dies off, aerobic bacteria consume the dead algae resulting in dangerously low oxygen “dead zones.” Lake Erie is particularly prone to algal blooms in part because it is the southern-most, shallowest and warmest of the Great Lakes, but also because surrounded by prime agricultural land. The task force’s report contains 20 recommendations for reducing phosphorous inputs into Lake Erie, including continued nutrient monitoring, developing dedicated funds for research, updating the phosphorous index farmers use to guide their fertilizer applications, promoting management practices that support living roots year round, and avoiding fertilizer application on frozen ground or before rainy weather. It’s Back! Provision that Undermines Clean Water Act Resurfaces in Congress

(Beyond Pesticides, October 30, 2013) Once again, a bipartisan group of U.S. Senators is urging Farm Bill conference committee members to accept a provision that would eliminate what they call a redundant permitting requirement for pesticide users. H.R. 935: Reducing Regulatory Burdens Act of 2013 is similar to a previous piece of legislation that was passed in the U.S.  House of Representatives  in 2011 to eliminate the requirement that pesticide applicators obtain Clean Water Act (CWA) permits (known as National Pollutant Discharge Elimination  System (NPDES) permit)  for applications where pesticides could be discharged into water. A  bipartisan group of  Senators hope to use the Farm Bill to eliminate permitting requirement, continuing to believe the myth that permits burden farmers and applicators. The Senate and House are now in a conference committee to work out the details of a new Farm Bill to reauthorize the current law. A dozen Senators, led by Sen. Banned Pesticides Threaten Illinois River Otters

(Beyond Pesticides, October, 16 2013)   Researchers at the Illinois Department of Natural Resources and the University of Illinois Urbana—Champaign have found that organochlorine pesticides and other organochlorine compounds like polychlorinated biphenyls (PBCs) are still contaminating river otters in the state, even though these chemicals have been banned for decades. Surprisingly, the levels detected are the same or higher than those detected in otters 20 years ago, highlighting the need to understand the exposure of wildlife and humans to organochlorine compounds despite their ban. In order to see what chemicals might be affecting otters, if any, the researchers examined the bodies of 23 river otters collected between 2009 and 2011. In the published study, River otters as biomonitors for organochlorine pesticides, PCBs, and PBDEs in Illinois,  scientists looked at liver concentrations of 20 organohalogenated compounds once used in agriculture and industry. The average concentrations of dieldrin, an insecticide that was used across the Midwest before being banned in 1987, actually exceeded those measured in river otters collected from 1984 to 1989. Is Long Banned DDT Still Threatening Endangered Birds?

(Beyond Pesticides, September 18, 2013) DDT, a pesticide banned in 1972, is behind the mystery surrounding the reproductive problems of dozens of endangered condors. This is according to a peer-reviewed paper written by 10 condor experts, including biologists from the Los Angeles and Santa Barbara zoos and the U.S. Fish and Wildlife Service. The researchers, who spent six years studying the reproductive problems, including eggshell thinning, in California condors have “established a strong link” to DDT in the birds’ food source. Condors are large scavenger birds with wingspans up to 10 feet and were reintroduced to California’s coast in 1997 after a century-long population decline. However, in 2006 biologists began observing thinning shells in many condor nests. Over the next six years, scientists observed condors feeding on dozens of sea lions, and found that in Big Sur, California, condor populations had low hatching success ”” just 20-40 percent. Study Reveals Toxic Nanoparticles Persist in Food

(Beyond Pesticides, August 27, 2013) A new study by scientists at the University of Missouri College of Agriculture, Food, and Natural Resources is shedding light on the persistence of nanopesticides in our food. Researchers focused their attention on silver nanoparticles (nanosilver), a substance that has been linked to environmental harm, bacterial resistance, and not fully understood impacts on human health. Scientists say their findings represent a reliable method of testing foods for the harmful particles and hope to more broadly implement their technique in the future. The last decade has witnessed a large influx in the use of nanotechnology in consumer products, including food, clothing, cosmetics, fertilizers, and pesticides. The growth of this technology has elicited strong reactions from scientists across the globe, with many asserting that further research is urgently needed to evaluate the potential impacts of these novel substances. Utility Plans to Spray Rights-of-Way Despite Local Opposition

(Beyond Pesticides, August 22, 2013) After four years of relying on non-toxic mechanical controls to clear weeds on rights-of-way across Cape Cod, the Massachusetts-based power company NStar announced that it will begin using herbicides again this fall. All 15 Cape Cod towns have signed a no-spray resolution in 2011 and 2013, requesting NStar to use non-chemical means to defoliate transmission line easements, citing concerns for pesticide drift into the ground and surface water. Yet, despite extensive local opposition to the spraying, and evidence of the efficacy of organic land management to control weeds, NStar has refused to seriously consider alternative methods to spraying toxic herbicides. Many of the targeted spray areas where power lines are located are in close proximity to homes with private wells, in areas that drain into public water supplies, and adjacent to bike and walking paths. The pesticides can persist in the soil and be tracked into homes, or enter the surface or ground water where drinking water is sourced. Bill Introduced to Restrict the Pesticide Methoprene in Estuaries in New York County

(Beyond Pesticides, August 21, 2013) Suffolk County, New York, Legislator Jay Schneiderman (I-Montauk) introduced a bill on July 30, 2013 to establish strict guidelines for the use of methoprene within estuaries in Suffolk County.   Methoprene, an insect growth regulator, is commonly used in mosquito control programs, but is highly toxic to estuarine invertebrates, including crabs and lobsters, which are the backbone of the fishing industry along the East coast. This bill follows similar legislation already passed in Connecticut and Rhode Island to help protect lobster populations. The lobster population in the Long Island Sound has decreased dramatically over the last decade, corresponding with the introduction of pesticides such as methoprene in mosquito control programs. Methoprene  is an insect growth regulator that prevents development to the adult reproductive stages so that insects die in arrested immaturity. Antimicrobials Alter Stream Communities and Lead to Resistance, Study Finds

(Beyond Pesticides, August 12, 2013) A recent study on triclosan, an antibacterial pesticide found in soaps, deodorants, toothpastes, cosmetics, fabrics, plastics, and toys, finds that exposure changes the composition of bacterial communities in streams and also increases bacterial resistance. The study contributes to continually mounting evidence demonstrating that triclosan is toxic to human health and the environment, even as the U.S. Environmental Protection Agency (EPA) gets ready to review the registration of the chemical. In May, EPA initiated the registration review of triclosan, an antibacterial pesticide that has been heavily scrutinized by concerned groups, including Beyond Pesticides, as well as members of Congress. Under pressure after its 2008 review, EPA announced that it would again review triclosan in 2013, five years earlier than scheduled. Over the last few years, as a direct result of pressure from consumer groups and the media regarding the need for triclosan in consumer products and the mounting scientific evidence documenting adverse health effects, including impacts to the thyroid hormone, major manufacturers have begun to quietly reformulate their products without triclosan. Third Time in Three Years – Pesticides Believed to be Cause of Fish Kills in Canada

(Beyond Pesticides, July 31, 2013) Environmental officials are investigating why dozens of dead fish are washing up on the banks of two rivers in western Prince Edward Island (P.E.I.), Canada. For the third time in three years, dead fish have been spotted rising to the surface of Barclay Brook where thousands of fish died in 2011 and 2012 after pesticides from farmers’ fields ran off into the water.   Almost exactly one year ago, when more than 2,000 dead fish were scooped from the near two-mile stretch of Barclay Brook, dead fish again began washing up on the banks of the same river in western P.E.I. following heavy rains last Friday. About a dozen were found the day of the rains, but officials and volunteers with the local watershed group have since found more than 100. The nearby Mill River also experienced a fish kill, with the first dead fish reported being washed up on Monday. P.E.I. Department of Environment and Environment Canada officials are investigating the fish kills. Pesticides Contaminate Frogs in California National Parks

(Beyond Pesticides, July 30, 2013) A recent study published in Environmental Toxicology and Chemistry found levels of pesticide contamination from agricultural drift in Pacific Tree frogs in remote mountain areas including national parks. The study supports past research on the pesticide transport through atmospheric dust and rain. To conduct the study, researchers collected Pacific Chorus frogs, as well as water and sediment samples, from seven ponds ranging from Lassen Volcanic National Park at the northern most location of Central Valley to the Giant Sequoia National Monument. The samples were tested for 98 types of pesticides, traces of which were found in frog tissues from all sites. Two fungicides, pyraclostrobin and tebuconazole, and one herbicide, simazine, were the most frequently detected compound. This was the first time these compounds have ever been reported in wild frog tissues. According to the study, chemical concentrations are often higher in the frog tissue than the environment. This happens as frogs store up small exposures over time, allowing pesticides to bioaccumulate in their bodies.
