Australian Organic Farmer Loses GE Contamination Suit

(Beyond Pesticides, May 29, 2014) The global fight to establish better protections from genetic contamination caused  by genetically engineered (GE) crops suffered a legal setback in Australia this week. A ruling of the Supreme Court of Western Australia  found that farmer Steve March could not seek compensation after losing his organic certification as a result of a neighbor’s GE crops contaminating his organic crops. Mr. Marsh filed the lawsuit against Michael Baxter, a neighboring GE canola seed farmer, alleging that  he had suffered economic damage because of his organic decertification. The decertification had been brought on by the confirmed presence of GE canola plants and seeds on his property and Australia’s zero-tolerance organic standard concerning GE contamination on organic lands. Mr. Baxter  began farming GE canola just a few years before and was the likely source of the contamination. Argued before the court earlier this year, the litigants as well as environmental and organic advocates across the globe had anxiously awaited the court’s decision. Supporters of the suit hoped it might advance much-needed protections against the economically devastating and oft uncontrolled invasion of GE crops on organic and non-GE lands. Oregon Counties Ban Planting of Genetically Engineered Crops

(Beyond Pesticides, May 23, 2014) Residents in two Oregon counties, Jackson and Josephine, voted to ban the cultivation, production, and distribution of genetically engineered (GE) crops within the counties’ borders Tuesday.  The Jackson County measure 15-119, passed with 66 percent of the vote, while Josephine County passed with 58 percent. As noted by Reuters, the newly approved measures mandate that people “harvest, destroy or remove all genetically engineered plants” no later than 12 months after the ordinances go into effect. This is great news for farmers of organic and non-genetically engineered crops, who constantly struggle with the threat of GE contamination. Though there are less than 120,000 registered voters in Jackson County, the measure gained national attention due to the fact that opponents raised over $830,000 to advertise againstthe measure, with over 97% of the funding coming in from outside of the county, including over $450,000 from biotech giant Monsanto and five other corporations to defeat the initiative. Minnesota Passes Bill to Label Garden Plants for Pollinators

(Beyond Pesticides, May 21, 2014) In response to recent public concern over the use of bee-killing systemic insecticides in treated nursery plants, Minnesota has just passed labeling legislation, HF 2798, which will inform consumers which plants are bee-friendly. The move follows a commitment by two Minnesota state agencies to study the impact of neonicotinoid pesticides, which ””given mounting research implicating neonicotinoids in bee declines”” beekeepers claim do not go far enough. Although the bill does not address agricultural neonicotinoid use, it is the first of its kind to ensure that nurseries keep tabs on the insecticides used on garden plants. Under the bill passed by Minnesota’s House and Senate last week, plants may not be labeled as beneficial to pollinators if they have been treated with detectible levels of systemic insecticides. Specifically, “A person may not label or advertise an annual plant, bedding plant, or other plant, plant material, or nursery stock as beneficial to pollinators if the annual plant, bedding plant, plant material, or nursery stock has been treated with and has a detectable level of systemic insecticide that: (1) has a pollinator protection box on the label; or (2) has a pollinator, bee, or honey bee precautionary statement […]

Industry Campaign and Congressional Hearing Mislead on Bee Decline

(Beyond Pesticides, April 30, 2014) A new report, released this week by author  Michele Simon  and Friends of the Earth  documents the tactics used by Bayer and other pesticide companies to delay regulatory action on neonicotinoid pesticides —a key contributor to bee declines. The report identifies public relations tactics reminiscent of those used by the tobacco industry, is now being used by Bayer, Syngenta, and Monsanto. Meanwhile, a Congressional hearing on pollinator health, with a panel dominated by industry, ignored the risks pesticides pose to pollinators, and failed to address sustainable solutions to bee decline. The report,  Follow the Honey: 7 Ways Pesticide Companies Are Spinning the Bee Crisis to Protect Profits,  uncovers the deceptive public relations tactics used by industry giants Bayer, Syngenta and Monsanto, to deflect blame from their products’ contributions to bee declines. France Bans GE Corn Cultivation, VT Passes GE Food Labeling Bill

(Beyond Pesticides, April 24, 2014) France’s lower house of parliament passed a bill last week banning the cultivation of all strains of genetically engineered (GE) corn within its borders, even those strains that might not yet be approved within the European Union (EU). The law follows a decree adopted last month, which targeted the only GE crop permitted for cultivation in the EU””Monsanto’s insect-resistant MON810 corn. Back in the U.S., Vermont became the first state to pass a  bill requiring the labeling of food containing GE ingredients  (You can read the House bill as it was introduced here and the Senate amendments to this bill here). The bill, which the Governor said he will sign, passed by large majorities in both houses of the legislature and does not contain a trigger provision similar to laws adopted in Connecticut and Maine  –with a  requirement that  similar action is taken in contiguous states before the law goes into effect. Vermont One Large Step Closer to Labeling Genetically Engineered Food

(Beyond Pesticides, April 18, 2014) Last week the Vermont state Senate voted 28-2 to authorize the mandatory labeling of foods made with genetically engineered (GE) ingredients. The bill, H.112, “An Act Relating to the Labeling of Food Produced with Genetic Engineering,” passed the Vermont House of Representatives back in May, and now goes back to the House for approval before moving to the Governor. Vermont’s legislation does not include a “trigger clause,” which is contained in  labeling bills passed last year in Maine and Connecticut  that, before  going into effect,  require other states in the New England region (including one boarding state) with an aggregate population of 20 million to pass similar laws. If the last hurdles in the state legislature are cleared and the bill is signed by Governor Peter Shumlin (D), Vermont’s labeling law would not allow manufacturers to describe any food containing GE ingredients as “all natural” or “natural.” Processed foods that contain a product or products with GE would be required to display in clear and conspicuous language the words, “partially produced with genetic engineering” or “may be partially produced with genetic engineering.” But even if passed, Vermont’s bill faces numerous challenges from the deep pockets […]

“DARK” Act Introduced to Stop the Labeling of GE Foods

Mike Pompeo (R-KS) recently introduced H.R. 4432, a bill that would give full authority of  genetically engineered (GE) labeling to the Food and Drug Administration, which now favors a voluntary approach to the issue.  The bill is designed by industry to undercut a growing number of states that are taking on GE labeling by preempting state authority. The bill is being fought by environmental and food safety groups that are backing federal legislation that would label all GE ingredients. H.R. 4432, or what is being dubbed as the “Deny Americans the Right-to-Know Act” (DARK Act) by activists, would dramatically change food labeling by giving the preemptive authority of labeling GE ingredients to the Food and Drug Administration (FDA). The act will prevent states from adopting their own GE labeling laws, allow food companies to put a “natural” label on products that contain GE ingredients, and prevent the FDA from requiring companies to label GE ingredients and continue its current “voluntary” labeling policy. With Big Money, Industry Fights County Ordinance to Ban GE Crop Planting

(Beyond Pesticides, April 7, 2014) A recent report by The Oregonian found that enormous amounts of money are being spent by agrichemical and biotechnology companies in  one Oregon  county to stop an ordinance that would ban farmers from being able to plant genetically engineered (GE) Crops. This current legislative fight encapsulates the uphill funding battle that anti-GE activists face when organizing state and local level campaigns. The ordinance that will appear on the upcoming May ballot in Jackson County, Oregon will ban the planting and rising of GE plants within the county. The ordinance also calls for the county to conduct inspections and allows enforcement through citizen lawsuits. Jackson County was the only county exempt from a law enacted last fall that made the state the regulator of agricultural seeds. The county’s measure qualified for the May ballot before the Oregon Senate passed S.B. 863, which preempts localities ability to regulate seed, so it was exempted in the bill. EPA Issues Stop Sale Order for Food Containers Laced with Nanosilver Pesticide

(Beyond Pesticides, April 3, 2014) A food container production company in New Jersey is finding out that the smallest of ingredients can have big implications for public health. Earlier this week, the U.S. Environmental Protection Agency (EPA) announced that it had issued a stop sale order to Pathway Investment Corp., manufacturer of Kinetic Go Green Premium Food Storage Containers and Kinetic Smartwist Series Containers. In addition to the order sent to Pathway, the EPA has also issued warning letters to Amazon, Sears, Wal-Mart and other large retailers directing them not to sell these products. The reason for the order: nanosilver””an extremely small particle of silver that has been added to consumer products of all kinds during the last decade to combat bacteria, mold, and other microorganisms. Because of nanosilver’s properties, it is considered a pesticide and active ingredient under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), the primary federal law governing pesticide use in the United States. Under FIFRA, any product containing an active ingredient that acts as a pesticide must be registered with EPA. Colorado GMO Labeling Initiative Overcomes Challenge by Industry

(Beyond Pesticides, March 19, 2014) Ruling on a  challenge by biotech industry interests, the Colorado Supreme Court on March 13 authorized the Right to Know Colorado ballot initiative to label GMO foods, clearing the way to begin collecting over 86,000 signatures needed for a 2014 statewide ballot measure. In overturning a major challenge by the biotech industry, pesticide, and grocery interests to a statewide GMO labeling ballot initiative, the Colorado State Supreme Court affirmed Colorado consumer’s right to determine whether the presence of genetically engineered foods should be labeled on food packaging. The State Supreme Court ruling allows the Right to Know Colorado campaign, a grassroots effort established by local residents to achieve mandatory labeling of genetically engineered (GE) ingredients ( commonly known as GMOs) in foods, to begin circulating petitions for signatures to place the initiative on the November 2014 ballot. Colorado requires 86,105 valid signatures to be submitted by early August to place an initiative on the ballot. Groups Sue EPA for Disclosure of Pesticide Inert Ingredients on Product Labels

(Beyond Pesticides, March 6, 2014)  Yesterday, Center for Environmental Health, Beyond Pesticides, and Physicians for  Social Responsibility, represented by Earthjustice, filed a complaint against the U.S. Environmental Protection Agency (EPA) for failing to complete rulemaking that would require pesticide manufacturers to disclose  the inert ingredients on  their pesticide product labels. An inert ingredient is any ingredient that is “not active,” or not targeted to killing a pest. “Consumers and users of pesticide products have a right to know all the ingredients that are in products they purchase so that they can make more informed choices in the marketplace,” said Jay Feldman, Executive Director of Beyond Pesticides. EPA’s 2010 proposal noted public disclosure “may lead to less exposure to”¦ hazardous inert ingredient[s] because consumers will likely choose products informed by the label.” In turn, “pesticide producers will likely respond by producing products with less hazardous inert ingredients.” Billions of pounds of pesticides are dispersed throughout the U.S. and enter our food supply, homes, schools, public lands and waterways. Petition Seeks Nationwide Refuge Ban of GE Crops and Neonicotinoid Pesticides

(Beyond Pesticides, February 27, 2014) Beyond Pesticides joined Center for Food Safety (CFS), Public Employees for Environmental Responsibility (PEER), and Center for Biological Diversityearlier this week in filing a formal petition for rulemaking with the U.S. Department of the Interior (DOI). The petition demands that the U.S. Fish and Wildlife Service (FWS), the DOI bureau tasked with managing and regulating the system of National Wildlife Refuges (NWRs) across this country, establish better protections for wildlife and their habitat by prohibiting the use of genetically engineered (GE) crops and neonicotinoid pesticides in NWRs as well as other necessary policy changes. The petition asserts that the allowed cultivation of GE crops and use of neonicotinoid pesticides on lands designated as NWRs violates not only the purpose and protective standards of the National Wildlife Refuge Act (NWRA), which seeks to conserve, manage and restore fish wildlife, and plant resources and their habitats for the present and future generations, but also threatens endangered species by resulting in destruction of critical habitat protected under the Endangered Species Act (ESA). EPA Proposes Updated Farmworker Protection Standards to Mixed Reviews

(Beyond Pesticides, February 24, 2014) The U.S. Environmental Protection Agency (EPA) last week released its long-awaited proposal to update Farm Worker Protection Standards (WPS),  which are designed to provide protections from pesticide exposure for more than two million farmworkers and their families across the nation.   Historically, farmworker advocates have criticized these protections as woefully inadequate in protecting the health of agricultural workers, but these new revisions attempt to strengthen the standards through increased training for workers handling pesticides, improved notification of pesticide applications, and a higher  minimum age requirement for children to work around pesticides. Farmworkers face disproportionate risks to pesticide exposures, with EPA stating that pesticide exposure incidents are vastly under-reported —in some case by as much as 90 percent. Although these proposed changes are a step in the right direction, there are still ongoing concerns about whether the changes will be adequate to protect workers. Revisions to the 20 year old standard have been under discussion for many years. In 2010, EPA released a document proposing WPS that would determine ways to increase training, improve safety requirements, provide clear emergency information, and create strong protection for applicators. Bee Week of Action: Demand Stores Stop Selling Bee-Killing Pesticides

Thousands participate in bee swarm actions across the country on Valentine’s week (Beyond Pesticides, February 12, 2013) ”” This week, over 27,000 people coast-to-coast are swarming Lowe’s and Home Depot stores to support the bees that pollinate our flowers for Valentine’s Day. In a coalition campaign called the Bee Week of Action, Beyond Pesticides, Friends of the Earth and allies are delivering more than half a million petition signatures and Valentines asking these retailers to show bees some love by taking off their shelves pesticides shown to harm and kill bees —and garden plants treated with these pesticides. Groups Call on Obama to Require National GE Labeling Laws

(Beyond Pesticides, January 25, 2014) U.S. Representative Peter DeFazio (D-OR) joined other members of Congress, along with more than 200 businesses and organizations, including Beyond Pesticides, in petitioning President Obama to adopt labeling requirements for genetically engineered (GE) foods. The letter encourages the president to fulfill his campaign pledge made in 2007 to require the Food and Drug Administration (FDA) to adopt a national mandatory labeling system. “It’s time the FDA’s policies reflected 21st century food technologies,” said Rep DeFazio in a press conference last Thursday. “After all, twenty years ago they didn’t have corn that could produce its own insecticides.” In April 2013, Rep. DeFazio and Senator Barbara Boxer (D-CA) introduced bipartisan legislation that requires FDA to label GE food, under the proposed Genetically Engineered Food Right-to-Know Act. Maine GE Labeling Bill Signed, Industry Pushes Federal Bill to Prohibit State Action

(Beyond Pesticides, January 10, 2014)  A requirement to  label genetically engineered (GE) foods in the state of Maine is set to become law. The bill, LD718, “An act to protect Maine food consumers’ right to know about genetically engineered food and seed stock,” was passed by the state legislature in July 2013 by a vote in the House of Representatives of 141 to 4, and  with the Senates’ unanimous approval. The bill was then sent  to Governor Paul LePage (R-ME) and signed into law on Wednesday, January 8. Meanwhile, the conventional food industry is pushing legislation in Congress to prevent, or preempt,  states from adopting laws requiring labeling of GE foods. The Maine Organic Farmers and Growers Association (MOFGA) praised the Maine law.  “We are thrilled that Governor LePage has signed the GMO labeling bill,” said MOFGA’s executive director Ted Quaday. “The time was right for a diverse and collaborative effort to take hold and move the discussion forward. General Mills to Drop Genetically Engineered Ingredients in Original Cheerios

(Beyond Pesticides, January 8, 2014) Last week, General Mills announced that the company will  eliminate genetically engineered (GE) ingredients from its mainstay original cereal Cheerios. The action  recognizes  the overwhelming consumer demand for GE-free products. The move was met with  a range of  reactions in the environmental community, from cheers of  victory for the GE-free movement to calls for broader action affecting General Mills’ product line, right-to-know labeling of all foods produced with GE ingredients, and compensation of farmers by patent holders of genetically engineered material that contaminates their crops.  The General Mills’ announcement does not apply to all of its Cheerio products, or its other products. “Did we change Cheerios? No. Not really,” says a blog post by Tom Forsythe, vice president of Global Communications for General Mills. “Why change anything at all? It’s simple. Oregon Legislation To Restrict Home Use of Bee-Killing Pesticides

(Beyond Pesticides, January 7, 2014) An Oregon state representative, Rep. Jeff Reardon (D-Portland), plans to introduce legislation in February that will effectively ban for home and garden use  certain neonicotinoid pesticides implicated in mass bee deaths this  summer. This legislation is part of the growing national effort to ban or restrict the use of neonicotinoid pesticides. Last year, the Save America’s Pollinators Act was introduced by Representative Earl Blumenauer (D-OR) to ban the use of neonicotinoids nationally. Rep. Reardon’s legislation would add neonicotinoid pesticides dinotefuran, imidacloprid, clothianidin and thiamethoxam to Oregon’s restricted pesticide use list. Under Oregon’s pesticide administrative rules,restricted use pesticides can only be applied by licensed pesticide applicators. Pesticide dealers are also required  to keep records of product sales of these pesticides and maintain sales records for at least three years. The legislation would also require the state to implement special training and testing to ensure licensed pesticide applicators know how to minimize risk to   pollinators. “These are dangerous chemicals. Large End-of-Year Penalty for Pesticide Violation Amid EPA’s Record of Few Enforcement Actions

Alleging multiple violations of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), the agreement requires Harrell’s to pay a hefty civil penalty in the amount of $1,736,560. Under FIFRA, the nation’s primary law governing the manufacture, distribution, and use of pesticides, a pesticide product cannot enter the U.S. marketplace without EPA registration and an approved label that conveys to intended users of the product critical information about its contents, methods and areas of application, and potential hazards. Ideally, the purpose of FIFRA is to ensure that no pesticides are produced, imported, distributed, sold, or used in a manner that pose an “unreasonable risk” to human health or the environment. Bee-Killing Pesticides Damage Children’s Brain and Nervous System, Says European Authority

(Beyond Pesticides, December 20, 2013) The European Food Safety Authority (EFSA) announced on Tuesday that pesticides linked to honey bee deaths worldwide may also damage human nervous systems ””in particular the brain, and recommended that the European Commission lower the guidance levels of acceptable exposure until more research is conducted. This new determination heightens the call to ban the use of these toxic chemicals in the U.S., following the lead of the European Union (EU). EFSA found that two commonly used chemicals “may adversely affect the development of neurons and brain structure associated with functions such as learning and memory” particularly of children. The recommendation focuses on two chemicals ””acetamiprid and imidacloprid”” in a relatively new class of insecticide called neonicotinoids. Three chemicals in this class were recently placed under a two-year ban in the European Union (EU) for uses on flowering crops known to attract honey bees. Close Results on GE Labeling in Washington State Raises Public Awareness of the Trouble with Modified Crops

(Beyond Pesticides, November 25, 2013) With nearly all the votes counted for Washington State’s Initiative 522, results show the measure defeated by a razor thin margin. After somber reports on Election Day had the measure trailing by 11%, supporters of I-522 urged patience as ballots continued to stream in (Washington runs an all-mail voting system). The race tightened up significantly, but ultimately succumbed to a 49%Y-51%N margin. Despite the results, Washington State’s initiative made incredible progress at raising awareness of the adverse health and environmental impacts associated with genetically engineered (GE) agriculture. A number of factors also worked against the Yes campaign during the final weeks leading up to Election Day, including an enormous influx of money from agrichemical companies and food manufacturers, which financed an advertising blitz claiming the initiative would raise the cost of food. The placement of the measure on an “off-year” election also drove down voter turnout. Yeson522 co-chair Trudy Bialic explains, “There was lower than expected voter turnout this year. Despite being outspent 3-to-1, we are projecting winning 49% of the vote. Fate of GE Labeling in Washington State To Be Decided Today

(Beyond Pesticides, November 5, 2013) Today residents of Washington State will vote on ballot measure I-522, to determine whether food sold on supermarket shelves will be required to disclose the presence of genetically engineered (GE) ingredients. The simple premise of labeling GE food has been fueled by a growing grassroots movement demanding a right to know the ingredients in the food they consume. Opposition to the ballot measure has been propped up by a moneyed cadre of chemical and food corporations that claim labeling would confuse consumers and lead to higher prices at the check-out line. Funding behind I-522 has tracked a similar trajectory to Proposition 37 on the ballot in California last year, with food and chemical corporations pouring tens of millions of dollars into advertising against the measure in the run-up to Election Day.  However, while proponents of labeling were outspent 6 to 1 in California, the gap in spending for I-522 narrowed to about 3 to 1 ($22 million to $7.8 million) in Washington State.
