Study Finds Pesticide Use Does Not Increase Profits for Farmers

(Beyond Pesticides, March 10, 2017) A French study published last week has found that higher pesticide use does not mean larger profits, demonstrating that farmers can reduce their usage of pesticides without worrying about their profits being affected, in most cases. Similar studies have shown that organic and conventional yields are comparable, supporting the case for farmers to transition from high pesticide use to healthier, safer, and more profitable alternatives. The study, led by Martin Lechenet, a PhD student with the French National Institute for Agricultural Research, looked at data from 946 French farms, including yields, pesticide application rates, soil characteristics, and local climate conditions. The researchers then used a model to focus on the relationship between pesticide application rates and productivity or profitability. They found that, in 77% of the farms, higher pesticide use was not linked to a higher profit. The researchers then estimated that pesticide use could be reduced by 42% without any negative effects on current profit levels in 59% of farms in their national network. EPA Finds Risks to Bees from Neonicotinoid Insecticides, Fails to Act Accordingly

(Beyond Pesticides, January 17, 2017) On January 12, 2017, the U.S. Environmental Protection Agency (EPA) released major risk assessment documents on  pollinator exposure to bee-toxic neonicotinoid insecticides finding no significant risks, despite the large and growing body of science identifying the pesticides’ hazards. In the documents, EPA identifies risks posed to bees by several neonicotinoid insecticides, but suggests that no restriction on uses are imminent. In another decision meant to protect bees from acutely toxic pesticides, the agency is scaling back its original proposal in deference chemical-intensive agricultural interests. EPA’s long awaited pollinator assessments for the neonicotinoids: clothianidin, thiamethoxam, and dinotefuran, much like the 2016 pollinator assessment release for imidacloprid, identifies risks to bees from the agricultural applications (foliar, soil and seed) of these chemicals, including from pesticide drift. Observed effects include decline in worker bees, and subsequent declines in brood and pollen stores in the colony. EPA‘s assessments continue to focus on honey bees, with cursory mention of wild, native bees. Death of Four Texas Children Linked to Inadequately Regulated Pesticide, Follows Other Deaths

(Beyond Pesticides, January 4, 2017) The New Year saw its first pesticide-related tragedy yesterday when four children, ranging in age from 7-17, died from a toxic pesticide treatment on their house in Amarillo, Texas. The pesticide at issue, aluminum phosphide, was illegally applied under a mobile home where at least ten people were living. The chemical, classified by the U.S. Environmental Protection Agency (EPA) as a restricted use pesticide (RUP), is restricted for use by certified applicators (and those under their supervision) and it is a violation to use it within 100 feet of residential structures. CNN reports that a family member used water to try and wash away the pesticide after it was applied, and the combination of water and aluminum phosphide increased the release of toxic phosphine gas. The incident demonstrates the deficiency of managing risks of highly toxic chemicals by labeling them “restricted use.” It has been Beyond Pesticides’ position that chemicals with aluminum phosphide’s level of toxicity should not be available on the market, even with restrictions. Cases of Pesticide Poisoning Up in California, Including Agricultural and Residential Areas

(Beyond Pesticides, December 21, 2016) A California Department of Pesticide Regulation (DPR) report of all pesticide related illnesses in the state in 2014 identifies 1,685 cases “potentially involving health effects from pesticide exposure,” combining exposures from agricultural and non-agricultural use. Of the 798 cases associated with non-agricultural use, 18% of them (146 cases) involved exposure in children under 18 years old. The exposure rates are alarming, and only strengthen efforts by local activists in counties like Tulare to protect children from pesticide exposure. According to the report, Tulare County has the highest number of reported illnesses related to pesticide exposure at 78, followed by Santa Cruz County with 67. The report, Summary of Results from the California Pesticide Illness Surveillance Program 2014, provides a summary of illnesses identified by the Pesticide Illness Surveillance Program (PISP), a program under DPR. Of the 1,685 cases potentially involving health effects from pesticide exposure reported, DPR epidemiologists determined that 1,073 of those cases were “at least possibly associated” with pesticide exposure, representing a 5% decrease from 2013. Help Protect California School Children from Pesticides in Communities Where Most U.S. Food is Grown: Send Comments by Dec. 9

Send a  short email to the California Department of Pesticide Regulation (DPR) ([email protected]) to tell the Department it  must expand proposed buffers around schools to one-mile to protect school children during and after school hours, and expand the rule to cover all schools and daycare centers. Given that, according to the California Department of Food and Agriculture’s latest statistics, “Over a third of the country’s vegetables and two-thirds of the country’s fruits and nuts [and a large share of dairy and livestock] are grown in California,” everyone who eats food in the U.S. has a stake in protecting children who live in the communities where the food is grown. Industry Challenges Local Maryland Restrictions of Lawn Pesticides as Preempted by State

(Beyond Pesticides, November 30, 2016) A landmark Montgomery County, Maryland ordinance, which protects children, pets, wildlife, and the wider environment from the hazards of unnecessary lawn and landscape pesticide use, is facing a legal challenge filed last week by the industry group Responsible Industry for a Sound Environment (RISE). The plaintiffs, which include local chemical lawn care companies and a few individuals, allege that the local ordinance is preempted by state law, despite the fact that Maryland is one of  seven states  that has not explicitly taken away (or preempted) local authority to restrict pesticides more stringently than the state. This challenge comes on the heels of a recent decision by the 9th  U.S. Circuit Court of Appeals, which struck down local laws in Hawaii aimed at protecting the environment from toxic pesticide use. Court Knocks Down Local Pesticide Restrictions on Private Property in Hawaii, Upholds Restrictions on GE Crops

(Beyond Pesticides, November 22, 2016) Last week the 9th U.S. Circuit Court of Appeals struck down local county laws aimed at protecting residents’ health and the environment in Hawaii. The ruling, handed down by federal Circuit Judge Consuelo M. Callahan, finds that Hawaii state law is comprehensive in regulating pesticides, and “impliedly preempts” local jurisdictions from passing laws with stricter standards than the state’s. The decision represents a victory for Monsanto, Syngenta, and the agrichemical industry, and a blow to the efforts of grassroots activists that say Hawaii is “ground zero” for toxic and experimental pesticide and genetically engineered (GE) crop use. Judge Callahan’s ruling overturns a number of laws passed over the last several years on different Hawaiian Islands that all aim to protect residents, the environment, and organic farms from the toxic effects of pesticide use and drift from GE cropland. This includes Bill 2491, a measure in Kauai County that imposed common-sense buffer zones for pesticide use within 500 feet of schools and medical facilities, and within 100 feet of any park, public roadway, or shoreline that flows into the ocean. Holistic Weed Management Benefits Farmers and the Environment

(Beyond Pesticides, November 21, 2016) The potential benefits of “weeds” have long been ignored, but a new study attempts to quantify the benefits of all species within an agricultural system, including the undesirable ones. The study, Integrating Insect, Resistance, and Floral Resource Management in Weed Control Decision-Making, by Cornell University scientists, assesses and updates holistic integrated pest management practices. In a discussion with the Cornell Chronicle, lead author of the study, Antonio DiTommaso, Ph.D., states, “Managing crop pests without fully understanding the impacts of tactics —related to resistance and nontarget plants or insects— costs producers money.” The authors introduced a weed management decision framework that accounts for weed benefits and illustrates that by allowing low levels of weeds in a cropping system, a farmer can increase crop yields and provide numerous ecosystem services. In a case study of an herbicide-tolerant corn cropping system, which had been controlled primarily with glyphosate,  the authors demonstrated that the European corn borer (ECB) could be reduced  through holistic management decision making. FDA Stops Testing for Glyphosate as New Report Finds High Levels Are Found in Food

(Beyond Pesticides, November 18, 2016)  The Food and Drug Administration (FDA) has suspended testing for glyphosate residues in food, according to a  statement made to the  Huffington Post. The suspension was announced as a  new report  was released from  Food Democracy Now!  and the Detox Project, which has exposed dangerous levels of glyphosate contamination in popular U.S. foods. Glyphosate has been  found to cause changes to DNA functioning, resulting in chronic disease, and has been  classified as a probable carcinogen  by the International Agency for Research on Cancer. In February 2016, FDA  announced  that it would start testing for glyphosate in food, following  sharp criticism  from the U.S. Government Accountability Office (GAO) for not using statistically valid methods consistent with Office of Management and Budget (OMB) standards to collect information on the incidence and level of pesticide residues. Now, the agency has suspended testing amid difficulties establishing a standard methodology to use across the agency’s multiple U.S. laboratories, according to  Huffington Post. NOSB Meets This Week, as Hydroponic Farmers Seek Formal Allowance to Use Organic Seal

(Beyond Pesticides, November 17, 2016) This week, the National Organic Standards Board (NOSB) is meeting in St. Louis to hear public comments on organic agricultural issues that will ultimately influence standards and processes. One major issue before the board is a motion on whether hydroponic and aquaponics operations can be certified organic. Farmers that practice hydroponic growing techniques are hoping to get the attention of the NOSB as they make an argument for their place in the certified organic industry, while others will be there to reject these arguments and uphold organic as soil-based agriculture. Despite a 2010 recommendation from the NOSB to prohibit allowing hydroponic production to quality as organic, USDA’s National Organic Program allowed organic labeling of the sector, which has experienced rapid growth in recent years. Typically, consumers have no way of knowing that the organic labeled prodeucts they are buying were grown organically. The NOSB is an advisory group, made up of 15 public experts, that makes direct recommendations to the U.S. Secretary of Agriculture on organic production, handling, and processing. Lawsuit Challenges “Pure” and “Natural” Label on Honey Contaminated with Glyphosate

(Beyond Pesticides,  November 3, 2016) Beyond Pesticides and the Organic Consumers Association (OCA), represented by Richman Law Group, filed a lawsuit yesterday in Superior Court in the District of Columbia against Sioux Honey Association, for the deceptive and misleading labeling of its Sue Bee and Aunt Sue’s honey brands. The suit follows news that Sue Bee honey products labeled “100% Pure” and “Natural” tested positive for glyphosate residue. Glyphosate, a known endocrine disrupter and, according to the World Health Organization, a probable human carcinogen, is the active ingredient in Monsanto’s Roundup ÂŽ herbicide. “A consumer seeing the words ”˜Pure,’ ”˜100% Pure’ or ”˜Natural’ on a honey product would reasonably expect that product to contain nothing other than honey,” said OCA International Director, Ronnie Cummins. “Regardless of how these products came to be contaminated, Sioux Honey has an obligation to either prevent the contamination, disclose the contamination, or at the very least, remove these deceptive labels.” Jay Feldman, Executive Director of Beyond Pesticides, said: “We join and support those beekeepers who are working to stop hazardous pesticides uses that cause widespread contamination of crops, including honey. Massachusetts Attorney General Stops Deceptive Safety Claims about Bee-Toxic Pesticides, Beyond Pesticides Urges Other States to Follow

October 26, 2016)  With the Massachusetts Attorney General forcing Bayer CropScience to end its statewide advertising containing deceptive safety claims about bee-toxic pesticides, Beyond Pesticides yesterday asked the other 49 states to do the same. In a letter to State Attorneys General, Beyond Pesticides said, “With neonicotinoid (neonic) insecticides linked to the increase in pollinator decline, we are writing to urge you, on behalf of our members in your state, to stop misleading and fraudulent advertising of these pesticide products.” Beyond Pesticides continues, “We make this request following the settlement reached by Massachusetts Attorney General Maura Healy with Bayer CropScience, announced today, that ends the company’s deceptive advertising practices on their neonicotinoid-containing lawn and garden products.” Bayer agreed to change its advertising practices, so that the neonic-containing lawn and garden products are no longer misrepresented by false safety claims. Oregon Approves 26 Recreational Marijuana Retailers

(Beyond Pesticides, October 4, 2016) Last week, the  Oregon Liquor Control Commission (OLCC) approved 26 licences for 26 recreational marijuana retailers as well as modified state rules regarding state licensure testing requirements and packaging limitations. According to a OLCC press release, some of the marijuana retailers began operating on October 1st, fulfilling the OLCC’s promise to Oregon’s citizens that recreational marijuana stores would be open for business in fall 2016. OAR 845-025-5700 previously required that all batches be tested for pesticides. Under the new Oregon Administrative Rules (OAR) Temporary Pesticide Rules (“Limited Batch Testing”) OAR 845-025-5700, effective September 30, 2016 until March 1, 2017, the OLCC requires a minimum of 33.3% of batches per harvest lot of cannabis to be tested. According to OAR 333-007-0010, if the OLCC finds that there is not enough laboratory capacity for pesticide testing, the Commission may permit randomly chosen samples from batches of usable marijuana to be tested for pesticides by a licensed lab, rather than requiring every batch of usable marijuana from a harvest lot to be tested. EPA Fines Syngenta $1.2 Million for Multiple Safety Violations under Settlement

(Beyond Pesticides, September 27, 2016)  Multinational pesticide manufacturer Syngenta Crop Protection was handed a  $1.2 million fine last week for multiple violations of federal pesticide law, according a settlement reached with the U.S. Environmental Protection Agency (EPA). EPA charged Syngenta with three major violations of the Federal Insecticide Fungicide and Rodenticide Act (FIFRA), including: (1) Failure to have repackaging agreement and/or maintain records on registered pesticides; (2) Distributing misbranded pesticides, and; (3) Failure to maintain data submitted for pesticide registration. However, under the consent agreement reached with EPA, the company neither admits nor denies the allegations. The settlement comes at a time of increased scrutiny of Syngenta, as the company is in the process of reregistering the herbicide atrazine, and Chinese National Chemical Corporation (ChemChina) continues its attempts to complete a $43 billion merger. While the plan appears to have cleared U.S. regulatory hurdles, European lawmakers have yet to sign off on the deal. “The repackaging, sale and distribution of unregistered and misbranded pesticides is illegal and puts people and the environment at risk. Cannabis Certification Program Restricts Pesticides and Residues

(Beyond Pesticides, August 31, 2016) Last week, a Denver marijuana company went through its first inspection for the Colorado-based Organic Cannabis Association’s (OCA) new “pesticide-free” certification. This voluntary certification program was developed by OCA following an indefinite postponement of the Pesticide-Free Marijuana Bill, HB 16-1079 by the Colorado Senate and the failure of  the Colorado Department of Agriculture (CDA) to implement meaningful regulations to protect  users within the state from pesticides that are not regulated  for use in cannabis production by the U.S. Environmental Protection Agency (EPA) and the states. While the certification program is characterized as “pesticide-free,” it is focused on residues on the finished product, allowing the use of pesticides that do not appear on the narrow list of those restricted by the state of Colorado. The certification is a a step in the right direction for consumers who wish to protect themselves from unwanted pesticides in their cannabis products, however it is important to note that it  does not equate to a USDA organic inspection, as marijuana remains illegal at the federal level and is unable to qualify for certification under the USDA National Organic Program (NOP). Non-Profits Sue General Mills for False and Misleading Use of ‘Natural’

Tests Reveal Nature Valley Products Contain Glyphosate, an Ingredient in Monsanto’s Roundup Washington, DC, August 25, 2016 – Today, three non profit organizations filed a lawsuit against General Mills for misleading the public by labeling their Nature Valley brand granola bars “Made with 100% NATURAL whole grain OATS.” It was recently discovered that the herbicide chemical glyphosate, an ingredient in Roundup and hundreds of other glyphosate-based herbicides, is present in the Nature Valley granola bars, which consumers expect to be natural and free of toxins. Moms Across America, Beyond Pesticides and Organic Consumers Association with The Richman Law Group filed jointly on behalf of the non profit members in Washington DC under the District of Columbia’s Consumer Protection Procedures Act. “As a mother, when I read “100% Natural” I would expect that to mean no synthetic or toxic chemicals at all. Senator Blumenthal Calls for Repeal of New, Weak GE Labeling Law that Preempts States

(Beyond Pesticides, August 23, 2016) “Fundamentally anti-consumer,” said U.S. Senator Richard Blumenthal (D-CT) of the new genetic engineered (GE) labeling bill signed into law by President Obama late last month. Senator Blumenthal’s frustration with the new legislation and its preemption of state-level laws such as Vermont and Connecticut’s led the Senator to announce he will be introducing a bill next session to repeal the divisive law. After years of state-level ballot initiatives in California, Oregon, Washington State, and Colorado, which were defeated after the chemical industry poured millions of dollars into ad buys that played on consumer fears of higher prices at the check-out line, Maine and Connecticut took a stand for consumer’s right to know. While their legislation required trigger clauses to go into effect, Vermont’s was passed shortly after without such a clause, and withstood a legal challenge from the multinational food and chemical industry. President Signs Weak Product Labeling Law on Genetically Engineered Ingredients, Preempts States

(Beyond Pesticides, August  1, 2016) As expected, President Obama signed into law an amendment to S. 764, the National Bioengineered Food Disclosure Law, which establishes a national GMO (genetically modified  organisms or genetically engineered-GE) food labeling requirement that food safety advocates say may be deceptive, preempts states from adopting stronger label language and standards, and excludes a large portion of the population without special cell phone technology. Pushed by Senators Debbie Stabenow (D-MI) and Pat Roberts (R-KS), the law is being characterized by its supporters as a compromise, stronger than the original legislation, the Biotechnology Food Labeling and Uniformity Act (S.2621), which was dubbed the Deny Americans the Right to Know (DARK) Act. That bill failed to reach cloture in the Senate in March. The U.S. Department of Agriculture, a big supporter of genetically engineered food production, will have two years to develop the standard, during which time it will assess the question of equitable access to the disclosure of ingredients. This new law will invalidate a stronger GMO labeling law that took effect in Vermont on July 1. Congress Proposes to Strip Farmworker Protection Standards in Funding Bill

(Beyond Pesticides, July 14, 2016) A funding bill (H.R. 5538) for the Environmental Protection Agency (EPA) and Interior Department is receiving pushback from conservation groups, environmental lobbyists, and workers’ rights advocates for containing dozens of controversial amendments, including  one that would strip funding for parts of the Agricultural Worker Protection Standard (WPS), which establishes many  protections for  those  in the country who experience the highest and most dangerous pesticide exposure — farmworkers. Title IV, Section 437 of H.R. 5538 states that, “None of the funds made available by this or any other Act may be used to implement or enforce, or to require States to implement or enforce, the provisions of 40 CFR 170.311(b)(9) as published in the Federal Register on November 2, 2015.” The provisions of 40 CFR 170.311(b)(9) refer to the WPS revisions passed in 2015, which had previously not been updated for over 20 years. The revisions are designed to provide at least some protections from pesticide exposure to farmworkers and their families is scheduled to effect in  December 2016. U.S. Senate Moves to Limit GMO Labeling

(Beyond Pesticides, July 7, 2016) Despite an outpouring of letters, calls and protests, in a key procedural vote yesterday, the Senate voted to deny Americans the right to know what is in in their food products, and to preempt states’ rights to create their own genetically engineered food labeling laws. In a cloture vote of 65-32, the highly-flawed genetically engineered (GE or GMO) labeling bill, S.B. 764, offered by Senators Debbie Stabenow (D-MI) and Pat Roberts (R-KY), also known as the Deny Americans the Right to Know (DARK) Act, passed through the Senate. This “compromise” bill allows producers to use QR codes and “smart labels” instead of clear, on-package labeling of food products that contain genetically modified organisms, which means that consumers will need to use a smart phone for the information.
