Majority of EU Countries Opt-Out of Approved GE Crops

(Beyond Pesticides, October 13, 2015) Nineteen  European Union (EU) member states (Austria, Belgium (Wallonia), Bulgaria, Croatia, Cyprus, Denmark, France, Germany, Greece, Hungary, Italy, Latvia, Lithuania, Luxembourg, Malta, The Netherlands, Poland, Solvenia, Scotland, Northern Ireland, and Wales) have opted out of approving GE cultivation except for research purposes. In the past, the EU has not been particularly fond of GE crops; currently, only one GE crop, insect resistant maize MON 810, has been approved for cultivation. In March, the EU passed a new directive that allowed GE crops to be approved for use Union-wide. Along with the Treaty on the Functioning of the EU (TFEU), that directive also gave member states the ability to “adopt legally binding acts restricting or prohibiting the cultivation of GMOs in their territory after such GMOs have been authorized to be placed on the Union market.” Once the opt-out applications have been processed and transmitted to the companies, they have one month to take action; that is, the companies most affected by the ban will have the chance to oppose it. EPA Releases Long-Awaited Revisions To Worker Protection Standards

(Beyond Pesticides, September 30, 2015) On September 28, the U.S. Environmental Protection Agency (EPA) finally released its new regulation regarding farmworker pesticide safety, revising the Agricultural Worker Protection Standards (WPS), which are designed to provide protections from pesticide exposure to farmworkers and their families. These standards have not been updated for over 20 years, and EPA had delayed revisions since the first proposed update in 2010. Historically, farmworker advocates have criticized these protections as woefully inadequate in protecting the health of agricultural workers, but these new revisions attempt to strengthen the standards through increased training for workers handling pesticides, improved notification of pesticide applications, and a higher  minimum age requirement for children to work around pesticides. Farmworker Justice, a nonprofit organization that seeks to empower migrant and seasonal farmworkers, has praised the revisions as a step in the right direction, but noted that the ruling did not include some significant safety measures. Federal Court Overturns EPA Approval of New Bee-Killing Insecticide Sulfoxaflor

(Beyond Pesticides, September 11, 2015) On Thursday, the Ninth Circuit Court of Appeals unequivocally rejected the U.S. Environmental Protection Agency’s (EPA) unconditional registration of the systemic and bee-toxic pesticide sulfoxaflor. The Court concluded that EPA violated federal law and its own regulations when it approved sulfoxaflor without reliable studies regarding the impact that the insecticide would have on honey bee colonies. The Court vacated EPA’s unconditional registration of the chemical, meaning that sulfoxaflor may no longer be used in the U.S. However, while the decision is good news for now, it still leaves the door open for sulfoxaflor’s future use once EPA obtains the necessary information regarding impacts to honey bees and re-approves the insecticide in accordance with law. The case is Pollinator Stewardship Council, American Honey Producers Association, National Honey Bee Advisory Board, American Beekeeping Federation, Thomas Smith, Bret Adee, Jeff Anderson v. U.S. EPA (9th Circuit U.S. Court of Appeals,  No. 13-7234). Dow AgroSciences (a Dow Chemical company)  joined  the case as an intervenor to support EPA. New York Lawn Care Companies Fined for Violating Pesticide Laws

(Beyond Pesticides, September 8, 2015) The New York State Department of Environmental Conservation (DEC) has issued tickets to six companies in Rockland and Westchester counties for violating state laws on pesticide applications, most on residential lawns. Eight other companies were issued warnings. The violations, which occurred between 2013 and spring 2015, ranged from unlicensed businesses to uncertified workers and unlabeled toxic pesticides. These fines and warnings came about after complaints and anonymous tips, and highlight the many instances where pesticide law enforcement and compliance falls short. In September of last year, a complaint was called into the DEC, reporting that a Jonathan Landscaping (of Rockville, NY) truck was spraying pesticides with no labels, and was missing triangle decals that indicate a valid state pesticide permit. The DEC inspector went out and found the truck, issuing four tickets for operating an unregistered pesticide business and unlabeled poisons. Rafael Hernandez, the owner of Jonathan Landscaping, pleaded guilty to violating environmental laws in March and was fined $350, according to The Journal News.  In April, SavALawn, another landscaping company, was found to be missing triangle decals and had unlabeled pesticide poisons, and was also issued a ticket, of value unknown. Germany to Ban GE Crops; US Approves GE Potato

(Beyond Pesticides, September 2, 2015) Germany intends to “opt out” of the cultivation of genetically engineered (GE) crops under new European Union (EU) rules regarding GE approvals, moving Germany one step forward to prohibiting GE crops. EU member states have until October 3, 2015 to inform the European Commission whether they wish to opt out of the new EU GE cultivation approvals. GE crops, which have divided Europe regarding their safety, remain a hot button issue across the continent. Meanwhile, in the U.S., the Department of Agriculture (USDA) granted nonregulated status to the “Innate” potato, approving yet other GE crop for U.S. agriculture that has insufficient testing and no labeling. According to Reuters, a new EU law approved in March 2015 clarifies the process for approving new GE crops after years of previous deadlock. Now this new law gives individual EU countries more flexibility over the cultivation of GE crops and the right to opt out by prohibiting GE crops even after they have been approved by the European Commission. Medical Journal Article Identifies Hazards of Pesticides in GE Crops

Landrigan, M.D., and Charles Benbrook, Ph.D., released a perspective article, GMOs, Herbicides, and Public Health, in the New England Journal of Medicine  that outlines  the hazards associated with food residues of  elevated pesticide use in the production  of genetically engineered (GE) crops. While mainstream media continuously misses the central issue  in the GE debate by asserting that these crops are merely an extension of selective breeding and effect a reduction in pesticide use, the authors  focus on  the significance of the actual increase in herbicide use and weed resistance in herbicide-tolerant crops. Drs. Landrigan and Benbrook offer two main recommendations in their article: the U.S. Environmental Protection Agency (EPA) should delay implementation of its decision to permit the use of Enlist Duo (the 2,4-D herbicide used with  Monsanto-engineered GE herbicide-tolerant  crop), and  the U.S. Food and Drug Administration (FDA) should  require labeling of GE foods and couple it with adequately funded, long-term postmarketing surveillance. Minneapolis, MN Passes Organic, Pollinator-Friendly Resolution

(Beyond Pesticides, August 25, 2015) Last Friday, the City Council of Minneapolis, MN unanimously passed a resolution declaring Minneapolis a pollinator-friendly community and urging city residents to take steps to protect dwindling pollinator populations. A groundswell of public support from a wide range of local and national groups, including Beyond Pesticides, resulted in swift passage of the resolution, the latest in a long string of local government action to safeguard pollinators from harmful pesticides, as federal proposals fail to address the magnitude of the crisis. “With the passage of today’s resolution, Minneapolis is now doing its part in the global effort to protect and grow the pollinator populations,” Mayor Betsy Hodges said to CBS Minnesota. The resolution, introduced and written by Councilmember Cam Gordon, assigns a number of bee safe actions to various city departments. While the Health Department’s Environmental Services Unit will maintain a list of pollinator-friendly plants, the Community Planning and Economic Development Department and Property Services Division of the City Coordinator’s office will create habitat for local pollinators. Town of Plattsburgh, NY Tackles Pesticides and GMOs in Non-Binding Resolution

(Beyond Pesticides, August 12 2015) Last week, the City of Plattsburgh, New York, unanimously approved a policy that encourages city departments and city residents to reduce and eventually eliminate their use of toxic pesticides, such as neonicotinoids and glyphosate. In the same resolution, city residents and department heads are also encouraged to refrain from genetically modified organism (GMO) cultivation, though they recognize there is very little of that taking place within Plattsburgh city limits. While this policy can only be used to discourage the use of pesticides and GMOs, not implement an outright ban, due to preemptive New York state law that occupies the field of pesticide regulation, city officials are hopeful that they will be able to use their influence to implore the state of New York and U.S. legislators to take statewide and nationwide measures on the production of GMO crops and to curb the use of toxic pesticides. Meeting Records Expose Industry’s Influence in UK’s Neonic Emergency Use Decision

(Beyond Pesticides, July 31, 2015) New information has surfaced regarding the role of agrochemical giants Bayer and Syngenta in the United Kingdom (UK)’s recent decision to temporarily allow the use of neonicotinoid seed treatment on oilseed rape crop. A record of the meeting, involving the UK government’s expert committee on pesticides (ECP) and industry representatives, had previously been suppressed. The newly released record of the meeting shows that Bayer and Syngenta were the only external representatives asked to answer the ECP’s questions. The emergency use, which has been granted for 120 days, allows growers to use Bayer’s Modesto (clothianidin) and Syngenta’s Cruiser OSR (thiamethoxam). The active ingredients of these products belong to a class of toxic chemicals known as neonicotinoids  (neonics), which have been  linked  to pollinator decline. These pesticides are associated with  decreased learning,  foraging  and navigational ability in bees, as well as increased vulnerability to pathogens and parasites as a result of suppressed bee immune systems. USDA Allows Introduction of 2,4-D-Tolerant GE Cotton in Response to Roundup Resistance

(Beyond Pesticides, July 30, 2015) Despite concerns for human and environmental contamination, the U.S. Department of Agriculture (USDA) adds 2,4-D-tolerant cotton, a genetically engineered (GE) crop, to the list of unregulated GE crops, joining 2,4-D resistant corn and soybeans. Last week, the Animal and Plant Health Inspection Service (APHIS) division of USDA released its decision on Dow AgroSciences’ petition to deregulate the 2,4-D resistant GE cotton. The decision was signed off by Michael J. Firko, the Deputy Administrator of Biotechnology Regulatory Services. In September of last year, Deputy Firko also signed the determination paperwork that deregulated GE corn and soybean. The deregulation essentially releases the GE organism from the regulatory requirements of 7 CFR part 340 or the plant pest provisions of the Plant Protection Act. Dow’s GE cotton, part of the Enlist Weed Control System, is resistant to 2,4-D choline, glufosinate, and glyphosate. Growers in the cotton industry have been vying for the GE cotton to enter the market in order to combat herbicide-resistant weeds due to the broad scale use of Monsanto’s RoundUp (glyphosate), which continues to fail across the agricultural industry due to weed resistance. Passage of the DARK Act Sheds Light on Next Steps for Opposition

(Beyond Pesticides, July 29 2015) The  Safe and Accurate Food Labeling Act of 2015,  H.R. 1599, often referred to as the “DARK” Act or Denying Americans the Right to Know what is in their food, passed the U.S.  House of Representatives last week by a vote of 275-150. Backed largely by House Republicans, the DARK Act makes it harder for the Food and Drug Administration (FDA) to require mandatory national labeling of genetically engineered (GE) organisms and strengthens current policies that allow companies to voluntarily label foods containing GE products, an option they rarely choose to do. The bill also continues to allow misleading “natural” claims for food that contain GE ingredients. Most concerning, however, is the prohibition  that H.R. 1599 would place  on states’ authority to require labeling of GE ingredients in food products, instituting federal  preemption of state and local authority. While the bill was being debated on the floor, co-sponsors Representatives Mike Pompeo (R-KS) and G.K. U.S. House May Prohibit States from Requiring Labeling of GE Ingredients

(Beyond Pesticides, July 17, 2015) The U.S. House of Representatives may pass a bill against the labeling of genetically-engineered (GE) food before the end of July. The House could vote as early as next week on a bill to preempt states from requiring labels on food made with GE ingredients. Backers say that the passage of the bill, HR 1599, named the Safe and Accurate Food Labeling Act of 2015, but referred to by critics as the DARK (Deny Americans the Right to Know) Act, seems assured, after speedy committee approval of the legislation. The Agriculture Committee, a quarter of whose members are cosponsors of the bill, approved an updated version on a voice vote during a session that ran less than 20 minutes. Only two members spoke against it. The legislation, reintroduced in March by Reps. Mike Pompeo (R-KS) and G.K. Butterfield (D-NC), will maintain secrecy  about GE ingredients in food, and would block both the Food and Drug Administration (FDA) and individual states from requiring GE food labels, but allow voluntary labeling standards. Colorado Warned of Its Illegal Allowance of Pesticides in Marijuana Production

(Beyond Pesticides, July 15, 2015) Yesterday, Beyond Pesticides sent a letter to the Colorado Department of Agriculture  (CDA) urging officials  to reconsider their latest position on pesticide use in  cannabis cultivation  and warning them of potential violations of the Federal Insecticide Fungicide and Rodenticide Act (FIFRA) that would likely arise moving forward. This letter was written in response to recent actions by CDA that encourage stakeholders to pursue exemptions for highly toxic pesticides and other indications that the state intends to allow the use of other pesticides under general label language that does not specifically address use on marijuana. Both of these approaches violate federal law and Environmental Protection Agency (EPA) regulations. Given the potential legal challenges associated with approving toxic pesticides for use on cannabis, Beyond Pesticides encourages CDA to allow within the state only the use of pesticides of a character unnecessary for regulation, which fall under section 25(b) of FIFRA. EPA’s “New” Restrictions Fail to Protect Honey Bees as Promised

(Beyond Pesticides, June 1, 2015) Last week, the Environmental Protection Agency (EPA) released a proposal intended to create “physical and temporal space” between bees and toxic pesticides. While touted as monumental progress on bee health by the agency, the reality is that the proposal will only result in modest changes to pesticide labels. EPA’s new rules contain only a temporary ban on foliar applications of acutely bee-toxic pesticide products, including neonicotinoid class insecticides, during bloom and when a beekeeper is on site and under contract. The proposal doesn’t address the widespread contamination and detrimental effects of these toxic, systemic (whole plant poisons) chemicals that will continue to occur even during the temporary prohibition. Media reports have generally overstated the implications of the proposal, applauding the “new” restrictions, and labeling the small portion of agricultural land that is affected  as “pesticide-free zones,” which couldn’t be further from the truth. The restrictions are not anything new — EPA pesticide labels already prohibit applications while in bloom where bees are foraging. Vermont Wins Legal Challenge to Its GE Labeling Law

(Beyond Pesticides, April 30, 2015) On Monday, a U.S. District Court Judge for the District of Vermont found that the state’s genetically engineered food (GE) labeling law, Act 120, is constitutional under the First Amendment, and thus rejected the motion to stop its implementation. The legal challenge  was brought by the same industrial food companies  —Grocery Manufacturers of America (GMA), Snack Food Association, International Dairy Foods Association, and National Association of Manufacturers  — that  had poured money into defeating the measure, before it overwhelmingly passed in the state legislature. The judge also dismissed a number of the plaintiffs’ claims, including assertions that the law violates the commerce clause and was expressly preempted by federal law. Chipotle Removes Genetically Engineered Food from Its Menu

(Beyond Pesticides, April 28, 2015) Beginning this week, Chipotle Mexican Grill will stop serving food containing genetically engineered (GE) ingredients. The restaurant’s announcement is the first of any major fast food chain, and fits with the company’s long-held mission of providing its customers “food with integrity.” In 2013, Chipotle also became the first major restaurant chain to label foods it sold that contained GE ingredients, and in 2010 the company announced its support for organic production practices by increasing the percentage of organic ingredients it serves, and committing to eventually transition the entire menu to organic. “Just because food is served fast doesn’t mean it has to be made with cheap raw ingredients, highly processed with preservatives and fillers and stabilizers and artificial colors and flavors,” said Steve Ells, Chipotle’s founder and co-chief executive to The New York Times. Although the meat and dairy served at the chain will still come from animals fed GE grain, the company indicates it will continue to work on the issue. California Releases New Guidelines for Pesticide Use on Marijuana

(Beyond Pesticides, April 14, 2015) Last week California released its first guidelines for the management of pests and use of pesticides on cannabis. Cannabis cultivation in California, particularly in the northern areas of the state, has been associated with rampant use of heavy construction equipment and pesticides to clear land and control pests, resulting in contamination and runoff in local streams, and widespread poisoning of non-target wildlife. Although growing cannabis on public lands in California  has always been illegal, private production of the plant in environmentally sensitive sites has gone largely unregulated due the plant’s illegal status under federal law, but legally allowed  in the state under California’s Compassionate Use Act. According to Beyond Pesticides’ recent report on state pesticide use on cannabis, California was one of six states silent on pesticide use on marijuana. EPA Agrees to Regulate Novel Nanotechnology Pesticides after Legal Challenge

(Beyond Pesticides, March 26, 2015) The Environmental Protection Agency (EPA) has agreed to regulate novel nanomaterial pesticides as a result of a lawsuit filed by Center for Food Safety (CFS) and joined by Beyond Pesticides in December. In 2008, a coalition of more than 13 organizations filed a legal petition requesting, among other things, that EPA recognize the risks associated with a growing class of nano-silver consumer products and regulate them as new pesticides. After EPA had failed to respond to the petition for six years, in December 2014 some of the petitioner groups sued the agency to force it to respond. As States Legalize Marijuana, Study Finds Uneven Pesticide Use Restrictions on Growing Practices

A study released today of the 23 states and the District of Columbia that have legalized marijuana finds a patchwork of state laws and evolving policy that define allowed pesticide use and management practices in cannabis production. This variety of state law is occurring in the absence of federal registration of pesticide use for cannabis production because of its classification as a narcotic under federal law. The investigation, Pesticide Use in Marijuana Production: Safety Issues and Sustainable Options, evaluates the state laws governing pesticide use in cannabis production where it is legalized. “The use of pesticides in the cultivation of cannabis has health implications for those growing the crop, and for users who are exposed to toxic residues through inhalation, ingestion, and absorption through the skin,” said Jay Feldman, executive director of Beyond Pesticides. “The good news is that five states and DC have adopted rules that require marijuana to be grown with practices that prevent the use of pesticides. U.S. Senator Calls for Suspension of Pentachlorophenol, Used to Treat Utility Poles

Schumer (D-NY) yesterday called on the U.S. Environmental Protection Agency (EPA) yesterday to immediately investigate the specific use of pentachlorophenol  (penta or PCP), a toxic wood preservative, to treat  utility poles throughout Long Island and urged  Public Service Electric and Gas (PSEG) Long Island to immediately suspend further use of this chemical until a  federal review  is complete. PSEG has been installing new, chemically-treated utility poles throughout the Towns of North Hempstead and East Hampton. In his press  release, Senator Schumer expresses  serious concern about penta’s  health risks to utility workers, adults and children and its ability to  move  into water over the long-term as the chemical leaches from the poles. The Senator also notes that a private firm has conducted a study based on a very limited sample size that does not consider long-term risks as the pole decomposes and further leaches toward groundwater. EPA, which is responsible for evaluating penta’s health and environmental risk, has noted public health concerns related to the chemical when ingested or inhaled, including  neurological, respiratory, kidney and immune system effects. Appeals Court to Hear Case on EPA’s Registration of Bee-Toxic Chemical

(Beyond Pesticides, March 4, 2015) The 9th U.S. Circuit Court of Appeals has agreed to hear the case brought by beekeepers challenging the U.S. Environmental Protection Agency’s (EPA) approval of a toxic pesticide known to be toxic to bees. In 2013, the beekeepers filed suit against the agency, citing that the new chemical, sulfoxaflor, as further endangering bees and beekeeping and noting that their concerns were not properly addressed by EPA before registration was granted. Sulfoxaflor is a sub-class of the neonicotinoid pesticides that have been linked to global bee declines. The Court has agreed to hear the case on April 14, 2015. The case, Pollinator Stewardship Council v. EPA, which requests changes to EPA’s product label for sulfoxaflor, was first filed July 2013. The petitioners include the Pollinator Stewardship Council, the American Honey Producers Association, the National Honey Bee Advisory Board, the American Beekeeping Federation, and beekeepers Bret Adee, Jeff Anderson and Thomas Smith. The beekeeper groups are represented by Earthjustice. Partial Victory as Hershey’s Announces Move Away from GMO Ingredients

(Beyond Pesticides, March 2, 2015) Amid growing consumer backlash, Hershey’s has announced first steps toward moving to non-genetically engineered (GE) ingredients in its chocolate. The news comes in response to tens of thousands of Facebook posts, emails, and telephone calls from consumers who took part in a campaign calling on Hershey’s to move to non-GE ingredients led by GMO Inside. In a statement released February 18, Hershey’s said that it will “transition some of its most popular chocolate brands, including Hershey’s Kisses Milk Chocolates and Hershey’s Milk Chocolate Bars to simpler ingredients.” Last week, Hershey’s confirmed with GMO Inside that as part of its commitment to simpler ingredients, its two iconic products will be non-GE by the end of the year, however the company did not respond to the request to source its sugar organically. “We congratulate Hershey’s on this important move and great first step. Scientists Challenge Industry Consensus that GE Foods Are ‘Safe’

(Beyond Pesticides, February 25, 2015) The biotechnology industry behind genetically engineered (GE) foods have for years touted that their technology is safe, dismissing any attempts to challenge their science or regulate their material. However, 300 scientists, physicians and scholars assert there is no scientific consensus on the safety of GE foods and find that claims of safety are an “artificial construct that has been falsely perpetuated” through various forums and media. The statement, published in the journal Environmental Sciences Europe and entitled, “No scientific consensus on GMO safety,” cites a concerted effort by GE seed developers and some scientists, commentators and journalists to construct the claim that there is a “scientific consensus” on GE safety, and that debate on the topic is “over.” According to the 13-page statement, 300 independent scientists and researchers felt compelled to develop a document that offered a balanced account of the current state of dissent in this field, based on published evidence in the scientific literature, for both the interested public and the wider science community.
