Hawaii Pesticide Disclosure Bill Passes Committee

(Beyond Pesticides February 10, 2016) Last week Hawaii’s House Energy and Environmental Protection Committee, chaired by Representative Chris Lee, unanimously passed a measure to require large-scale, outdoor commercial agricultural businesses to publicly disclose outdoor application of pesticides in various environmentally sensitive areas. House Bill 2574  will  make the reporting guidelines for the voluntary Kauai program mandatory across the state and will  also establish “disclosure and public notification requirements for outdoor applications of pesticides in and in the proximity of schools, health care facilities, child care facilities, elder care facilities, and other environmentally sensitive areas,” according to the bill. The bill’s next step is the Agriculture Committee, where chair Representative Clift Tsuji has killed pesticide-related bills in the past. House Bill 2574 is the latest in a string of laws proposed by local and state governments within Hawaii to try to  protect citizens from the harms of toxic pesticides. In 2015, Hawaiian legislators proposed House Bill 1514  to establish school and hospital buffer zones. Bayer Refuses to Cancel Insecticide Toxic to Aquatic Life

(Beyond Pesticides, February 9, 2016) Last week, Bayer CropScience reneged on an agreement with the U.S. Environmental Protection Agency (EPA) to voluntarily cancel the conditionally registered insecticide flubendiamide if  the agency  received  data that  identified adverse ecological effects. Based on the data, EPA found that the chemical causes “unreasonable adverse effects” to benthic organisms living in sediment near agricultural fields. Bayer’s defiance in the face of EPA’s finding  points to  a fundamental  weakness in  the agency’s conditional pesticide registration process, which allows toxic chemicals onto the market without a complete and comprehensive assessment  of their  potential  harm, in this case to  wildlife and the vital ecosystem services they provide. In 2008, EPA granted Bayer a “conditional” registration for flubendiamide, a classification that allows a new pesticide to be registered and used in the field, despite outstanding data points on its toxicological impact. In this case, original data submitted to EPA by Bayer showed concern over the effect of the chemical and its breakdown product on freshwater benthic invertebrates, species such as crustaceans and aquatic insects that  live in stream sediment and provide important ecosystem services such as decomposition and nutrient cycling. Oregon Proposes Legislation to Protect Farmers and Consumers from GE Contamination

(Beyond Pesticides, January 28, 2016) Last week, Oregon Representative Paul Holyey introduced legislation that would protect traditional crops against contamination from their genetically engineered counterparts. As it stands, local governments are preempted (disallowed) from taking actions that protect traditional farmers from contamination by genetically engineered (GE) crops. With the help of advocates representing family farms and food safety, The Transgenic Contamination Prevention Bill (HB 4122) will  repeal sections of Senate-passed  Bill 863,  which  preempts local governments, and restore the  right of local jurisdictions to regulate the planting of GE  seed. The law, Bill 863, dubbed  Oregon’s Monsanto Protection Act by environmentalists, farmers and consumers, was passed in 2013 and signed into law by then-Governor John Kitzhaber. The new language in HB 4122 seeks to correct the chemical company-driven legislation of the former bill and restore protection for traditional and organic farmers. In May, 2014, the voters of Jackson and Josephine Counties, Oregon, passed a ballot initiative, Genetically Modified Organism Ban, Measure 15-119, which sparked the backlash in the state legislature. WA Oyster Growers Request Approval to Spray Neonicotinoid Pesticides in Bay, Despite Public Opposition

(Beyond Pesticides, January 13, 2016) Last Friday, the Willapa Grays Harbor Oyster Growers Association (WGHOGA) in Washington State sent a 71-page request to the Washington Department of Ecology (Ecology) asking state regulators to approve  a permit to  spray neonicotinoid insecticides  that are having devastating effects on the ecosystems worldwide. Yet, WGHOGA is pursuing a single-minded approach to chemically control the shrimp that are hurting their oyster crops, while using chemicals that the preponderance of science finds cause ecosystem imbalance. In  April 2015, much to the dismay of activists and concerned local residents, Ecology approved a permit for the use of imidacloprid (a neonicotinoid) to combat a growing native population of burrowing shrimp that threatens  valuable shellfish (oyster) beds in Willapa Bay and Grays  Harbor. But, with a  nationwide public outcry, the permit was withdrawn in May 2015. Campbell Soup Says GE Food Is Safe, Endorses Mandatory GE Labeling to Preempt States with Weak Language

(Beyond Pesticides, January 12, 2016) Late last week in a precedent-setting move, Campbell Soup Company announced its support for federal mandatory labeling of foods containing genetically engineered (GE) ingredients. If such labeling does not come soon, the company also indicated it is prepared to voluntarily label all products it produces that  contain GE ingredients. Agri-Pulse reported, “Campbell made clear that it still supported the use of genetic engineering in agriculture but said that there is a need for national labeling standards that would preempt state standards.” Campbell’s President and CEO Denise Morrison, ““I want to stress that we’re in no way disputing the science behind GMOs or their safety. The overwhelming weight of scientific evidence indicates that GMOs are safe and that foods derived from crops using genetically modified seedsare not nutritionally different from other foods,” Morrison wrote.” Ms. Morrison said that the company is against a patchwork of regulation across the states.  In its release Campbell issues a sample label, which states:  “Partially produced with genetic engineering. UK Researchers Find Bee-Killing Pesticide Cocktail in Hedgerows and Wildflowers

(Beyond Pesticides, January 11, 2016) Scientists at Sussex University in the United Kingdom (UK) have found that bumble bees and honey bees are exposed to a harmful chemical cocktail when collecting pollen from wildflowers and hedgerows that border neonicotinoid-treated crops in UK farmland. After testing oilseed rape croplands during blooming season, these chemical cocktails were found to be mixed with fungicides and insecticides, and at concentrations much higher than expected.  According to the Soil Association, which supported the study, “These chemical cocktails could make the impact of neonicotinoids up to 1,000 times more potent than previously realized.” With at least 121 different agrochemicals detected in hive wax and pollen samples in the Unites States, most of which include systemic pesticides, it is becoming increasingly more important to study the synergistic effects of pesticides in and outside of farm land. The study focused on “determining which mixtures of commonly used fungicides occur alongside neonicotinoids” and found that all individual oilseed rape pollen samples contained at least six neonicotinoid and fungicide residues. Study Adds to Evidence of Endocrine-Disrupting Chemicals in Intersex Fish

(Beyond Pesticides, January 4, 2016) A study published by the U.S. Geological Survey (USGS) and U.S. Fish and Wildlife Service (FWS) found large-scale evidence of intersex in smallmouth and largemouth bass in the Northeast United States, an indicator of endocrine disruption. The study, published in the journal Ecotoxicology and Environmental Safety, looks at 19 U.S. National Wildlife Refuges and is the first reconnaissance survey of this scope. The study found that the prevalence of testicular oocytes across all samples was 85% and 27% for male small- and largemouth bass, respectively. Intersex occurs when one sex develops characteristics of the opposite sex. In the case of this study, researchers found testicular oocytes ””female eggs found inside male testicles””in male smallmouth and largemouth bass. The study explains, “The presence of oocytes in the testes of male gonochoristic fish has been used as an indicator of estrogenic exposure.” The source of the estrogen is hard to pinpoint, but pesticides are often cited as a cause given that they widely pollute waterways that  fish populate. Native Bee Populations on Decline on U.S. Farms

(Beyond Pesticides, December 23, 2015) Native  bees are on the decline in some of the major agricultural regions in the United States, according to a new study. The study scientists produced the first national map of bee populations and identified numerous trouble areas. Since 2006, honey bees and other pollinators in the U.S. and throughout the world have experienced ongoing and rapid population declines. The continuation of this crisis threatens the stability of ecosystems, the economy, and food supply, as one in three bites of food are dependent on pollinator services. The study, titled Modeling the status, trends, and impacts of wild bee abundance in the United States  and published in the journal Proceedings of the Natural Academy of Science, for the first time aims to assess the status and trends of wild bees and their potential impacts on pollination services across the U.S. and found that between 2008 and 2013 bee abundance declined across 23% of the nation’s  land area. Herbicides and Endocrine-Disrupting Chemicals Linked to Decline of Smallmouth Bass

(Beyond Pesticides, December 18, 2015) One of the most likely causes for the population decline of smallmouth bass in the Susquehanna River are endocrine-disrupting compounds and herbicides, concludes a multi-agency, multi-year study of one of the most complex river systems in Pennsylvania. The Pennsylvania Department of Environmental Protection (DEP) and the Pennsylvania Fish and Boat Commission (PFBC), along with nearly 50 participants and six partner agencies, released findings on Monday that narrow the likely causes from an initial field of 14 candidates to two. PFBC also found that pathogens and parasites are probable contributing factors. Following a smallmouth bass (SMB) population crash in 2005, and additional observed maladies, such as tumors and lesions on SMB, the team used ground-breaking monitoring strategies to collect more than 30,000 water quality records annually, along with review of existing research to isolate the possible causes keeping young-of-the-year (YOY) SMB from growing to adulthood. Genetically Engineered Salmon without Labeling Approved by FDA

(Beyond Pesticides, December 1, 2015) Last month, the U.S. Food and Drug Administration (FDA) approved, without a labeling requirement, a genetically engineered (GE) salmon designed to grow faster and come to market quicker than other farmed salmon. The fish, dubbed AquAdvantage by its developer, Massachusetts-based biotechnology firm AquaBounty, has been the center of considerable controversy as it represents the first GE animal approved for commercial sale and human consumption. While FDA has declared the fish safe to eat, and AquaBounty argues the fish will help feed the world, opponents stress that the potential adverse effects of the technology have not been properly vetted, and consumers will have no way to tell whether the salmon they purchase at the store is the engineered AquAdvantage product. Draft guidelines released by FDA when the salmon was approved do not require retailers to inform consumers that the fish is GE. Instead, the agency provided examples of voluntary statements, such as “genetically engineered,” or “This salmon patty was made from Atlantic salmon produced using modern biotechnology,” that producers  can consider using. Studies Add to Mounting Evidence of Neonic Dangers

(Beyond Pesticides, November 30, 2015) Last week, two studies were published that link neonicotinoid (neonic) insecticide exposure to detrimental effects in bees and butterflies. The first study, published in the international scientific journal Nature, found that bumblebees exposed to neonics suffered pollination services impairment that reduces their delivery to apple crops. The second study, published in the United Kingdom journal Peer J, used over 1,000 sites cataloged from 1984 to 2012 in the UK Butterfly Monitoring Scheme (UKBMS) database to point to the strong association between neonic use and butterfly population decline. These studies contribute to the mounting evidence that neonic insecticides are linked to pollinator decline. Neonics have increasingly been the subject of recent studies that highlight a causal relationship between neonic exposure  and harmful effects to pollinators, like foraging and reproductive complications. These effects are being identified by scientists all over the world, gradually negating industry criticism of study design. EPA Revokes Registration of Toxic Pesticide Central to Genetically Engineered Agriculture

(Beyond Pesticides, November 25, 2015) In response to a lawsuit filed by environmental groups, the U.S. Environmental Protection Agency (EPA) yesterday revoked the registration of the toxic herbicide “Enlist Duo,” which contains the cancer causing 2,4-D and is central to future uses of genetically engineered (GE) crops in chemical-intensive agriculture. The marketing of this chemical in genetically engineered agriculture has become integral to the chemical industry’s response to weed resistance to the widely used herbicide glyphosate (Roundup), also identified as cancer causing this year by the International Agency for Research on Cancer (IARC). “Instead of looking for genetically engineered silver bullets that result in crop failure, we should be expanding organic agricultural systems that are productive and profitable, protect public health and the environment and slow global climate change,” said Jay Feldman, executive director of Beyond Pesticides. Native Bees Found to Have Residues of Pesticides Linked to Their Steep Decline

(Beyond Pesticides, November 12, 2015) The U.S. Geological Survey (USGS) recently performed the first-ever study of pesticide residues on native bee populations and found that they are exposed to neonicotinoid insecticides, as well as other pesticides, at significant rates. This study digs deeper into a question  that was previously considered by a researcher who  studied chemical-intensive  apple orchards and linked a steep decline in wild or native bees to the application of pesticides. The USGS study  broadens understanding about the effects of toxic pesticides to native bee species, expanding field research that has principally focused on managed honey bee populations. The study tested for 122 different pesticides including bifenthrin, atrazine and chlorpyrifos, a chemical for which the U.S. Environmental Protection Agency (EPA) recently proposed to revoke all food tolerances in response to  a court-ordered deadline. USDA Continues to Suppress Independent Science on Bee-Killing Pesticides

(Beyond Pesticides, November 09, 2015) The U.S. Department of Agriculture (USDA) cancelled a webinar on the presence of neonicotinoids in waterways in the Prairie Pothole region, according to the government watchdog group Public Employees for Environmental Responsibility (PEER). PEER states that the cancellation is “another example of USDA interfering with the release of new science-based information about adverse effects linked to  neonicotinoid (neonics) pesticides.” As a result, PEER continues, “Growing ecological risks posed by the most widely used insecticides in North America will likely not be considered in developing USDA policies, planning or management practices.” Neonicotinoids are a controversial class of chemicals that have been linked to the global bee decline by a rapidly growing body of scientific literature. A webinar, titled Pesticides and Potholes: Understanding the Risks of Neonicotinoid Insecticides to Aquatic Ecosystems in Prairie Canada and Beyond,  was supposed to take place June 24, 2014, according to PEER. EPA Continues Trend of Pesticide Approval without Adequate Review

(Beyond Pesticides, November 2, 2015) The Center for Biological Diversity (CBD) submitted a formal notice last week for intent to sue the Environmental Protection Agency (EPA) for approving benzovindiflupyr, a fungicide that is highly toxic to fish and aquatic invertebrates. CBD asserts that EPA recognized that benzovindiflupyr could harm wildlife and critical habitat protected by the Endangered Species Act (ESA), but approved it for use without consulting with expert wildlife agencies as required by the act. This is  not the first time that EPA has approved toxic chemicals without fully understanding the consequences. On August 28, 2015, EPA granted broad approval for use of benzovindiflupyr on most crops, including cereals, corn, vegetables, fruits, turf grass and ornamentals. The agency’s own data show that benzovindiflupyr is highly persistent in the environment and will build up in waterways due to runoff from treated fields. USDA Scientist Punished for Neonic Study Files Complaint

(Beyond Pesticides, October 29, 2015) One of the top entomologists at the U.S. Department of Agriculture (USDA) filed a whistleblower complaint against a  federal agency, citing unprofessional retaliation following the publication of a study linking neonicotinoid insecticides to the decline of monarch butterflies. Jonathan Lundgren, Ph.D., Senior Research Entomologist and Lab Supervisor for the Agricultural Research Service (ARS) in South Dakota, is fighting suspension for publishing research deemed “sensitive” by his USDA superiors. According to Jeff Ruch, executive director of Public Employees for Environmental Responsibility (PEER), which is providing legal services to Dr. Lundgren, this case underscores why legal protections for government scientists are sorely needed. Until recently, Dr. Lundgren worked for USDA for eleven years with great success, and his cutting edge research has drawn national attention and international recognition. In April of this year, Dr. Lundgren published a study in The Science of Nature that shows that clothianidin, a neonicotinoid seed treatment, kills monarch butterfly larvae in the laboratory. Fresh Produce Tainted With Illegal Pesticides

(Beyond Pesticides, October 23, 2015) Tests on produce collected by California’s Department of Pesticide Regulation (CDPR) for 2014 show high levels of  illegal toxic pesticide residues. The CDPR report found 1 percent of produce containing an excess amount of pesticide residues, and an additional 5.5 percent of produce tested contained illegal residues of pesticides that are not allowed for use on that product. Additionally, the data shows residues of a banned  chemical, which was taken off the market  over 20 years in the U.S. due to health concerns related to farmworker exposure. These findings showcase issues related to  system-wide failure in  enforcement. Advocates stress that violations may continue to occur due to inadequacies in regulations governing enforcement authorities, which include warnings or low fines for violators. In raising concerns about the safety of food grown with chemical-intensive methods, advocates point to the need to expand the transition to organic agriculture for better protection of public health and safety. U.S. Senators to Advance Legislation to Stop States from Labeling GE Food

(Beyond Pesticides, October 22, 2015) With increasing consumer concern about genetically engineered (GE) food, yesterday  the U.S. Senate Committee on Agriculture, Nutrition, and Forestry held a hearing,  entitled Agriculture Biotechnology: a Look at Federal Regulation and Stakeholder Perspectives, that critics called lopsided. Study Finds Neonics “Severely Affect” Health of Honey Bee Queens

(Beyond Pesticides, October 20, 2015) Exposure to neonicotinoid (neonic) pesticides results in profound negative impacts to the health of honey bee queens, according to an international team of researchers led by Geoff Williams, MD, PhD, at the University of Bern in Switzerland. While most studies to date have investigated how neonics effect the health of individual workers or overall colony fitness, Dr. William’s study, Neonicotinoid pesticides severely affect honey bee queens, is one of the first to focus on the health of honey bee queens. Neither the European Union nor U.S. Environmental Protection Agency (EPA) study the impacts of pesticides on queen health before allowing a pesticide to market. The results of this research are particularly concerning, given widespread anecdotal evidence from beekeepers across the globe that ”˜poor quality queens’ are playing a role in bee declines. To test the impacts of these chemicals on queen honey bees, scientists exposed a sample of 29 queens to field-realistic levels of the neonics  clothianidian and thiamethoxam (1 parts per billion and 4 ppb respectively), and compared them to a population of 28 control queens, which were not treated with neonics. Monsanto Faces Lawsuits on Cancer Linked to Roundup

(Beyond Pesticides, October 19, 2015) Monsanto, the major producer of Roundup (glyphosate), has found itself in hot water recently, as personal injury lawsuits pile up over the link between glyphosate exposure and non-Hodgkin’s Lymphoma (NHL). Personal injury law firms around the U.S. have found a multitude of plaintiffs and are preparing for what could be a “mass tort” action against Monsanto for knowingly misinforming the public and farmworkers about the dangers of the chemical. The latest lawsuit was filed October 14 in Delaware Superior Court by three law firms representing three plaintiffs. One plaintiff in the Delaware lawsuit, Joselin Barrera, 24, a child of migrant farmworkers, relates  her non-Hodgkin lymphoma (NHL) to glyphosate exposure. Elias de la Garza, a former migrant farm worker and landscaper diagnosed with NHL, has a similar claim. These follow other lawsuits filed last month in New York and California that  accuse Monsanto of knowing that glyphosate was hazardous to human health. Monsanto “led a prolonged campaign of misinformation to convince government agencies, farmers and the general population that Roundup was safe,” the lawsuit states. Majority of EU Countries Opt-Out of Approved GE Crops

(Beyond Pesticides, October 13, 2015) Nineteen  European Union (EU) member states (Austria, Belgium (Wallonia), Bulgaria, Croatia, Cyprus, Denmark, France, Germany, Greece, Hungary, Italy, Latvia, Lithuania, Luxembourg, Malta, The Netherlands, Poland, Solvenia, Scotland, Northern Ireland, and Wales) have opted out of approving GE cultivation except for research purposes. In the past, the EU has not been particularly fond of GE crops; currently, only one GE crop, insect resistant maize MON 810, has been approved for cultivation. In March, the EU passed a new directive that allowed GE crops to be approved for use Union-wide. Along with the Treaty on the Functioning of the EU (TFEU), that directive also gave member states the ability to “adopt legally binding acts restricting or prohibiting the cultivation of GMOs in their territory after such GMOs have been authorized to be placed on the Union market.” Once the opt-out applications have been processed and transmitted to the companies, they have one month to take action; that is, the companies most affected by the ban will have the chance to oppose it. EPA Releases Long-Awaited Revisions To Worker Protection Standards

(Beyond Pesticides, September 30, 2015) On September 28, the U.S. Environmental Protection Agency (EPA) finally released its new regulation regarding farmworker pesticide safety, revising the Agricultural Worker Protection Standards (WPS), which are designed to provide protections from pesticide exposure to farmworkers and their families. These standards have not been updated for over 20 years, and EPA had delayed revisions since the first proposed update in 2010. Historically, farmworker advocates have criticized these protections as woefully inadequate in protecting the health of agricultural workers, but these new revisions attempt to strengthen the standards through increased training for workers handling pesticides, improved notification of pesticide applications, and a higher  minimum age requirement for children to work around pesticides. Farmworker Justice, a nonprofit organization that seeks to empower migrant and seasonal farmworkers, has praised the revisions as a step in the right direction, but noted that the ruling did not include some significant safety measures.
