Misleading Claims Found on Plethora of “Green” Products

(Beyond Pesticides, October 29, 2010) According to a new report by the North American environmental-marketing company TerraChoice, 95% of consumer products examined that claim to be eco-friendly are guilty of greenwashing, including: vague language such as “all-natural,†no proof of environmental claims, and the use of fake labels designed to imply that the product has a third party endorsement. Interestingly, the study found that “big box†retailers tend to stock more “green†products and more products that provide legitimate environmental certifications (like organic) than smaller “green†boutique-style stores. This report comes on the heels of FTC’s announcement to revise its “Green Guides†guidelines. In an effort to reduce confusion among consumers trying to decipher the wide variety of green claims, the commission is revising its guidelines for companies seeking to promote their products as environmentally friendly. The report, The Sins of Greenwashing: Home and Family Edition, examines over 5,000 consumer products in 34 stores in the U.S. and Canada and finds 12,061 “green†claims. FTC to Revise Green Marketing Guidelines, Public Comment Invited Until December 10, 2010

(Beyond Pesticides, October 12, 2010) In an effort to reduce confusion among consumers trying to decipher the wide variety of green claims, the Federal Trade Commission (FTC) is revising its “Green Guides,†guidelines for companies seeking to promote their products as environmentally friendly. As consumers have become more aware of the environmental effects of the products they use, “green†marketing claims have become more prevalent. When a product carries the organic label, consumers can be confident that it has met strict standards and was certified by an independent organization, but many other labels are simply attempts at “green washing” conventional products to charge a premium to environmentally conscience consumers. Market research has shown that consumers often misunderstand the intentions of some green claims. Some labels make claims that are too broad and difficult to quantify. The revised guidelines advise producers not to make such broad claims on labels such as “environmentally friendly,” because according to an FTC consumer perception study, consumers often assume the product has far reaching environmental benefits. “What companies think green claims mean and what consumers really understand are sometimes two different things,†said FTC Chairman Jon Leibowitz. Genetically Engineered Sugar Beets Face New Legal Challenge

(Beyond Pesticides, September 13, 2010) Several groups opposed to genetically engineered (GE) foods filed suit in San Francisco against the USDA on Thursday to stop the agency from sidestepping National Environmental Policy Act (NEPA) regulations and allowing the planting of GE sugar beets. Government approval of the crop was revoked in August; however, USDA announced on September 1 it would issue permits allowing farmers to plant GE sugar beets as long as the crop did not flower. The plaintiffs, which include Center for Food Safety, Sierra Club, Organic Seed Alliance, and High Mowing Organic Seeds Company with representation from Earth Justice, contend the plantings would contaminate nearby farms with GE pollen, and again asked the judge to bar all planting of GE sugar beets. The GE sugar beets, produced by St. Louis-based Monsanto, have been engineered to be resistant to the herbicide glyphosate, sold by Monsanto under the trade name Round Up. Price of Organic Produce May Soon Decrease

(Beyond Pesticides, September 9, 2010) Researchers at the University of Arizona have examined the reasons for the higher cost of organic produce and predict the price will soon decrease. Many consumers would like to purchase more organic produce, but chose conventional due to the lower costs. Organic agriculture is the fastest growing sector of U.S. agriculture, and despite premium prices, organic food sales grew 53% from 2005 to 2008. Organic agriculture embodies an ecological approach to farming that does not rely on or permit synthetic pesticides, chemical fertilizers, genetically modified organisms, antibiotics, sewage sludge, or irradiation. Instead of using these harmful products and practices, organic agriculture utilizes techniques such as cover cropping, crop rotation, and composting to produce healthy soil, prevent pest and disease problems, and grow healthy food and fiber. The study, entitled “Resale and Wholesale Market Power in Organic Apples,†examined organic apples grown in Washington State to serve as an example for overall organic agricultural production and sales. Toxic Contaminants Found in City’s Free ‘Organic Biosolids Compost’

(Beyond Pesticides, August 11, 2010) Independent tests of sewage sludge-derived compost from the Synagro CVC plant -distributed free to gardeners since 2007 by the San Francisco Public Utilities Commission (PUC) in their “organic biosolids compost” giveaway program — have found appreciable concentrations of contaminants with endocrine-disruptive properties. These contaminants include polybrominated diphenyl ether (PBDE) flame retardants, nonylphenol detergent breakdown products, and the antibacterial agent triclosan. The independent tests were conducted for the Food Rights Network by Robert C. Hale, PhD of the Virginia Institute of Marine Sciences. The antibacterial triclosan, an endocrine disruptor, was also found in the sewage sludge compost, at an average of 1,312 ng/g (or ppb). Last week, the Centers for Disease Control updated their National Report on Human Exposure to Environmental Chemicals and noted that triclosan levels in people increased by over 41% between just the years 2004 and 2006. Also last week, a scientific paper showed that triclosan from sewage sludge can be taken up by soybean plants and translocated into the beans themselves, then consumed by people and animals. New Mobile App to Help Consumers Choose GM Free Food

(Beyond Pesticides, July 19, 2010) The Washington D.C. based Center for Food Safety (CFS) has unveiled an application for mobile phones to help shoppers quickly and easily identify foods made with ingredients from genetically modified (GM) organisms. Many consumers are leery of GM foods, yet unfortunately producers are not required to label products that contain GM ingredients, leaving consumers guessing about what they are eating. To aid consumers where regulatory oversight has failed, CFS created its new True Food Shoppers Guide Mobile Application available for free through iTunes and Android Market. GM foods were first introduced into the U.S. food supply in 1994, promising to put an end to world hunger. Using genetic engineering, scientists were expected to create drought and salt tolerant crops, with higher yields and nutrient content. These crops never materialized, however, and industry giants such as Monsanto have collected huge revenues selling insecticide producing and herbicide resistant crops to American farmers. USDA Study Compares Organic and Conventional Eggs, But Misses Big Picture

(Beyond Pesticides, July 12, 2010) A study comparing the quality (measured in fat and protein content, egg white and shell thickness, and other physical characteristics) of various types of chicken eggs, including conventional, free-range and organic, failed to examine pesticide residues or vitamin content, nor does it consider the environmental and health impacts of conventional, chemical-based production systems, according to food and environmental safety advocates. The study is receiving attention after a recent article in Time magazine points out that organic eggs are often three times more expensive than conventional factory farm eggs. The study concludes that there is no substantial quality difference between eggs produced under different production systems. The study, “Physical quality and composition of retail shell eggs,†which was originally published in the March 2010 issue of the journal Poultry Science, compares white and brown large-shell eggs with various production and nutritional differences such as traditional, cage-free, free-roaming, pasteurized, nutritionally-enhanced (omega-3 fatty acids), fertile and organic. The study examined two dozen eggs of each variety taken from two Athens, GA grocery stores on three separate occasions. EPA Needs Broader Approach on Antimicrobials

(Beyond Pesticides, June 30, 2010) The U.S. Environmental Protection Agency (EPA) approval process for thousands of antimicrobial products is woefully inadequate, according Public Employees for Environmental Responsibility (PEER). Despite a growing body of scientific evidence about the side-effects of these products, EPA rubberstamps registrations without duly considering an array of potential public health and environmental impacts. Antimicrobials are now a billion dollar business with more than 5,000 such products currently registered with EPA. Initially designed for hospitals and clinics, antimicrobial pesticides are today found in products ranging from household cleaners to mattresses and bedding, cosmetics, toys, toothpaste and even chopsticks. Antibacterial products are being marketed to the health conscious without firm evidence of real benefits and amid growing concern about downstream consequences. One prime example of this is the antibacterial pesticide triclosan that is formulated into hundreds of personal care products, toys and textiles. Studies show that triclosan is an endocrine disruptor, accumulates in human fatty tissue and can influence the onset of bacterial resistance. Whole Foods Adopts Policy on Mislabeled “Organic†Personal Care Products

(Beyond Pesticides, June 14, 2010) Whole Foods Market is setting a good example for other retailers to follow in protecting consumers from fraudulent “organic†claims on health and beauty products. The national grocery retailer of natural and organic products announced earlier this month that all cosmetic and personal care products sold at their stores with the word “organic†on the product label must comply with the U.S. Department of Agriculture (USDA) National Organic Program (NOP) or NSF 305 standards, meaning that the product must be third-party certified to USDA organic standards or front label “organic†claims must cease, according to the Organic Consumers Association. Thought the term “organic†on all products, whether for food or non-food items, meant that it was certified? That’s the law, but sometimes not the reality. The reality is that the USDA’s NOP requires certification for all “organic†claims on food products, but does not currently have similar certification requirements in place for non-food items. The new Whole Foods Market policy states, “We believe that the ‘organic’ claim used on personal care products should have very similar meaning to the ‘organic’ claim used on food products, which is currently regulated by the USDA’s National Organic Program. Ask Your Local Retailers to Stop Selling Triclosan Products

(Beyond Pesticides, May 26, 2010) Beyond Pesticides has drafted sample text (see below), and we need your help to deliver a letter to your local supermarket, cosmetics store or co-op asking them to stop selling products that contain triclosan. Hundreds of products containing the antibacterial chemical triclosan decorate the shelves of retail stores across the country. From hand soap and toothpastes, to toys and yoga mats, triclosan is everywhere. Product labels will read “triclosan,†“triclocarban†(a related compound found in bar soaps) or “Microban†(a formulation of triclosan used in plastics and fabrics). It is time to take action and demand that this endocrine disrupting chemical is removed from the products we use and love. When consumers demand more for their health and well-being, retailers and manufacturers of triclosan products must listen. Triclosan, which has a similar chemical structure as dioxin, is linked to various health and environmental problems. Report Raises Concerns About Bacterial Resistance to Triclosan

(Beyond Pesticides, April 28, 2010) Having already requested the Scientific Committee on Consumer Safety (SCCS) to assess whether an association can be found between the use of triclosan in cosmetic products and the development of resistance by certain micro-organisms, the European Commission is launching a public consultation on the preliminary opinion, which found in March that, “ Low concentrations of triclosan can trigger the expression of resistance and cross-resistance mechanisms in bacteria in vitroâ€Â¦.[which] warrants further investigation.†The preliminary report from the SCCS, entitled “Preliminary opinion on triclosan (Antimicrobial Resistance),†was published in March 2010 and open to comment. The committee was asked to answer the question: “Does the SCCS consider a continued use of triclosan as a preservative in cosmetic products as safe taking into account the new provided documentation of resistance development by certain micro-organisms and cross-resistance?†The SCCS also found that, “Some reported environmental concentrations in a number of geographically distinct areas are high enough to suggest that such triggering of bacterial resistance could also occur in the environment. Food Chain, Chipotle Mexican Grill, Stands Up For Organic Food

(Beyond Pesticides, April 15, 2010) As part of its “Food with Integrity†mission, Chipotle Mexican Grill, a national chain of about 1,000 restaurants, is making the commitment to support sustainable agriculture by increasing the percentage of organic ingredients, such as organic black and pinto beans on its food menu, and eventually transitioning to a completely organic menu. Chipotle’s efforts to use ingredients from more sustainable sources have led to a direct reduction of chemical pesticide use on its ingredients of nearly 100,000 pounds since 2005. In its position paper entitled, “Position on Pesticide Use,†posted in January 2010, Chipotle outlined its efforts to expand its commitment to sustainable foods aimed at bringing â€Ëœmore positive change in the nation’s food supply.’ To date, Chipotle serves more naturally raised meat (from animals that are raised in a humane way, never given antibiotics or added hormones, and fed a pure vegetarian diet) than any other restaurant company, making them the only national restaurant company with a significant commitment to local and organic produce. While Demand for Farm-to-School Program Doubles in Minnesota, Organic Focus is Lost

(Beyond Pesticides, April 13, 2010) While the number of Minnesota school districts purchasing fresh food from local farms has more than doubled in the last 15 months, according to a survey released last week by the Minnesota School Nutrition Association (MSNA) and the Institute for Agriculture and Trade Policy (IATP), there is no mention of organically produced food as a priority to protect children, local health or the local environment from the pollution and contamination caused by pesticide use. Communities, such as Olympia, Washington have turned to local organic food in their school lunch program. According to the Rodale Institute, “[W]hile it’s true that food produced locally generally has a smaller carbon footprint than food transported across the country (or from another continent), the carbon emitted by transporting food is smaller than that released by growing it with chemical means. On Wednesday March 3rd, Californians for a Healthy and Green Economy (CHANGE) recognized the year’s bad actors, bad chemical actors that is, at the first ever “Toxies.†CHANGE is a coalition of environmental, policy, labor, interfaith and other organizations working to regulate toxic chemicals in the state of California. Held at the Egyptian Theater in Hollywood, the Red Carpet Event featured actors in character as various harmful chemicals. Toxies were awarded to the pesticides Triclosan and Methyl Iodide. The tongue-in-cheek award show was intended to bring awareness to the harmful effect that these chemicals have on human health and the environment. The timing coincides not only with the awards show season, but with the anticipated release of the final draft of regulations for California’s Green Chemistry Programs. Critics Charge Sara Lee with Greenwashing To Lure Consumers

(Beyond Pesticides, February 23, 2010) Latest in the trend of consumer “greenwashing,” Sara Lee Corporation has launched a new marketing strategy for its EarthGrains ® bread, replacing a small proportion of its ingredients with their line of “Eco-Grainâ„¢†wheat. According to their press release, the company describes EarthGrains as “sustainable” because it uses a combination of “satellite imagery to help determine fertilizer requirements in any given area of the field,†reducing chemical fertilizer use by merely 15%. In contrast, as mandated by federal law, organic farmers are required by law to reduce their synthetic fertilizer use by 100%, and also prohibit organic farmers from using toxic pesticides that are commonly applied to conventional wheat fields, including those growing “Eco-Grain.†Sara Lee, which launched the bread marketing campaign February 2, 2010 said Eco-Grain wheat was developed with help from agricultural conglomerate Cargill. According to Sara Lee’s website, 20% of the flour in EarthGrains 100% Natural 24 oz. bread is made from Eco-Grainâ„¢ wheat, therefore, the total reduction in chemical fertilizer use in a loaf of EarthGrains bread is only 3%. Federal Complaint with USDA Filed Against False “Organic†Personal Care Brands

(Beyond Pesticides, January 20, 2010) The Organic Consumers Association (OCA), along with certified organic personal care brands Dr. Bronner’s Magic Soaps, Intelligent Nutrients, and Organic Essence, last week filed a complaint with the U.S. Department of Agriculture (USDA) National Organic Program (NOP), seeking action to stop some personal care manufacturers from, according to the petitioners, mislabeling their products as “organic.” The petitioners are requesting an investigation into what it believes is widespread and blatantly deceptive labeling practices of leading “organic†personal care brands, in violation of USDA NOP regulations. The complaint, filed collectively on behalf of 50 million consumers of organic products, argues that products such as liquid soaps, body washes, facial cleansers, shampoos, conditioners, moisturizing lotions, lip balms, make-up and other cosmetic products produced by 12 different corporations have been advertised, labeled and marketed as “organic†or “organics†when, in fact, the petitioners say the products are not “organic†as understood by reasonable consumers. “Unfortunately, the hands-off regulatory approach by the USDA’s National Organic Program during the Bush years failed to protect consumers from deceptive labeling in the personal care marketplace,†said Ronnie Cummins, executive director of the Organic Consumers Association. Agency Petitioned to Regulate Endocrine Disruptors

(Beyond Pesticides, January 14, 2010) Stating that current water-quality criteria does not reflect the latest scientific knowledge, The Center for Biological Diversity petitioned the U.S. Environmental Protection Agency (EPA) to establish new water-quality criteria for numerous endocrine-disrupting chemicals (EDC) under the Clean Water Act. If adopted, it will be a big step in regulating and eliminating persistent and widespread chemicals that damage reproductive functions in wildlife and humans. The Center for Biological Diversity formally requested that the EPA publish water quality criteria and information taking into account overwhelming science about the effects of EDC pollution on January 11. It says that under the Clean Water Act, EPA has a duty to periodically update water quality criteria to reflect the latest scientific knowledge. The petition presents scientific information on endocrine disrupting chemical pollution found in our waters and requests that the EPA promptly update water quality criteria reflecting this scientific information. Multinationals Pushing Out Organic Fair Trade Coffee Production in Latin America

(Beyond Pesticides, January 8, 2010) Market forces driven by multinational corporations with increased market share and depressed payments for organic and fair trade coffee is threatening the organic coffee industry in Latin America. This is reversing successful efforts to improve worker and environmental protection in the production of a crop that was introduced to Latin America by Jesuit monks three hundred years ago. According to a recent Time Magazine article coffee has grown to a $70 billion a year industry, making coffee the second most valuable traded commodity after oil. Yet, small growers remain mired in poverty, where working conditions can be miserable; laboring on dangerously steep mountain sides, being exposed to dangerous pesticides and chemical fertilizers, and often going hungry for months out of the year. Organic and fair trade certified production provided a socially just response to this reality. Take Action: Submit Comments on Corporate Control of Our Food System

But for the first time ever, the U.S. Department of Justice (DOJ) is calling for public comment on how big business controls food and farming. The DOJ’s Antitrust Division is collecting input in preparation for “agricultural workshops,” to be held jointly with the U.S. Department of Agriculture (USDA) in early 2010, which will examine the extent of abusive anticompetitive behavior by agribusiness giants. The workshops, which were first announced by Attorney General Eric Holder and Agriculture Secretary Tom Vilsack on Aug. 5, 2009, are the first joint Department of Justice/USDA workshops ever to be held to discuss competition and regulatory issues in the agriculture industry. The all-day workshops, which will begin in March 2010, will be held in Alabama, Colorado, Iowa, Washington, D.C. and Wisconsin. Large-scale Livestock Operation Decertified Organic by USDA

(Beyond Pesticides, December 7, 2009) In an investigation and legal case that dragged on for almost four years, one of the largest organic cattle producers in the United States, Promiseland Livestock, LLC, is suspended from organic commerce, along with its owner and key employees, for four years. The penalty is part of an order issued by administrative law judge Peter Davenport in Washington, DC on November 25, 2009, a multimillion dollar operation with facilities in Missouri and Nebraska, including over 13,000 acres of crop land, and managing 22,000 head of beef and dairy cattle, had been accused of multiple improprieties in formal legal complaints, including not feeding organic grain to cattle, selling fraudulent organic feed and “laundering” conventional cattle as organic. “We are pleased that justice has been served in the Promiseland matter,” said Mark A. Kastel, Senior Farm Policy Analyst for the Wisconsin-based Cornucopia Institute. Scrutiny from Cornucopia, one of the industry’s most aggressive independent watchdogs, was part of the genesis for the comprehensive USDA investigation and subsequent legal proceedings. New Study Links Suicidal Thoughts to Pesticides

(Beyond Pesticides, October 26, 2009) A new study conducted in China finds that people with organophosphate pesticides in their homes are more likely to have suicidal thoughts. According to the study, “Pesticide exposure and suicidal ideation in rural communities in Zhejiang province, China,†published in the October issue of the WHO Bulletin, there is biological evidence that chronic low-grade exposure to organophosphate pesticides, which are very easily absorbed into the body through the skin and lungs, may have adverse effects on mental health. The study was carried out in the central/coastal region of China, a relatively wealthy area with a rapidly developing economy. In a very large survey of mental health in rural community residents, participants were also asked about how they stored pesticides. The study found that people who stored pesticides at home, i.e. those with more exposure, were more likely to report recent suicidal thoughts. Supporting this, the survey also found suicidal thoughts to be associated with how easily accessible these pesticides were in the home and that the geographic areas with highest home storage of pesticides also had highest levels of suicidal thoughts in their populations. “Organophosphate pesticides are widely used around the world. Study Shows More Corn for Ethanol Production Hurts Water

(Beyond Pesticides, October 1, 2009) More pesticides and fertilizers used to grow conventional corn would find their way into nearby water sources if ethanol demands lead to planting more acres in corn, according to a Purdue University study. The study of Indiana water sources finds that fields practicing continuous-corn rotations have higher levels of nitrogen, fungicides and phosphorous than corn-soybean rotations. While touted as a green energy source, most corn ethanol is made with genetically modified corn that is routinely sprayed with pesticides and chemical fertilizers. To makes matters worse, it’s usually planted year after year, rather than using crop rotation, a basic strategy to reduce pest pressure and soil erosion. Corn ethanol is also inefficient, producing only 1.34 joules of energy for each joule used in production (compared to 8 joules for sugarcane). Furthermore, the American Clean Energy and Security Act (House Climate Bill) sidetracks a proposed EPA regulation that requires U.S. ethanol makers responsible for greenhouse gas emissions from conversion of forests and grasslands overseas to cropland. Children Living Near Agricultural Pesticide Use Have Higher Cancer Rate

(Beyond Pesticides, September 29, 2009) A new study reveals that children exposed to agricultural pesticides applied near their home have up to twice the risk of developing the most common form of childhood leukemia, according to the Northern California Cancer Center (NCCC). The study, “Residential proximity to agricultural pesticide applications and childhood acute lymphoblastic leukemia,†published in the October issue of Environmental Research, used a unique California database to reveal an elevated risk in acute lymphoblastic leukemia (ALL) among children living near applications of certain categories of pesticides used in agriculture. The study, led by Rudolph Rull, Ph.D., shows an elevated risk of ALL associated with moderate exposure, but not high exposure, to pesticides classified as organophosphates (odds ratio (OR) 1.6), chlorophenoxy herbicides (OR 2.0), and triazines (OR 1.9), and with agricultural pesticides used as insecticides (OR 1.5) or fumigants (OR 1.7). California is one of the few states in the country that requires active reporting of pesticide applications, including time, place, and the type and amount of pesticide used.
