European Commission Postpones Vote to Define and Regulate Endocrine Disrupting Chemicals

(Beyond Pesticides, March 2, 2017) On Tuesday, the European Commission (EC) refrained from voting on proposed scientific criteria that would have identified endocrine disrupting chemicals (EDC) and led to regulation on their use in EU countries. This sends the Commission back to the drawing board on the proposal, on which they hope to eventually take a formal vote. The failure to move forward with defined criteria on these hazardous chemicals, which are present in pesticides, biocides, and self-care products, is still largely due to the disagreements of voting member states over the rules reflecting hazard or risk-based criteria. There have been several other meetings of the member states on this proposal, including a meeting in December which highlighted the inadequacies of the criteria. After this meeting, according to Bas Eickhout, of the Greens-European Free Alliance, “Under the Commission’s criteria, it is likely that not a single substance would be identified as an endocrine disrupter, and they would effectively escape specific regulation.” This all follows on the weak regulations issued by the EC in June 2016 to regulate endocrine disruptors in pesticide products, which ultimately undermine the precautionary legal standard that governs pesticide usage in Europe. Neurotoxic Flea Collar Pesticide Upheld, EPA Issues Warning on Children’s Exposure

(Beyond Pesticides, January 9, 2017) After the U.S. Environmental Protection Agency (EPA) released its recent human health risk assessment for the organophosphate insecticide (OP) tetrachlorvinphos (TCVP) on December 21, 2016, the agency announced it was allowing the continued use of the neurotoxic chemical to which children are widely exposed through pets’ flea collars and other flea treatments. According to EPA, ” TCVP is used as a direct animal treatment to livestock (i.e., cattle, horses, poultry and swine) and their premises, in kennels, outdoors as a perimeter treatment, and as a flea treatment [including flea collars] on cats and dogs.” In its announcement on January 4, 2017, EPA states, “We advise consumers to take certain precautions when handling TCVP products in residential areas. These precautions are listed on TCVP product labels, including: not allowing children to play with TCVP pet collar products, keeping TCVP spray and powder products out of reach of children, and washing hands thoroughly with soap and water after handling.” Advocates have raised concerns related to similar decisions on flea collars in the past in which EPA has issued warnings to mitigate risks, despite its inability to ensure children’s safety. EPA Postpones Glyphosate Cancer Review Meeting after Letter from CropLife America

(Beyond Pesticides, October 21, 2016) Last week, the U.S. Environmental Protection Agency (EPA) postponed  a long-planned Scientific Advisory Panel (SAP) on the carcinogenicity of the widely used herbicide glyphosate due to “recent changes in the availability of experts for the peer review panel.”  However, as veteran journalist, formerly with Reuters, Carey Gillam reports in the Huffington Post, the move was likely the result of a letter industry front group CropLife America sent to EPA just days before the postponement, challenging the bias of certain experts on the panel. Croplife America is a national trade association that represents manufacturers, formulators, and distributors of pesticides, and has a vested interest in tamping down consumer concerns over glyphosate’s carcinogenicity. CropLife’s letter focuses in on two experts that were set to present in front of the EPA panel, Peter Infante, Dr.PH., and Kenneth Portier, PhD. CropLife writes that Dr. Infante will “reflexively discount any and all industry sponsored studies”¦” and indicates that his bias should preclude him from participation in the SAP. Europe Releases Weakened Criteria for Regulating Endocrine Disruptors

(Beyond Pesticides, June 21, 2016) New regulations issued by the European Commission (EU) last week to regulate endocrine disruptors in pesticide products are being criticized by public interest groups and scientists as undermining the precautionary legal standard governing pesticide use in Europe. Previous  investigations and reports  have uncovered  industry’s attempt to quash efforts to enact robust protections from these harmful chemicals, despite their likely contribution to billions of dollars in lost revenue due to health effects. EC’s new rules endorse the World Health Organization’s definition of endocrine disrupting chemicals (EDC). The WHO defines an endocrine disruptor as “an exogenous substance or mixture that alters function(s) of the endocrine system and consequently causes adverse health effects in an intact organism, or its progeny, or (sub)populations,” However, the proposed regulations go little beyond defining the term. “The WHO definition is not a criteria, it is just a definition,” said Andreas Kortenkamp, PhD to The Guardian. “In effect, the commission has decided to place the burden of deciding how to regulate endocrine-disrupting chemicals onto the assessors on a case-by-case basis.” Of concern is the level to which the rules reflect a hazard or risk-based criteria. Report Compiles Over 400 Carcinogens Found in People’s Bodies

(Beyond Pesticides, June 14, 2016) A new report released yesterday by the Environmental Working Group (EWG) has found that up to 420 known or likely carcinogens have been measured in a diverse array of populations, and that exposure to these carcinogens is not limited to on-the-job contact with industrial chemicals, including pesticides. According to the National Cancer Institute, an estimated 1.7 million new cases will be diagnosed in the U.S. in 2016. While some of these cases may be due to genetic makeup, others may be caused by substances in the air, soil, food and other materials in our environment. Through a review of scientific literature and publicly available biomonitoring studies, EWG compiled a comprehensive inventory of known or likely carcinogens that have been measured in people. According to the EWG report, data from the National Health and Nutrition Survey, or NHANES, conducted annually by the Centers for Disease Control and Prevention, confirms that many of these carcinogens are in the bodies of Americans not at risk of occupational exposure — indeed, at any given time some people may harbor dozens or hundreds of cancer-causing chemicals. Europe Bans Two Endocrine Disrupting Pesticides

(Beyond Pesticides, April 27, 2016) The  European Union (EU)  has placed a moratorium on two endocrine-disrupting herbicides that are linked to thyroid cancer, infertility, reproductive problems and fetal malformations. The chemicals, amitrole and isoproturon, will be banned as of September 30, 2016, after the European Commission voted unanimously, for the first time, to ban the two endocrine disruptors. Earlier this month, the European Commission’s Standing Committee on Phytopharmaceuticals voted to ban the uses of amitrole and isoproturon in accordance with 2009-EU pesticide rules,  which state that endocrine disrupting pesticides should not be allowed on the European market. The committee finds that amitrole is capable of causing malformations in offspring and inducing thyroid cancer, while isoproturon can cause adverse effects to reproduction and lower fertility. In 2013 amitrole was voluntarily cancelled by the registrant, while isoproturon is not registered for use in the U.S. According to the Guardian, amitrole is widely used in 10 EU countries, including the UK, in industrial farming. EPA at Odds with Scientists on Endocrine System Effects of Weedkillers Atrazine and 2,4-D

(Beyond Pesticides, July 6, 2015) With the release of its  Tier 1 screening results  for the first 52 pesticide chemicals (active and inert ingredients) evaluated under  the Endocrine Disruptor Screening Program (EDSP), the U.S. Environmental Protection Agency (EPA) is at odds with a large body of scientific evidence worldwide that identifies many of these chemicals, most notably the herbicides  2,4-D  and  atrazine,  as interacting with the endocrine system or acting as endocrine disruptors. Independent scientific data has shown these chemicals to interfere with the hormone system. EPA’s EDSP is a multi-step process used to ensure that exposure to chemicals does not result in adverse human health and environmental effects that canoccur from the disruption of hormones. The two-tiered screening and testing system requires that EPA identify which chemicals are able to interact with the endocrine system, specifically with three hormonal pathways — estrogen, androgen, and thyroid — in Tier 1. EPA Responds to Call for Chlorpyrifos Ban with New Risk Calculations and Continued Use

(Beyond Pesticides, January 7, 2015) On Monday, the U.S. Environmental Protection Agency (EPA) released a revised human health assessment for the insecticide, chlorpyrifos, which finds risks to workers who mix, load and apply chlorpyrifos, and that the chemical has the potential to pose risks to drinking water in small watersheds. The assessment also notes that EPA will retain the 10X (10-fold) safety factor to protect children from all routes of exposures. EPA’s latest finding confirms long-standing scientific data that  has documented chlorpyrifos’ toxicity to humans and environmental contamination. However, despite these findings, EPA proposes to place additional restrictions on chlorpyrifos’ use, instead of a widespread ban. This latest assessment updates the June 2011 preliminary human health risk assessment, which was widely criticized by environmental and farmworker groups. EPA is releasing this assessment based on new information received since 2011, including public comments. The assessment is, in part, in response to a petition submitted by Natural Resources Defense Council (NRDC) and Pesticide Action Network (PAN) in 2007, which called on the agency to ban all uses of the insecticide. EPA Approves Enlist Duo®, Opens Gate to New Wave of GE Woes

(Beyond Pesticides, October, 16, 2014) Despite a massive outpouring of public opposition, the U.S. Environmental Protection Agency (EPA) announced yesterday that it has registered Enlist Duo ®, officially putting the rubber stamp of approval on the sale and use of a new wave of genetically-engineered (GE) 2,4-D tolerant crops. Developed by Dow AgroSciences, Enlist Duo ® is an herbicide that incorporates a mix of glyphosate and a new formulation of 2,4-D, intended for use on GE Enlist-Duo ®-tolerant corn and soybean crops. U.S. Representative Questions EPA’s Risk Assessment of 2,4-D-Based Herbicide

(Beyond Pesticides, September 2, 2014) U.S. Representative Henry Waxman (D-Calif.) sent a letter to the U.S. Environmental Protection Agency (EPA) last week asking them a poignant question: Why didn’t the human health risk assessment of Dow’s newest 2,4-D-based herbicide apply the ten-fold safety factor required by national law to protect children and infants? The question is a good one and events leading up to it began back in April 2014, when EPA opened up a public comment period for Dow AgroSciences’s application to expand the use of its 2,4-D choline salt herbicide, known as Enlist Duo ®, on 2,4-D-tolerant corn and soybeans. This application was the next step in ushering in a new wave of genetically-engineered (GE) crops sought to replace the quickly waning glyphosate-resistant or Roundup Ready ® varieties. As EPA described on its Enlist-Duo ® webpage, “Weeds are becoming increasingly resistant to glyphosate-based herbicides and are posing a problem for farmers. EPA’s Response on Pesticide Drift and Children’s Health Challenged

(Beyond Pesticides, June 5, 2014) Environmental advocacy groups filed an Administration Objection and a court appeal last week in order to challenge the Environmental Protection Agency’s (EPA) refusal to quickly correct errors in pesticide registrations and immediately implement measures to protect children from exposure to dangerous pesticides that drift from fields during and after application. EPA’s continued refusal to protect children’s health from pesticide drift is being criticized by numerous environmental, health, and farmworker advocacy groups. The groups, which include  United Farmworkers, Pineros y Campesinos Unidos del Noroeste, Pesticide Action Network of North America, Sea Mar Community Health Centers, California Rural Legal Assistance Foundation, Physicians for Social Responsibility, and Farm Labor Organizing Committee, originally filed a petition back in 2009 titled “Pesticides in the Air””Kids at Risk: Petition to EPA to Protect Children from Pesticide Drift (2009).” The petition asked that the agency properly comply with an existing law that requires EPA to protect children’s health from exposure to pesticides that drift from fields and orchards. Backdoor Farm Bill Amendment Orders EPA to Ignore Unsafe Levels of Fluoride in Kid’s Food

(Beyond Pesticides, January 30, 2014) With the U.S. House of Representatives’ passage of the Agriculture Act of 2014 (commonly known as the Farm Bill) yesterday, conventional farming allies and chemical agribusiness dealt a dangerous blow to children’s health protections and offered up yet another reason for consumers everywhere to support organic. The behind-closed-door amendment to the Farm Bill that appeared in neither the pre-conference House or Senate-passed versions of the Bill available to the public, orders the U.S. Environmental Protection Agency (EPA) to ignore its ruling that levels of fluoride left in food treated with the toxic fumigant sulfuryl fluoride are unsafe for consumers everywhere, especially children and infants. Looking at the Numbers Under the Food Quality Protection Act (FQPA), a law designed to provide stronger protections for infants and children from pesticides, EPA must consider the aggregate dose that children receive from pesticide residues along with the other “nonpesticidal” sources. EPA Acknowledges Low Dose Effects, Defends Its Current Testing Protocol

(Beyond Pesticides, June 28, 2013) The U.S. Environmental Protection Agency (EPA) released a draft “State of the Science” report last week acknowledging that low dose responses “do occur in biological systems” while defending its current risk assessment procedures as adequate for evaluating low dose effects. This report comes after EPA’s long running failure to fully implement a 1996 Congressionally mandated program to evaluate endocrine disruptors, and heavy criticism last year from prominent scientists who said EPA’s testing procedures are outdated. In 1999 the Natural Resources Defense Council (NRDC) filed a lawsuit against the EPA for failing to meet a statutory deadline for implementation of the Endocrine Disruptor Screening Program (EDSP) required under the 1996 Food Quality Protection Act, forcing the EPA to make a settlement agreement. As a result of  NRDC et al. v. EPA (No. C-99-03701 CAL) filed in the Northern District of California, EPA agreed to start requiring screening and testing of certain chemicals varying by date, using a tiered system. Industry Backed Legislation Directs EPA to Allow Hazardous Pesticide in Food

(Beyond Pesticides, April 29, 2013) Dow AgroSciences, one of the nation’s largest pesticide makers, along with various food companies, have persuaded several members of Congress to endorse a bill that directs the Environmental Protection Agency (EPA) to reverse a proposed phase out of sulfuryl fluoride, a highly toxic food fumigant and potent greenhouse gas. If passed, the bill would make the U.S. one of only two western nations to allow sulfuryl fluoride on food, increase the number of American children ingesting unsafe levels of fluoride, and create a food poisoning risk for consumers who  purchase food that contains permissible levels of the fumigant. The  Pest Free Food Supply Act, H.R. 1496, sponsored by Rep. Tom Graves (R-GA) and 14 others, seeks to prevent the proposed  phase out  of sulfuryl fluoride from taking effect. The phase out, which EPA proposed in January 2011, was prompted by a  joint petition from the Fluoride Action Network (FAN), Environmental Working Group (EWG) and Beyond Pesticides. Bayer, Syngenta Propose Bee Health Plan to Forestall Restrictions on Products

(Beyond Pesticides, April 3, 2013)   Last week, Syngenta and Bayer CropScience proposed an action plan to forestall pending European Union (EU) restrictions on their neonicotinoid products that have been linked to global bee declines.   Stating that a ban on their products would not save hives, the plan focuses on implementing agricultural best management practices, planting habitat, and new research and development, all of which fail to seriously address the real problem that their products are highly toxic to bees. This new industry plan comes on the heels of the European Union (EU) stalemate on bee health, and after the EU food safety agency concluded that certain neonicotinoids pose unacceptable risks to bees. Public and regulatory scrutiny is now focused on the class of chemicals — neonicotinoids— linked to bee health decline. Neonicotinoids have been shown by numerous studies to adversely impact the health of  bees, as well as  birds and aquatic organisms. Chlorpyrifos Preliminary Volatilization Assessment Finds Risks to Children; EPA Requests Comment to Address Uncertainties

(Beyond Pesticides, February 21, 2013) On February 6, the U.S. Environmental Protection Agency (EPA) released its preliminary volatilization assessment for the registration review of chlorpyrifos, finding that vapor phase chlorpyrifos may be emitted from treated fields at levels resulting in exposure to children and others who live, work, attend school, or otherwise spend time nearby.  In some circumstances, these bystanders may be exposed to chlorpyrifos and/or the transformation product chlorpyrifos-oxon at concentrations that could cause adverse effects. Citing uncertainties, the agency is requesting comments by March 8, 2013 on the potential risks to children and other bystanders from volatilization of chlorpyrifos from treated crops. EPA’s preliminary volatilization assessment is also in response to a petition filed by the Natural Resources Defense Council (NRDC) and the Pesticide Action Network North America (PAN) in 2007, which requested that the agency revoke all tolerances and cancel all registrations for chlorpyrifos. EPA Seeks Public Comment on Endangered Species Proposal

(Beyond Pesticides, August 30, 2012) The U.S. Environmental Protection Agency (EPA) announced on August 17 that it is seeking comments on a proposal developed jointly with the U.S. Department of Agriculture (USDA), the National Marine Fisheries Service (NMFS), and the U.S. Fish and Wildlife Service (FWS) to enhance opportunities for stakeholder input during pesticide registration reviews and endangered species consultations. The proposal specifically emphasizes coordination across federal agencies and expanding USDA’s role, as well as pesticide users to provide current pesticide use information to EPA’s ecological risk assessments. The proposal describes EPA’s plan to reach out to potentially affected pesticide users to discuss the technical and economic feasibility of draft Reasonable and Prudent Alternatives (RPAs) intended to avoid jeopardy to threatened and/or endangered species. It also describes the process by which public comments received on RPAs will be summarized and organized by EPA and provided to the Services, which will prepare a document to be included in the administrative record of the consultation explaining how comments were considered, and if appropriate, how the final biological opinion was modified to address the comments. MN Court Rejects Organic Farmers’ Lawsuit Charging Pesticide Drift Is Trespass

(Beyond Pesticides, August 6, 2012) The Minnesota Supreme Court reversed a ruling that gave organic farmers clear redress and decided that pesticide drift from one farm to another is not trespass, but instead must, in litigation, be found to be negligence or a nuisance. The ruling, while still giving farmers a legal channel to sue on pesticide drift, creates a higher standard for organic farmers to seek relief if their crops are damaged by pesticide drift. The ruling overturns a decision last summer by the state Court of Appeals that said pesticide drifting from its intended farm onto an adjacent organic farm could be considered a trespassing violation. EPA Wants Further Risk Mitigation Measures for Chlorpyrifos, Groups Want it Banned

(Beyond Pesticides, July 23, 2012) The U.S. Environmental Protection Agency’s (EPA) announcement last week of new agricultural risk mitigation measures for the neurotoxic insecticide chlorpyrifos continues to ignore farmworker health and that of their families, as well as the viability of organic farming systems in providing not only safer food, but safer working environments for farmworkers. The new measures, while a step in the right direction to protect vulnerable populations, do not go far enough to address the unreasonable risks associated with the chemical’s widespread continued use. The national pesticide law, the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA), requires protection against “unreasonable adverse effects to man or the environment.” In its latest decision, EPA seeks to reduce exposure to “acceptable” risk levels. In this case, the agency is seeking to reduce exposure of bystanders to spray applications. The measures include reductions in aerial application rates of the insecticide and the establishment of mandatory buffers around sensitive sites where bystanders including children are known to suffer exposure. EPA Reevaluating Its Commitment to Phase Out Toxic Fumigant

(Beyond Pesticides, May 14, 2012) The U.S. Environmental Protection Agency (EPA) is accepting public comment on several complex regulatory issues related to the agency’s commitment to phase out the toxic fumigant sulfuryl fluoride. At one time EPA had supported sulfuryl fluoride as a replacement for a second fumigant, methyl bromide, which the United States is obligated under international treaty to eliminate due to its contribution to ozone depletion. However, EPA reversed that support once further research and a refined risk assessment established that aggregate exposure to sulfuryl fluoride does not adequately protect the health of certain population subgroups. Although EPA decided unequivocally in 2011 to phase out all food-related uses for sulfuryl fluoride, the current public comment opportunity revisits key elements of that decision and could open the door for an unwarranted and unnecessary extension of this toxic fumigant’s allowance. Initially registered in 1959 to kill termites and other wood-boring pests, sulfuryl fluoride gained attention as a potential alternative to methyl bromide as a broad spectrum insect fumigant in post-harvest commodity storage and food processing facilities. Take Action: EPA Proposes Expansion of Neurotoxic Pyrethroid Uses

(Beyond Pesticides, January 31, 2012) The Environmental Protection Agency (EPA) has proposed an expansion in pyrethrins/pyrethroid insecticide uses as part of its cumulative risk assessment for this neurotoxic class of chemicals. In the cumulative risk assessment, EPA concludes that pyrethroids “do not pose risk concerns for children or adults,” ignoring a wealth of independent data that links this class of chemicals to certain cancers, respiratory and reproductive problems, and the onset of insect resistance. It went as far as to state that its cumulative assessment supports consideration of registering additional new uses of these pesticides, potentially opening the flood gates for manufacturers to bombard the market with more pyrethroid pesticides, endangering the health of the public. The agency is accepting public comments through February 8, 2012. Tell EPA that it has ignored numerous health effects and that these pesticides do pose unacceptable risks to human health given the availability of alternatives. (Beyond Pesticides, November 16, 2011) On November 9, 2011, the U.S. Environmental Protection Agency (EPA) issued its cumulative risk assessment for the pyrethroid class of insecticides, concluding that these pesticides “do not pose risk concerns for children or adults,” ignoring a wealth of independent data that links this class of chemicals to certain cancers, respiratory and reproductive problems, and the onset of insect resistance. The agency went as far to state that its cumulative assessment supports consideration of registering additional new uses of these pesticides, potentially opening the flood gates for manufacturers to bombard the market with more pyrethroid pesticides, endangering the health of the public. EPA issued the final pyrethins/pyrethroid cumulative risk assessment in the Federal Register and is requesting comment until January 9, 2011, including information that may be used to further refine the assessment. Pyrethroids are a widely used class of insecticides used for mosquito control and various insects in residential and agricultural settings. However pyrethroids are highly neurotoxic and have been linked to cancer, endocrine disruption, suppression of the immune system, and various reproductive effects. European Food Still Heavily Contaminated With Dangerous Cocktails Of Pesticides

(Beyond Pesticides, November 9, 2011) A 2009 European Union (EU) report on pesticide residues, published yesterday by the European Food Safety Authority (EFSA), shows food on the European market is still heavily contaminated with cocktails of pesticides. The percentage of EU food in shops and markets with multiple residues remains at a high level of 25.1%, meaning only a slight improvement in the last five years of reporting. The highest reported number of pesticide chemical residues in one food item remains at 26: One sample analyzed had 26 different pesticides! Like the U.S. where consumers are exposed through food and drinking water to a variety of chemical mixtures of pesticide food residues, EU citizens also continue to be exposed to mixtures of pesticides on a daily basis. According to the report , compliance with the legal maximum residue levels (MRLs) for pesticides in food rose to 97.4 percent of the analyzed samples in 2009, up by about one percentage point from 2008, EFSA said. However, like their counterparts in the U.S., the regulatory entities EFSA and European Commission still do not protect people against the effects of mixtures.
