Herbicide Use and Chemical Inputs Doubled on VT Dairy Farms with GE Crops

(Beyond Pesticides, June 29, 2016) A new report published by Regeneration Vermont finds that herbicide and chemical fertilizer use on Vermont dairy farms nearly doubled from 2002 to 2012, increasing from 1.54 to 3.01 pounds of herbicide per acre, respectively. The report, Vermont’s GMO Legacy: Pesticides, Polluted Water & Climate Destruction, by Will Allen, Ph.D. of Regeneration Vermont and Cedar Circle Farm, focuses on the failed promises of genetically engineered (GE, or GMO) crops to reduce chemical inputs required for crop production. While Vermont leads the nation on the GE labeling front, with its  law set to go into effect on July 1, the report, which highlights the flawed exemption on dairy and meat products, is a sobering reminder that this is only a part of the solution to the effects of GE crops and chemical-intensive agriculture. “While the law will force mainstream food corporations to label GMOs in products like Cheetos and Spaghetti-os before coming into the state, it turns a blind eye to the GMO-derived dairy that is the primary ingredient in, for example, Ben & Jerry’s ice cream and Cabot’s cheddar cheese,” says Dr. Allen. “This is about more than the consumer’s right to know. Senate Strikes a DARK Deal on GMO Labeling

(Beyond Pesticides, June 28, 2016) In an effort to block the impending implementation of Vermont’s genetically engineered (GE) food labeling law, Senators Debbie Stabenow (D-MO) and Pat Roberts (R-KS) have struck a deal aimed at continuing to keep consumers in the dark about the ingredients in the food they eat. Vermont’s law, signed on May 8, 2014 by Governor Peter Shumlin (D), is set to go into effect on July 1, 2016. After the state defeated a legal challenge brought by the Grocery Manufacturers of American and other industrial food companies, opponents pivoted their efforts to Congress, where they pushed for the so-called DARK (Denying Americans the Right to Know) Act, which would have codified a voluntary labeling system nationwide and preempted Vermont’s law. The DARK Act was passed through the House, yet failed to secure enough votes in the Senate. Despite Senator Stabenow voting against the DARK Act earlier this year, she has now reached a DARK deal that, in effect, would continue to deny Americans important information about the presence of genetically engineered ingredients in the food we eat. International Panel Calls for End to Industrial Agriculture, Shift to Diversified Systems

(Beyond Pesticides, June 7, 2016) A wholesale change in agricultural practices is necessary to ensure protection of human health and the environment over the long-term, according to a wide-ranging report authored by the International Panel of Experts on Sustainable Food Systems (IPES), “a fully independent panel, without financial or organizational ties to any corporations, governments or intergovernmental agencies.” The report, From Uniformity to Diversity, calls for a paradigm shift from industrial agriculture to diversified agroecological systems. According to the report, diversified agroecology focuses on maintaining multiple sources of food production, and farming by applying ecological concepts and principles to the design and management of food systems. Industrial agriculture, on the other hand, requires highly-specialized production of a single food crop, and, through scale and task separation, focuses on increasing productivity through intensification. While monocultures and concentrated animal feeding operations (CAFOs) are characteristic of industrial agriculture, agroecological practices embrace spatial and temporal diversification (through practices like crop rotation and intercropping), and focus on multiple outputs. Maryland Residents Asked to Urge Governor to Sign Pollinator Protection Act, Under Threat of Veto this Week

(Beyond Pesticides, May 26, 2015) Maryland’s historic Pollinator Protection Act, (SB 198 and HB 211) may be in danger. Last month, lawmakers approved the bill by a 98-39 vote in the Maryland House of Delegates, however it faces the possibility of a veto by Governor Larry Hogan (R). While the governor’s office says that the bill is currently under review, according to local news source WBAL, the governor is prepared to veto the bill, which he has until tomorrow, Friday, May 27, to do. If the governor does veto the bill, Maryland’s Pollinator Protection Act will go back to the legislature for an override vote, which will take place in early 2017. Meanwhile, beekeepers continue to lose their bees at unprecedented rates. Last week, we reported results of 2015-16 Colony Loss Survey, which show no sign that the crisis of abating. According to the survey, beekeepers lost 28.1% of their colonies over this past winter, and a total of 44% of their colonies over the last year. Organic Consumers Association Sues to Keep Synthetics Out of Organic Infant Formula

(Beyond Pesticides May 3, 2016) Last week, the Organic Consumers Association (OCA) filed lawsuits against two popular infant formula makers for falsely labeling their products as organic. The claims against both The Honest Co. and Hain Celestial Group allege that their products contain ingredients that are prohibited under the Organic Food Production Act (OFPA) of 1990 as well as non-organic and non-agricultural ingredients. The lawsuit against The Honest Company alleges the product contains 11 synthetic ingredients that are not allowed by federal law in organic products, including sodium selenite and taurine. In the court documents, OCA also claims that some of the ingredients have not been “assessed as safe for human foods — much less for infant formulas.” “No one is more concerned about food labels and ingredients than new mothers responsible for feeding infants whose immune systems and brain development are so underdeveloped and vulnerable. As consumers, these mothers must rely on truthful labeling in order to make the best choices for feeding their infants and toddlers. GAO Finds USDA Regulation of Genetically Engineered Crops Deficient

(Beyond Pesticides April 20, 2016) A recently released study by the U.S. Government Accountability Office (GAO) assesses the actions of three government agencies responsible for regulating genetically engineered (GE) crops, finding several shortcomings in the process. The report, which was commissioned by U.S. Senator Jon Tester (D-MT), is entitled Genetically Engineered Crops:  USDA Needs to Enhance Oversight and better Understand Impacts of Unintended Mixing with Other Crops. The report finds that while the Environmental Protection Agency (EPA), Food and Drug Administration (FDA), and U.S. Department of Agriculture (USDA) have taken some steps to regulate GE crops, USDA’s failure to update its regulations that oversee GE crops has created a large data gap on the extent and impact of the unintended mixing of GE and non-GE crops. To address this, GAO recommends, among other things, that USDA set a timeline for updating its regulations and include farmer’s growing identity-preserved crops in its survey efforts to better understand the impacts of unintended mixing. Maryland Legislature Bans Retail Sales of Bee-Toxic Neonicotinoid Pesticides

(Beyond Pesticides, April 11, 2016) In a historic move, the Maryland legislature voted to become the first state in the nation to ban consumers from using products containing neonicotinoid pesticides, a class of bee-toxic chemicals that has been linked to the startling decline in bees and other pollinators around the world. The bill now heads to Governor Larry Hogan to sign or veto. The Pollinator Protection Act was approved by lawmakers on Thursday by  a 98-39 vote in the Maryland House of Delegates. While consumers will not be allowed to buy pesticide products containing neonicotinoids starting in 2018, the legislation’s  reach does not extend to farmers, veterinarians, and certified pesticide applicators, who will still be permitted to apply  the chemicals. Consumers can also buy treated plants and seedlings from stores without any labeling. Cumulatively, these present major sources of exposure for bees and other pollinators. The bill originally included a requirement that companies put labels on plants and seeds that are treated with neonicotinoids, but that provision was ultimately pulled from the bill. EPA Introduces Safer Choice Label for Cleaning Products

(Beyond Pesticides, April 7, 2016) Last month, the U.S. Environmental Protection Agency (EPA) introduced the Safe Choice Program (not to be confused with Beyond Pesticides’ longstanding Safer Choice program), an overhauled labeling system created by Design for the Environment (DfE) that encourages consumers to seek out and use cleaning products that protect public health and the environment. Safer Choice uses the technical expertise of its DfE workgroup of EPA scientists to compare ingredients in the same functional class and thereby identify those ingredients with the lowest hazard profile. In order to earn a Safer Choice Standard label, products must have chemical ingredient formulations that “function in making the product work,” which allows formulators “to use those ingredients with the lowest hazard in their functional class.” Safer Chemical Ingredients are listed on EPAs website. “EPA’s Safer Choice program helps consumers find products that are productive and contain ingredients that are safer,” said EPA Mid-Atlantic Regional Administrator Shawn M. More Companies To Label for GE Ingredients, While Maintaining Their Safety

(Beyond Pesticides, March 24, 2016) This week, four major food manufacturing companies, Kellogg’s, General Mills, Mars, and ConAgra, committed to labeling food containing genetically engineered (GE) ingredients, while exclaiming the safety of GE food. Each company released statements citing the new Vermont labeling law, set to take effect this summer. The four companies joined Campbell Soup Company, which announced its  own label on GE ingredients in January. At the time,  Agri-Pulse reported, “Campbell made clear that it still supported the use of genetic engineering in agriculture, but said that there is a need for national labeling standards that would preempt state standards.” A summary of the companies’  releases are as follows: Kellogg’s Kellogg’s North America President, Paul Norman, insists upon the adoption of a “federal solution for the labeling of GMOs.” Until that happens, he says, “We will start labeling some of our products nationwide for the presence of  GMOs beginning in mid-to-late April. Senate Blocks Vote on Bill To Stop GE Labeling

(Beyond Pesticides, March 17, 2016)  Yesterday,  the U.S. Senate  voted to block a vote  on a food labeling bill that would eliminate consumers’ right to know whether genetically engineered (GE) ingredients are in the food they purchase. Senate Amendment  3450,  National Voluntary Bioengineered Food Labeling Standard, proposed by Senator Pat Roberts (R-KS), failed to garner the  60 votes necessary for cloture, which would have ended the debate and allowed a vote on the bill. The  vote of 48-49 effectively killed the Senate bill. The amendment is the Senate version of H.R. 1599, Safe and Accurate Food Labeling Act, sponsored by  Representative Mike Pompeo (R-KS).  Opponents have dubbed the legislation the Deny Americans the Right to Know Act (DARK Act). The bill passed the House in July, 2015 on  a  vote of 275-150. In addition to  preempting the ability of all  states to impose mandatory labeling standards, the bill imposes a weak voluntary federal scheme in its place. Senate Democrats Introduce Bill Requiring GE Food Labeling, Includes Preemption of States

(Beyond Pesticides March 9, 2016) Last week, Senators Jeff Merkley (OR), Patrick Leahy (D-VT), Jon Tester (D-MT), and Dianne Feinstein (D-CA) introduced legislation to  require  that consumer food packaging  displays genetically engineered (GE) ingredient labeling. The Senators’ legislation, the Biotechnology Food Labeling and Uniformity Act  (S.2621), presents an alternative to the primarily Republican-backed Biotechnology Labeling Solutions Bill that recently passed the Senate Agriculture Committee on a 14-6 vote. The Biotechnology Labeling Solutions Bill, which embodies several provisions of the much opposed DARK Act, will  hide ingredient information from consumers by overturning state GE labeling laws like that of Vermont’s. “Rather than blocking consumers’ access to information they want, the U.S. Senate should move forward with a solution that works for businesses and consumers alike,” said Senator Merkley. “There is a way to give consumers the information they are asking for without placing unfair or conflicting requirements on food producers. Label Warning on Dangerous PCP-Treated Poles Deemed Unconstitutional

(Beyond Pesticides, March 3, 2016) Last month, U.S. District Court Judge Arthur Spatt declared a dangerous wood preservative label ordinance unconstitutional, ending a three year battle between a New York town and Public Service Enterprise Group (PESG). In 2014, under the authority of the Long Island Power Authority (LIPA), PESG installed thousands of hurricane-resistant utility poles containing the hazardous wood preservative pentachlorophenol (PCP or penta). The U.S. Environmental Protection Agency (EPA) defines pentachlorophenol as “extremely toxic” to humans even from short-term exposure and is listed as a “probable human carcinogen.” Judge Spatt cited the First Amendment doctrine of commercial speech, stating that, “In order to qualify as commercial speech, the message sought to be regulated must necessarily bear some discernible connection to the commercial interests of the speaker.” Because the utility poles are not intended to be sold to the public nor influence consumer behavior, PESG is not required to post “compelled warning signs” on their dangerous utility poles. Feminine Hygiene Products Tainted with Glyphosate, Other Toxic Chemicals

(Beyond Pesticides, February 25, 2016) Feminine care products sold in France may contain “potentially toxic residues,” according to a study conducted by 60 Millions de Consommateurs, a French consumer rights group. The study finds  traces of chemicals, such as dioxins and insecticides, in 5 of 11 products tested. A separate analysis conducted by Corman, a manufacturer of feminine care products, also finds  residues of the weedkiller glyphosate, which was classified in March 2015  as a probable carcinogen by the International Agency for Research on Cancer (IARC). Researchers at 60 Millions  reported finidng traces of halogenated waste, a by-product related to the processing of raw materials, in Tampax Compak Active Regular Fresh tampons. The researchers also detected residues of organochlorine and pyrethroid pesticides, linked to a wide range of adverse health impacts, in some Always sanitary towels. Highly toxic dioxins, which can be cause cancer, reproductive and developmental problems and damage the immune system, according to the World Health Organization, were also found in products by OB and the European Nett brands. Colorado Legislature Considers Pesticide-Free Marijuana Bill

(Beyond Pesticides February 24, 2016) Last Friday, Colorado’s House Public Health Care and Human Services Committee heard a proposal to create a contaminant-free certification system for marijuana sold within the state. This program, intended to resemble the federal National Organic Program, was offered as a legislative response to protect consumers after the Colorado Department of Agriculture (CDA) failed to implement meaningful regulations to keep marijuana users within the state safe from the harms associated with unregulated pesticides use on cannabis crops. If the proposal moves forward, Colorado will becomes the first state to establish and regulate an organic label in its marijuana  industry, paving the way for other states with legalized marijuana industries to follow suit. Massachusetts and New Hampshire require that cultivation practices are consistent with USDA national organic standards. “Consumers have a right to know what they’re putting in their body,” said Colorado Rep. Jonathan Singer, co-sponsor of HB16-1079, which requires that CDA set up an independent program to certify that cannabis sold in the state is pesticide-free. Oregon Proposes Legislation to Protect Farmers and Consumers from GE Contamination

(Beyond Pesticides, January 28, 2016) Last week, Oregon Representative Paul Holyey introduced legislation that would protect traditional crops against contamination from their genetically engineered counterparts. As it stands, local governments are preempted (disallowed) from taking actions that protect traditional farmers from contamination by genetically engineered (GE) crops. With the help of advocates representing family farms and food safety, The Transgenic Contamination Prevention Bill (HB 4122) will  repeal sections of Senate-passed  Bill 863,  which  preempts local governments, and restore the  right of local jurisdictions to regulate the planting of GE  seed. The law, Bill 863, dubbed  Oregon’s Monsanto Protection Act by environmentalists, farmers and consumers, was passed in 2013 and signed into law by then-Governor John Kitzhaber. The new language in HB 4122 seeks to correct the chemical company-driven legislation of the former bill and restore protection for traditional and organic farmers. In May, 2014, the voters of Jackson and Josephine Counties, Oregon, passed a ballot initiative, Genetically Modified Organism Ban, Measure 15-119, which sparked the backlash in the state legislature. Oregon, Colorado Move Forward in Regulating Pesticides on Marijuana

(Beyond Pesticides January 22, 2016) Last week, the Oregon Department of Agriculture (ODA) released a list of pesticide products available for use on marijuana cultivated within the state. The list, which contains 257 pesticide products, aligns with similar product lists published by Washington State and Colorado, and raises the same concerns over the allowance of products that violate the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA) and have not been subject to health evaluations of public exposure to the pesticides used. Those concerns were on full display last week in Colorado, when the Colorado Department of Agriculture (CDA) held a public meeting to discuss amendments to its Pesticide Applicators’ Act that would allow growers to use pesticides that violate FIFRA. Additionally, in an attempt to address consumers’ concerns over the issue of unregulated pesticides in marijuana, two lawmakers in Colorado introduced a bill that would establish a program for certifying marijuana as “pesticide free” within the state. Major Supermarket Bans Bee-Toxic Pesticides in Produce Production

 (Beyond Pesticides, January 20, 2016) Aldi SĂĽd, the German supermarket chain with stores in the U.S., has become the first major European retailer to ban pesticides toxic to bees, including the neonicotinoids imidacloprid, clothianidin and thiamethoxam, from fruits and vegetables produced for their stores. Aldi has requested suppliers comply at the earliest possible time. In light of the growing pollinator crisis and due to public pressure, retailers in Europe and the U.S. are slowly beginning to make the switch away from bee-toxic pesticides. Beginning January 1, suppliers of fruits and vegetables to Aldi suppliers will have to ensure that their cultivation practices do not include the following eight pesticides identified as toxic to bees (thiamethoxam, chlorpyrifos,  clothianidin, cypermethrin, deltamethrin, fipronil, imidacloprid and sulfoxaflor) to meet  the new requirement. According to a press release from Greenpeace, the chemicals are used on various commodities in Europe  —thiamethoxam (used in lettuce and endive), chlorpyrifos, clothianidin (used in kohlrabi, herbs, Brussels sprouts, head cabbage, cauliflower and kale), cypermethrin (leek, head cabbage and leguminous vegetables), deltamethrin (cauliflower, peppers, eggplant, zucchini, cucumber, pea, head cabbage, tomato and lettuce),  imidacloprid (applied to apples, peaches, apricots and lettuce). Campbell Soup Says GE Food Is Safe, Endorses Mandatory GE Labeling to Preempt States with Weak Language

(Beyond Pesticides, January 12, 2016) Late last week in a precedent-setting move, Campbell Soup Company announced its support for federal mandatory labeling of foods containing genetically engineered (GE) ingredients. If such labeling does not come soon, the company also indicated it is prepared to voluntarily label all products it produces that  contain GE ingredients. Agri-Pulse reported, “Campbell made clear that it still supported the use of genetic engineering in agriculture but said that there is a need for national labeling standards that would preempt state standards.” Campbell’s President and CEO Denise Morrison, ““I want to stress that we’re in no way disputing the science behind GMOs or their safety. Home Depot Announces Phase Out of Bee-Toxic Pesticides

(Beyond Pesticides, December 4, 2015) Home Depot, the world’s largest home-improvement chain, has announced that it will no longer use  neonicotinoid (neonic) pesticides (which have emerged as the leading class of pesticides responsible for bee declines) in  80 percent of its flowering plants, and that it will complete its phase-out in plants by 2018. This follows the announcement made by Lowe’s earlier this year to phase out the sale of products containing neonicotinoid pesticides within 48 months. On its Eco Options gardening page, Home Depot says the following: “Our live goods suppliers have reduced the number of plants that they treat with neonicotinoids, so that now over 80% of our flowering plants are not treated HomeDepotWinBPwith neonicotinoids. We will continue this decrease unless,  1) it is required by state or federal regulation, or  2) undisputed science proves that the use of neonicotinoids on our live goods does not have a lethal or sub lethal effect on pollinators. Genetically Engineered Salmon without Labeling Approved by FDA

(Beyond Pesticides, December 1, 2015) Last month, the U.S. Food and Drug Administration (FDA) approved, without a labeling requirement, a genetically engineered (GE) salmon designed to grow faster and come to market quicker than other farmed salmon. The fish, dubbed AquAdvantage by its developer, Massachusetts-based biotechnology firm AquaBounty, has been the center of considerable controversy as it represents the first GE animal approved for commercial sale and human consumption. While FDA has declared the fish safe to eat, and AquaBounty argues the fish will help feed the world, opponents stress that the potential adverse effects of the technology have not been properly vetted, and consumers will have no way to tell whether the salmon they purchase at the store is the engineered AquAdvantage product. Draft guidelines released by FDA when the salmon was approved do not require retailers to inform consumers that the fish is GE. Instead, the agency provided examples of voluntary statements, such as “genetically engineered,” or “This salmon patty was made from Atlantic salmon produced using modern biotechnology,” that producers  can consider using. Glyphosate, produced and sold as Roundup by Monsanto, is touted as a “low toxicity” chemical and “safer” than other chemicals by EPA and industry and is widely used in food production and on lawns, gardens, parks, and children’s playing fields. However, IARC’s recent classification of glyphosate as a Group 2A “probable” carcinogen finds that glyphosate is anything but safe. U.S. Senators to Advance Legislation to Stop States from Labeling GE Food

(Beyond Pesticides, October 22, 2015) With increasing consumer concern about genetically engineered (GE) food, yesterday  the U.S. Senate Committee on Agriculture, Nutrition, and Forestry held a hearing,  entitled Agriculture Biotechnology: a Look at Federal Regulation and Stakeholder Perspectives, that critics called lopsided. Most witnesses characterized GE food as safe or side-stepped the issue of safety, as government witnesses refused to distinguish GE from conventional food and opposed food labeling. “This is the first time in 10 years we’ve had a hearing on biotech. I guess we’re a little late, but we’re here,” said chair of the committee, Senator Pat Roberts (R-KS). The ranking  minority member of the committee, Senator  Debbie Stabenow (D-MI)  said,  “Biotechnology is proven to be safe, beneficial, and I believe will play a major role in helping to solve these dual global challenges of climate change and global food security,” Central to the hearing is the the issue of labeling food products containing GE crops. Senator Stabenow called for the adoption of legislation on GE food labeling, presumably with language that will preempt the authority of states to adopt more stringent labeling standards.
