Court Rejects USDA Motion to Dismiss Lawsuit on Organic Rule Change

(Beyond Pesticides, September 14, 2015) On Thursday September 10, a federal judge in the U.S. District Court for the Northern District of California, in a bench ruling, rejected the U.S. Department of Agriculture’s (USDA)  motion to dismiss a federal lawsuit (Case3:15-cv-01690) that challenges the National Organic Program’s (NOP) failure to follow proper legal procedures  in making a substantial rule change to the organic standard. This court ruling allows the case to move forward  on the  proper procedure and the importance of formal notice and public comment regarding  the rules for organic food production. The lawsuit, filed earlier this year by the Center for Environmental Health, Beyond Pesticides, and the Center for Food Safety (CFS), challenges the contaminated compost guidance  released by USDA, which weakens the long- standing prohibition of synthetic pesticide contaminants. Prior to the new contaminated compost guidance, organic regulations expressly prohibited fertilizers and compost from containing any synthetic substances not included on organic’s National List of Allowed and Prohibited Substances. EPA at Odds with Scientists on Endocrine System Effects of Weedkillers Atrazine and 2,4-D

(Beyond Pesticides, July 6, 2015) With the release of its  Tier 1 screening results  for the first 52 pesticide chemicals (active and inert ingredients) evaluated under  the Endocrine Disruptor Screening Program (EDSP), the U.S. Environmental Protection Agency (EPA) is at odds with a large body of scientific evidence worldwide that identifies many of these chemicals, most notably the herbicides  2,4-D  and  atrazine,  as interacting with the endocrine system or acting as endocrine disruptors. Independent scientific data has shown these chemicals to interfere with the hormone system. EPA’s EDSP is a multi-step process used to ensure that exposure to chemicals does not result in adverse human health and environmental effects that canoccur from the disruption of hormones. The two-tiered screening and testing system requires that EPA identify which chemicals are able to interact with the endocrine system, specifically with three hormonal pathways — estrogen, androgen, and thyroid — in Tier 1. Major issues before the spring 2015 NOSB include: Ӣ Synthetic methionine should be phased out of organic poultry feed as the NOSB originally decided. Methionine is an amino acid that acts as a growth promoter (comparable to the synthetic growth promoter rGBH used in dairy cows). The new proposal increases use instead of increasing space and outdoor access, and alternative feed sources —without any scientific support. Common Herbicides Linked to Antibiotic Resistance

(Beyond Pesticides, March 30, 2015) Last week, following the World Health Organization’s (WHO) declaration that glyphosate is carcinogenic to humans  based on animal studies, a new study was published in the American Society of Microbiology’s journal, mBio, linking glyphosate, 2,4-D and dicamba to antibiotic resistance after testing the sub-lethal effects of these pesticides in certain bacteria. The new mBio study finds  that when bacteria, specifically Salmonella and E. coli, are exposed to the herbicides described above, they responded differently to the common antibiotics ampicillin, ciprofloxacin, chloramphenicol, kanamycin, and tetracycline. Researchers replicated real-world scenarios by purchasing weed killers from a local store and using the exact levels that are specified on the product label. This provided researchers with the opportunity to observe how the bacteria reacted when exposed to the herbicides at sublethal levels; that is, those that did not kill them. When the bacteria are exposed to the herbicides and the antibiotics at the same time, the exposure to the herbicides trigger a defense mechanism that otherwise would not have been triggered solely by the antibiotics. Groups Call for Labeling of 300 Inerts Ingredients as EPA Delists 72 Already Discontinued

(Beyond Pesticides, October 27, 2014) Calling it a  response to a petition filed by  Beyond Pesticides and other groups back in 2006, the U.S. Environmental Protection Agency (EPA) announced Thursday its  proposal to remove 72 no longer used inert ingredients from its list of approved pesticide ingredients  —as  groups asked for public disclosure of all inerts ingredients in pesticide formulations on product labels. While the proposal is a step in the right direction, ultimately the move is inadequate and misdirected, as the original petition, submitted along with Center for Environmental Health, Physicians for Social Responsibility, and nearly 20 other organizations, called for the agency to require pesticide manufacturers to disclose 371 inert ingredients on their pesticide product labels. The proposal not only fails to address the issue of disclosure for the rest of the 300 inert ingredients, but also only targets hazardous chemicals no longer being used as inert ingredients in any pesticide formulation, such as rotenone, turpentine oil, and nitrous oxide. Review Links Glyphosate to non-Hodgkin’s Lymphoma

(Beyond Pesticides, May 2, 2014) A recent review, published in the International Journal of Environmental Research and Public Health, examines the interaction between widely used agricultural herbicides, like glyphosate, the active ingredient of Roundup products, and the risk of developing non-Hodgkin’s lymphoma (NHL). The study represents one of the most comprehensive reviews on the topic of occupational exposure to pesticides in scientific literature, demonstrating their clear harm to human health. The study, “Non Hodgkin lymphoma and occupational exposure to agricultural pesticide chemical groups and active ingredients: A systematic review and meta-analysis,” reviews almost thirty years of epidemiological research, examining occupational exposure of farmers to 80 active ingredients, and 21 chemicals groups to clarify their role in the development of NHL. Analyzing 44 papers, the study opens its discussion by mentioning the ”˜striking increase’ in incidents of NHL over the past 30 years. The study attempts to reconcile apparent trends of low mortality but high incidents of cancer among farm workers, pointing out that exposure to agricultural pesticides are often associated with signficint sub-lethal impacts. Triclosan Linked to the Growth of Breast Cancer Cells

(Beyond Pesticides, April, 29, 2014) According to a recent study published in the American Chemical Society’s (ACS) journal Chemical Research in Toxicology, the chemicals triclosan and octylphenol are linked to the growth of breast cancer cells. Triclosan is an antibacterial and antifungal agent found in numerous commonly known household products. Octylphenol is a commercial solvent that can be found in paints and plastics, and is often used as an inert ingredient in pesticide formulations. Researchers investigated whether these two endocrine-disrupting chemicals (ECDs) contributed to the growth of cancer cells. In their study, Progression of Breast Cancer Cells Was Enhanced by Endocrine-Disrupting Chemicals, Triclosan and Octylphenol, via an Estrogen Receptor-Dependent Signaling Pathway in Cellular and Mouse Xenograft Models, scientists performed both in vitro tests on human breast cancer cells in petri dishes, and in vivo tests via tissue grafts on mice. “Although the doses of EDCs were somewhat high, we did this to simulate their effects of daily exposure, as well as body accumulation due to long-term exposure, simultaneously in animal experiments,” said Kyung-Chul Choi, PhD, co-author of the research. Groups Sue EPA for Disclosure of Pesticide Inert Ingredients on Product Labels

(Beyond Pesticides, March 6, 2014)  Yesterday, Center for Environmental Health, Beyond Pesticides, and Physicians for  Social Responsibility, represented by Earthjustice, filed a complaint against the U.S. Environmental Protection Agency (EPA) for failing to complete rulemaking that would require pesticide manufacturers to disclose  the inert ingredients on  their pesticide product labels. An inert ingredient is any ingredient that is “not active,” or not targeted to killing a pest. “Consumers and users of pesticide products have a right to know all the ingredients that are in products they purchase so that they can make more informed choices in the marketplace,” said Jay Feldman, Executive Director of Beyond Pesticides. EPA’s 2010 proposal noted public disclosure “may lead to less exposure to”¦ hazardous inert ingredient[s] because consumers will likely choose products informed by the label.” In turn, “pesticide producers will likely respond by producing products with less hazardous inert ingredients.” Billions of pounds of pesticides are dispersed throughout the U.S. and enter our food supply, homes, schools, public lands and waterways. USDA Report Cites Concerns with GE Crops as the Agency Approves New Uses

(Beyond Pesticides, February 28, 2014) A report released last week by the U.S. Department of Agriculture (USDA) considers the trends of genetically engineered (GE) crops over the past 15 years, since they were first introduced. Responding to increasing GE use, USDA also points to major concerns such as increasing herbicide resistance and higher levels of herbicide use as major potential threats to human health and the environment. The report comes as USDA and the U.S. Environmental Protection Agency (EPA) are poised to  approve  new forms of GE corn and soybeans designed to be resistant to 2,4-D products,  one of the active ingredients in Agent Orange and a known carcinogen. Released  by USDA’s Economic Research Service (ERS) on February 20, the report not only details the trends in GE use but also the known and unknown threats that GE crops pose. The number of GE varieties approved by USDA’s Animal and Plant Health Inspection Service (APHIS) grew exponentially between 1984 and 2002, the report said. Town Asks MA Supreme Court to Affirm Right to Stop Private Pesticide Use in Sensitive Pond

(Beyond Pesticides, February 20, 2014) The town of Chilmark located on Martha’s Vineyard, Massachusetts is not backing down from its decision to challenge property owners and the local conservation commission’s attempts to introduce a toxic herbicide directly into the waters of the only enclosed, great pond of the well-known, destination island. While one might assume that the litigation centers around whether or not the herbicide proposed for use in the local water source poses as a danger, this issue is only a sideline debate. Instead, the central dispute highlights one of the greatest challenges facing local governments surrounding pesticide control and a locality’s authority to protect both its citizens and its local environment from the hazards that these chemicals bestow: preemption. Preemption is the ability of one level of government to override laws of a lower level. While local governments once had the ability to restrict the use of pesticides on all land within their jurisdictions, pressure from the chemical industry led many states to pass legislation that prohibits municipalities from adopting local pesticide ordinances affecting the use of pesticides on private property that are more restrictive than state policy. Study Elevates Need for Testing of “Inert” Ingredients in Pesticide Products

(Beyond Pesticides, February 13, 2014) French scientists from the University of Caen have revealed one more layer of the myth behind so-called “inert” ingredients in pesticides, concluding that pesticide risk assessments that focus exclusively on active ingredients substantially underestimate the potential hazards of the product as a whole. The findings in Major pesticides are more toxic to human cells than their declared active principles indicate that inert ingredients in pesticides can magnify the effects of active ingredients, sometimes as much as 1,000-fold. In conducting their study, Robin Mesnage,  Ph.D.  and  his team of scientists, including Gilles-Eric Seralini,  exposed three human cell lines to the active ingredients of three herbicides, three insecticides, and three fungicides. The team then exposed the cell lines to the well-known commercial formulations that include these active ingredients which also contained “inerts,” and compared the results. Overall the study concluded that the commercial combinations had a magnifying effect on the toxicity of the active ingredients. While many might assume  that three insecticides tested ranked highest in toxicity, the study actually ranked fungicides as having the highest on-average toxicity, followed by herbicides, then insecticides. Bee Larvae Adversely Affected by Mix of Pesticides and Inert Ingredients

(Beyond Pesticides, February 6, 2014) We know that pesticides and bees don’t mix and that particular pesticides, such as neonictinoids, pose significant threats to bee populations worldwide, but a recent study conducted by researchers at Pennsylvania State University have identified that it is “the mix” of the many chemicals in the environment that pose a significant threat to honey bee survival. Looking at the four most common pesticides detected in pollen and wax –fluvalinate, coumaphos, chlorothalonil, and chloropyrifos, Wanyi Zhu and other researchers have assessed the toxic impacts of these pesticides on honey bee larvae at real world exposure levels; that is, levels that are found in existing hives outside of a laboratory. GE Soy Exhibits Higher Glyphosate Residues than Conventional, Organic Healthier

(Beyond Pesticides, January 16, 2014) Researchers in Norway recently released a new study giving organic consumers and anti-genetically engineered (GE) crop advocates another few solid reasons to promote organic and continue the fight against engineered crops.  Findings from the study demonstrate that not only do soybeans grown using organic cultivation practices provide the healthiest nutritional profile of the three classes of soybeans studied, but GE soybeans also retain glyphosate residues at higher levels than their conventional, non-GE soybean counterparts. In Compositional differences in soybeans on the market: Glyphosate accumulates in Roundup Ready GM soybeans (Soy Study), Thomas Bøhn of Genøk, Centre for Biosafety and his team of researcher examined 31 batches of soybeans””all grown in the United States.  The batches were separated into three categories: (1) GE, glyphosate-tolerant soy (GE-soy); (2) unmodified soy cultivated using conventional ”˜chemical’ practices; and (3) unmodified soy cultivated using organic practices. White Paper Outlines New Approach to Endangered Species Act Pesticide Review

(Beyond Pesticides, November 19, 2013) Last week, the Environmental Protection Agency (EPA), the U .S. Department of Agriculture (USDA), Fish and Wildlife Service (FWS), and National Marine Fisheries Service (NMFS) released a white paper identifying how they plan to reconfigure the pesticide review process to meet the pesticide approval requirements for the Endangered Species Act (ESA). The new approach outlined in the white paper incorporates suggestions from the National Academy of Sciences’ Research Council (NRC) report released last May. The white paper is a step towards overhauling a deeply flawed process, though there will be several challenges to implementing this new approach for the agencies moving forward. Under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), before a pesticide can be sold, distributed, or used in the U.S., EPA is required to determine that the pesticide does not cause unreasonable adverse effects on the environment. However, in the case of species listed as endangered or threatened under the ESA, all federal agencies, including EPA, are required to ensure that their actions will not jeopardize the continued existence of a listed species by diminishing the species’ numbers and reproduction. Review Highlights Dangerous Health Effects of Glyphosate

(Beyond Pesticides, May 9, 2013) A review of the scientific literature of the toxic effects of glyphosate, one of the most popular weed killers in the U.S. and the active ingredient in Roundup, links the herbicide  to a wide range of diseases and suggests  that more research is needed. The review, conducted by a scientist at Massachusetts Institute of Technology (MIT), looks at the mechanisms through which the adverse effects may be happening and points to  the chemical’s inhibition of cytochrome P450 (CYP) enzymes, which plays the crucial role of detoxifying xenobiotics. Thus, glyphosate can enhance the negative effects of other environmental toxicants on the body. Authors argue that this has been a critically overlooked component in research on glyphosates’ toxicity to mammals. We “have hit upon something very important that needs to be taken seriously and further investigated,” Stephanie Seneff, PhD, lead author and research scientist at MIT, told Reuters. Report Finds Pesticide Hazards to Endangered Species Inadequately Reviewed by EPA

(Beyond Pesticides, May 2, 2013) A committee of the National Academy of Sciences’ Research Council (NRC) issued a new report that outlines steps to improve regulatory problems associated with pesticides that harm endangered and threatened species. The report, Evaluating Risks That Pesticides Pose to Endangered, Threatened Species — New Report  suggests the need to overhaul  EPA’s deeply flawed pesticide approval process. Under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), before a pesticide can be sold, distributed, or used in the United States, the U.S. Environmental Protection Agency (EPA) is required to determine  that the pesticide does not cause unreasonable adverse effects on the environment. (Beyond Pesticides, March 19, 2013) The phase-out of antibiotic use in apple and pear production may continue beyond 2014 unless the public speaks out. Luckily, unlike the closed-door meetings that surround the rulemaking process in other government agencies, organic regulations are unique because they include a key ingredient: you, the public. Twice a year, the National Organic Standards Board (NOSB) solicits comments from the public on materials petitioned for use in organic, and issues of concern to the organic community. Below is a brief summary of select issues and proposed materials that are up for review at the Spring 2013 National Organic Standards Board (NOSB) meeting. Your participation is vital as it will help determine the future of organic in the United States: Will antibiotics continue to be allowed in apple and pear production after years of delay? EPA Proposes to Clarify Exempt Minimum Risk Pesticide Ingredients

(Beyond Pesticides, January 4, 2013) On December 31, 2012, the U.S. Environmental Protection Agency (EPA) proposed to clarify its labeling requirement for disclosure of all active and inert ingredients in “minimum risk pesticide products,” exempt from registration under Section 25 (b) of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). The rule (77 FR 250) reorganizes the list of eligible active and inert ingredients by adding identifiers that will clarify for the public, and more importantly for federal and state inspectors, which ingredients are permitted in minimum risk pesticide products. The modification would require labels to use common chemical names in the list of ingredients as well as the contact information for the manufacturer. The lack of clarity on minimum risk pesticide product labels in the past has made it difficult for enforcement officials who must use their own judgment on the applicability of vague descriptors such as cedar leaf oil and cedar wood oil, which are exempt under the current listing of “Cedar Oil” under CFR Section 152.25. Leading Pediatrics Group Issues Warning and Recommendations on Pesticides

(Beyond Pesticides, November 27, 2012) On Monday, the American Academy of Pediatrics (AAP) released a landmark policy statement, Pesticide Exposure in Children, and an accompanying technical report on the effects of pesticide exposure in children. In the documents, released in the December 2012 issue of Pediatrics magazine and online on November 26, AAP makes note of the current shortfalls in medical training, public health tracking, and regulatory action on pesticides. Acknowledging the risks to children from both acute and chronic effects, AAP’s report provides recommendations to both pediatricians and government health agencies. AAP’s policy statement comes on the heels of an October 2012 report citing the benefits of eating organic food in order to reduce pesticide exposure. Lead authors on the documents for the AAP’s Council on Environmental Health are James R. Roberts, MD, MPH, Medical University of South Carolina, and Catherine J. Karr, MD, PhD, University of Washington. AAP’s statement notes that, “Children encounter pesticides daily and have unique susceptibilities to their potential toxicity.” The report discusses how kids are exposed to pesticides every day in air, food, dust, and soil. Organic Board Sets Inerts Review, Approves Biodegradable Mulch, Rejects Synthetic Infant Formula Supplements, and More

(Beyond Pesticides, November 19, 2012) At its October 15-18, 2012 Fall meeting in Providence, Rhode Island the National Organic Standards Board (NOSB) conducted standards reviews affecting the integrity of organic food and farming and rejected proposals that would have weakened the standards. As it does twice a year, the NOSB (a 15-member board appointed by the Secretary of Agriculture and intended by Congress to represent all stakeholders in the organic sector, including farmers, certifiers, processors, retailers, consumers, environmentalists, and a scientist) met in public, received public comments, and voted on a range of topics from biodegradable bioplastic mulch, supplemental infant formula ingredients, inert ingredients in allowed pesticides, fertilizers, to allowed synthetic substances. The Board considered subcommittee recommendations that had been proposed by each of the issue subcommittees -including crops, livestock, handling, materials, policy development, and certification, accreditation, and compliance- and subject to a public comment period that preceded the meeting. There were several highly controversial issues discussed, including the addition of supplemental chemical nutrients to organic infant formula, the use and removal of biodegradable biobased-bioplastic mulch film, and the new review requirement for inert ingredients that are integral to allowed pesticide products.
