Local Municipality Requires Labeling of Penta (PCP)-Treated Utility Poles

(Beyond Pesticides, September 15, 2014) The Town of North Hempstead on Long Island, New York has passed a new law requiring warning labels on the utility poles that are treated with the hazardous wood preservative, pentachlorophenol  (PCP). At the town board meeting on September 9, a vote of 7-0 mandated the labeling with the following warning: “This pole contains a hazardous chemical. Avoid prolonged direct contact with this pole. Wash hands or other exposed areas thoroughly if contact is made.” Since the Long Island Power Authority (LIPA), operated by Public Service Enterprise Group (PSEG), installed thousands of new hurricane-resistant utility poles that are thicker and taller, it shed  more light on the community hazards  associated with use of pentachlorophenol. Of the 324,000 utility poles on Long Island, about 95,000 have been treated with PCP. Even though there is a prohibition  of PCP for residential uses within the U.S., it still can be used on utility poles, railroad ties and other industrial uses under  federal law. Emory University To Ban Neonicotinoids from Campus

(Beyond Pesticides, September 10, 2014) As bee and other pollinator populations continue to decline around the world, with clear evidence pointing to neonicotinoid pesticides as a prime cause, Emory University announced last week that it will be eliminating the use of this controversial class of chemicals from its campus, joining institutions and  communities like University of Vermont Law School, Spokane  (Washington),  Eugene (Oregon), and Shorewood (Minnesota). Neonicotinoids are a class of insecticides that share a common mode of action that affects the central nervous system of insects,  affecting the organisms’ ability to function. These systemic pesticides, which move through the plant’s vascular system and express themselves through pollen and nectar, include imidacloprid, acetamiprid, clothianidin, dinotefuran, nithiazine, thiacloprid and thiamethoxam. A continually growing body of science has implicated neonicotinoids, which are applied to or incorporated into seeds for agricultural, ornamental and garden plants, as a key factor in recent global bee die-offs. Beekeepers across the country reported losses of 40 to 90 percent of their bees last winter. Manufacturer Proposes Increase in Bee-Toxic Pesticide on Crops

(Beyond Pesticides, September 9, 2014) Multinational pesticide manufacturer Syngenta  has petitioned the U.S. Environmental Protection Agency (EPA) to raise the allowable levels of a systemic pesticide on a number of crops. In certain cases, such as hay from wheat, the company is asking for a 400x increase in the tolerance level set by the federal agency. The pesticide in question is thiamethoxam, a member of the neonicotinoid class of insecticides that have been widely implicated in global pollinator declines. Many of the requested tolerance increases are for crops that end up as feed for livestock, but are also foraged by pollinators. For example, Syngenta is requesting increases on sweet corn used as forage from 0.1 parts per million (ppm) to 5.0 ppm — a 50x increase. The company is also requesting new tolerances on known bee-attractive crops; while tolerances on sunflower are currently 0.02 ppm, the company is requesting a new tolerance for sunflower seeds at 0.4 ppm. Study Finds EPA Favors Industry in Pesticide Safety Evaluations

(Beyond Pesticides, September 5, 2014) A study published in a scientific journal finds that the U.S. Environmental Protection Agency (EPA) favors the chemical  industry when making determinations on pesticide safety. Under the Federal Insecticide Fungicide and Rodenticide Act (FIFRA), EPA conducts  risk assessments to determine whether a new or existing chemical is eligible for registration or reregistration and therefore able to enter or remain on the market. The study’s conclusions raise serious concerns for both environmental and human health protection because of EPA’s practice of inviting bias and underestimating potential harm. The study, which will be in the October issue of BioScience, highlights the case of atrazine, an herbicide that has been linked to cancer, endocrine disruption, birth defects, and reproductive effects. In their study, Michelle Boone, Ph.D., of Miami University, and her colleagues find that most pesticide toxicity tests used in risk assessments are conducted by pesticide manufacturers themselves. The authors contend that this can result in conflicts of interest. Canadian Beekeepers File Class Action Lawsuit Against Makers of Neonicotinoids

(Beyond Pesticides, September 4, 2014) Beekeepers in Ontario, Canada are tired of losing bees and have decided to take matters into their own hands by filing a class action lawsuit against two makers of neonicotinoids. According to The Globe and Mail, the lawsuit alleges that Syngenta and Bayer CropScience were negligent in the design, sale, manufacture, and distribution of neonicotinoid pesticides and this negligence caused the plaintiffs, Sun Parlor Honey and Munro Honey, to suffer $450 million in damages. These alleged damages are based on losses from damaged or lost bee colonies, decreased honey production, lost profits, and unrecoverable costs ””all because of neonicotinoids. Neonicotinoids are chemically similar to nicotine and are pesticides that are toxic to a broad range of insect pests. They are also known as systemic pesticides, which are pesticides that spread throughout the entire plant structure, making everything from roots to pollen toxic to organisms that come in contact with it. In Coverup of Illegal Pesticide Use, Applicator Gets Two Year Prison Sentence

(Beyond Pesticides, September 3, 2014) The U.S. Justice Department sentenced Steven A. Murray, a pesticide operator with Bio-Tech Management in Pelham, Georgia, to two years in prison last week after as a result of charges related to a cover up illegal pesticide applications made at over 100 nursing homes. Mr. Murray pleaded guilty to one count of conspiracy, three counts of false statements, two counts of mail fraud, and 10 counts of unlawful use of a registered pesticide. In addition to being sentenced to two years in prison, Murray was subject to a $7,500 fine. His company was placed on three years of probation and also required to pay a $50,000 fine. From October 2005 to June 2009, Mr. Murray and Bio-Tech provided monthly pest control services to hundreds of nursing homes in several southern states including Georgia, South Carolina, North Carolina and Alabama by spraying pesticides in and around their clients’ facilities. Bio-Tech employees routinely  applied  the pesticide Termidor indoors, contrary to the  manufacturer’s  label  instructions, and then created false service reports to conceal that illegal use. Oregon Spray Pilot Fined $10,000 for Pesticide Drift that Residents Say Poisoned Them

(Beyond Pesticides, August 26, 2014) Nearly a year after residents in Curry County Oregon were sprayed with herbicides, the pilot responsible for the incident had  his license suspended for a year and was fined $10,000 by the Oregon Department of Agriculture (ODA). The Pacific Air Research Company, which employed the pilot, was also fined $10,000 and had all its licenses revoked for a year for providing false information to the state. The initial incident happened in October 2013, when  residents complained of experiencing rashes, headaches, asthma, and stomach cramps right after the application. As reported in the The Oregonian, after the investigation, ODA was criticized by environmental groups and the general public for not doing a proper investigation. It took 6 months for any information to be disclosed even though the poisoned residents requested it. Pacific Air Research at the time of the incident stated that the only chemical being sprayed was glyphosate. Then, ODA conducted an investigation and concluded that the spray was not directly linked to the conditions displayed by residents. Town Bans Land Application of Sewage Sludge, or Biosolids

(Beyond Pesticides, August 22, 2014) The Town Board in Wheatfield, New York unanimously voted last month to amend its biosolids law to ban any application of sewage sludge and other similar materials from the treatment of municipal wastewater to any land in town, even for those who already have permits from the state. The law reasons that the potential contamination of groundwater, surface water, and soil, as well as the potential for air pollution, poses an unreasonable risk to town residents, public health, and the environment. Biosolids, otherwise known as sewage sludge, are composed of dried microbes previously used to process wastewater in treatment plants. The material is increasingly being used in conventional agriculture, but its application is explicitly forbidden in organic production. This is because the sludge can contain high concentrations of toxic contaminants, such as pesticides, detergents, estrogenic hormones, antibiotics, dioxins, PCBs, flame retardants, and heavy metals. A 2002 study revealed the material to be associated with an increased prevalence of Staphylococcus aureus infections, a condition known to cause skin rashes and respiratory problems, for people located in close proximity to biosolid application sites. Following Lawsuit, EPA Restores Stream Buffers to Protect Salmon from Pesticides

(Beyond Pesticides, August 18, 2014) In a victory for environmental groups, conservationists, and fishing groups, the U.S. Environmental Protection Agency (EPA) finalized a settlement last Wednesday to restore no-spray buffer zones around waterways to protect imperiled salmon and steelhead from five toxic pesticides.   An initial agreement was reached in June, when it underwent public comment, and was ultimately filed August 13 without any substantive changes. The settlement follows litigation filed by Earthjustice, representing the Pacific Coast Federation of Fishermen’s Associations, the Northwest Coalition for Alternatives to Pesticides, and Defenders of Wildlife, back in 2010 that called for EPA adoption of reasonable fish protections from the insecticides. Report Finds Banned, Illegal Pesticides in Popular Indian Tea Brands

(Beyond Pesticides, August 14, 2014) Pesticides are not the first thing to pop into mind when peering into a hot mug of steaming, pale green or murky black tea first thing in the morning. A recent report published by Greenpeace India announced the results of an investigation that tested for pesticide residues in branded tea. The verdict? Nearly 94% of the tea samples tested contained at least one of 34 different pesticides, while over half contained a toxic cocktail of more than 10 different pesticides. The residues found include DDT, which was banned for use in agriculture in India since 1989, and endosulfan, which was banned in 2011 by the Indian Supreme Court. Over half of the 49 samples contained illegal pesticides — either those that are not approved for use in tea cultivation or exceeded recommended limits. These pesticides include ones that have been long banned from agriculture and use in tea cultivation (DDT and triazophos), suspected mutagens and neurotoxicants (monocrotophos), and insecticides associated with the global decline in bee populations (neonicotinoids like thiacloprid and thiamethoxam). Vermont Law School Becomes First BEE Protective Campus!

(Beyond Pesticides, August 11, 2014) Vermont Law School announced Friday that its campus is going neonicotinoid pesticide-free, making it the first higher-education campus in the country to earn official recognition from the  BEE Protective Campaign, led by Beyond Pesticides and Center for Food Safety. The university joins an expanding list of communities across the country to take action to protect pollinators in the absence of federal regulation, including Eugene, OR,   Spokane, WA, and most recently, Shorewood, Minnesota. “We are very pleased that Vermont Law School has taken the lead on going neonic-free, and hope other universities and communities will follow suit,” said Nichelle Harriott, Senior Staff Scientist at Beyond Pesticides. New Wave of Herbicide-Tolerant Crops Awaiting Likely U.S. Approval

(Beyond Pesticides, August 8, 2014) Despite the continued documentation of weed resistance all over the United States, as well as the world, another line of herbicide-tolerant crops developed by Monsanto is currently in the pipeline awaiting likely approval by U.S. regulators. The U.S. Department of Agriculture’s (USDA) Animal and Plant Health Inspection Service (APHIS) released a draft environmental impact statement (EIS) on Tuesday, which, according to regulators, will pave the way for the approval of new  genetically modified cotton and soybean plants tolerant to a mixture of the herbicides glyphosate and dicamba. Monsanto’s new soybean and cotton crops were developed to withstand their new herbicide formulation, called Roundup Xtend, which combines the pesticides dicamba and glyphosate. The “Roundup Ready Xtend crop system” was developed to curb the proliferation of millions of acres of weeds that have grown resistant to Monsanto’s glyphosate-based Roundup, which has been used on the company’s biotech corn, soybeans, and cotton. Minnesota City Passes “Bee-Safe” Policy

(Beyond Pesticides, August 6, 2014) Shorewood, Minnesota has become the first city in the state, and the third city in the nation to pass a bee friendly policy. The city council unanimously approved a “bee-safe” resolution that encourages planting bee-friendly flowers and restricts the bee-killing pesticides, neonicotinoids. The city has already begun planting clover, which will provide nectar and pollen forage for bees in city parks. A group of Shorewood residents, concerned over reports of bee decline, came together to ensure that bees in their community have access to healthy forage and habitat. In a prime example of grassroots activism, the group urged their neighbors to plant pollinator-friendly plants, and to take care of lawns without using products harmful to bees. The resolution, passed last week, encourages the use of bee-safe processes in parks, education to residents on bee and pollinator safety, and other bee safe practices. Neonicotinoids, the class of chemicals identified as playing a major role in bee decline across the globe, have been banned from city property. Banned Pesticide DDT with Lingering Residues Again Linked to Obesity and Diabetes

(Beyond Pesticides, August 5, 2014) A new study finds that female mice exposed in utero to the pesticide DDT are at greater risk for obesity and type-2 diabetes, adding to a growing body of literature linking metabolic diseases to pesticide exposure. The study, titled Perinatal Exposure of Mice to the Pesticide DDT Impairs Energy Expenditure and Metabolism in Adult Female Offspring, was published in the journal PLoS One. Researchers measure and compare metabolic abnormalities in female mice that were exposed in utero to DDT against a control group of those that were unexposed. After exposure, the two groups were then fed high-fat diets for 12 weeks in adulthood. Females exposed to DDT around the time of their birth were more likely to develop insulin sensitivity, glucose intolerance, high cholesterol, and metabolic complications that could result in liver disease. These results suggest that DDT exposure in and around the time of gestation cultivates conditions that increase an individual’s likelihood of accumulating excess fat over the course of one’s lifespan. UK Parliament Finds Unacceptable Influence of Pesticide Company Pollinator Research on Regulatory Decisions

(Beyond Pesticides, July 30, 2014) Critical research on the plight of pollinators is being tainted by corporate funding, according to an English report published on Monday. According to the report from the United Kingdom’s (UK) Environmental Audit Committee (EAC),   a committee of Parliament, pesticide manufacturers have too much control over vital research into links between their products and the death of bees. The committee also recommends that in light of recent research, the UK government must seek a permanent ban on bee-killing pesticides. The EAC’s report finds that UK’s Department for Environment, Food and Rural Affairs (DEFRA), which oversees pesticide use, relies on industry data to inform opinion that erodes public confidence in any action to protect pollinators. Pesticides Linked to Drug-Resistant Fungal Infections in Humans

(Beyond Pesticides, July 29, 2014) A recent rise in drug resistant human pathogenic fungi may be fueled by the use of fungicides (pesticides that kill fungi) on agricultural fields, according to research led by Manchester University in the United Kingdom. Aspergillus, the genus of common soil-dwelling fungi analyzed by researchers, include an incredibly diverse group of mold species. Although some provide important commercial uses (such as in the production of citric acid, for instance), many species are pathogenic in humans, and can result in life-threatening lung infections. The rise of cross-resistant fungi is a serious concern for sensitive individuals with weakened immune systems, such as transplant patients, asthmatics, and those with leukemia. In the study, Occurrence of azole-resistant species of Aspergillus in the UK environment, UK scientists collected hundreds of samples across the country. Although no resistant strains were found in inner city locations, 1.7% of samples from rural agricultural areas had markers for drug resistance. New Zealand To Increase Scrutiny of Bee-killing Pesticides, Denies “Neonic” Application

(Beyond Pesticides, July 23, 2014) New Zealand’s Environmental Protection Authority is stepping up its requirements for a higher level of scientific evidence regarding the safety and effects of neonicotinoids -pesticides linked to bee decline- before considering them for approval. Just last month, the Authority declined an application of thiamethoxam, a neonicotinoid, for use as a seed treatment, citing risks to bees. The decision follows a recent worldwide integrated assessment of research into systemic pesticides that concludes that neonicotinoid insecticides pose a serious risk to birds, honey bees and other pollinators, and a wide range of invertebrates, including earthworms. The international analysis of 800 peer-reviewed scientific reports confirms concerns of beekeepers and environmental groups throughout the world that long-term exposure to systemic pesticides at low, sublethal levels could be harmful to bees and a factor in declining bee populations. Virginia County Stops Pesticide Spraying in Favor of Alternatives to Combat Lyme Disease

(Beyond Pesticides, July 18, 2014) After years of struggling to combat the rise of Lyme disease in the region, Loudoun County, Virginia has decided to forgo the spraying of a hazardous pesticide in public parks in favor of public education and continued surveillance of park lands. Controversy over spraying arose back in 2012 when Loudoun began ramping its spray program to manage ticks, often the carrier of the disease. Loudon County used the pesticide Talstar, which contains the active ingredient bifenthrin, a neurotoxic chemical whose use raises public health and product efficacy concerns, as documented by the Centers for Disease Control and Prevention. Beekeepers expressed concern that spraying would greatly damage their bee colonies, as bifenthrin is highly toxic to bees, while conservationists were concerned with the chemicals leaching into waterways and killing aquatic life. At the same time, some researchers point out that there was no evidence that spraying the chemical would reduce the number of Lyme disease infections. Groups Oppose Trade Pact Proposals that Weaken Chemical Safety Protections

(Beyond Pesticides, July 14, 2014) In a letter Thursday, a broad array of major U.S. and European chemical safety, health, environmental, labor, consumer and other organizations, including Beyond Pesticides, expressed strong opposition to proposed rules for the Transatlantic Trade and Investment Partnership (TTIP) that could chill or roll back robust chemical safety standards on both sides of the Atlantic. The letter was sent to U.S. Trade Representative Michael Froman and EU Commissioner for Trade Karel de Gucht, in advance of the sixth round of TTIP negotiations, which are to begin in Brussels next week. “EU and U.S. trade policy should not be geared toward advancing the chemical industry’s agenda at the expense of public health and the environment — but that appears to be exactly what is currently underway with TTIP,” the letter states. “The presence of toxic chemicals in our food, our homes, our workplaces, and our bodies is a threat to present and future generations, with staggering cost for society and individuals.” At the upcoming TTIP negotiations, draft text will be presented for the first time for several of the proposed pact’s chapters that could directly undermine strong chemical safety rules. Bird Population Declines Linked to Neonicotinoid Pesticides, Adding to Previous Science

(Beyond Pesticides, July 11, 2014) In addition to previous research on the direct impacts of pesticides on pollinators and other beneficials, a recent study published by Dutch scientists establishes an additional indirect link between neonicotinoid use and insect-eating birds. The report, which came out on Wednesday, provides evidence that neonicotinoids, a class of systemic pesticides, are indirectly hurting larger creatures by reducing insect prey populations such as mosquitoes and beetles. Researchers found that in certain areas of the Netherlands where water is contaminated with high concentrations of imidacloprid, a commonly used neonicotinoid, bird populations tend to decline by an average of 3.5 percent every year. Further analysis found that this spatial pattern of decline appeared only after the introduction of imidacloprid to the Netherlands in the mid-1990s, even after correcting for land-use changes that have been known to affect bird populations in farmland. “To our surprise we did find a very strong effect on birds”, said lead author of the study, Caspar Hallmann, a Ph.D. student from Radboud University in the Netherlands, to Reuters. Chemical Company Withdraws Challenge to EU Bee Protections from Neonics

(Beyond Pesticides, July 10, 2014) In the face of public outcry and protest, chemical-industry giant, Syngenta, has withdrawn its emergency application to allow the use of neonicotinoid pesticides on United Kingdom (UK) oilseed rape crops (known as canola in the U.S.). The application, filed earlier this year in anticipation of the UK canola growing season, claimed that canola farmers would suffer irreparable damage from pests without the use of neonicotinoids that had been banned under a temporary two-year European Union (EU). The EU’s directive that went into effect at the end of 2013 and will continue through 2015 was enacted to protect the severely declining and threatened bee populations  ””a problem  throughout Europe and the world. While many factors contribute to the bee decline, neonicotinoids, a relatively new class of pesticides, have been linked through numerous studies to the significant decline and were determined by the European Food Safety Authority to be a “high acute risk.” Neonicotinoids are often used as a seed coating on agricultural crops as well as in foliar applications, affecting bee and pollinator survival at several different levels. Late Breaking News: Groups Challenge California’s Approval of Bee-Killing Pesticides

State rubber stamps expanded usage before determining effects on crop pollinators (Beyond Pesticides, July 8, 2014) Today, environmental and food safety groups challenged California’s illegal practice of approving new agricultural uses for neonicotinoid pesticides despite mounting evidence that the pesticides are devastating honeybees. Pesticide Action Network, Center for Food Safety, and Beyond Pesticides, represented by Earthjustice, filed the legal challenge in the California Superior Court for the County of Alameda, urging the California Department of Pesticide Regulation (DPR) to stop approving neonicotinoid pesticides pending its completion of a comprehensive scientific review of impacts to honeybees.   DPR began its scientific review in early 2009 after it received evidence that neonicotinoids are killing bees, but five years later, DPR has yet to take meaningful action to protect bees. Meanwhile, DPR has continued to allow increased use of neonicotinoids in California.   Today’s lawsuit challenges DPR’s June 13, 2014 decision to expand the use of two powerful neonicotinoid insecticides — sold under the trademarks Venom Insecticide and Dinotefuran 20SG — despite the agency’s still-pending review of impacts to pollinators.   The case underscores these larger problems with the DPR’s unwillingness to comply with laws enacted to ensure that pesticides do not threaten […]

Maine Town Votes to Ban Lawn Pesticides on Public and Private Property, Becoming Second to Act in Last Year

(Beyond Pesticides, July 8, 2014) [Eds. Note: Because of a procedural glitch in the ordinance, the Ogunquit pesticide ban ordinance was scheduled to be placed on the ballot again on November 4, 2014. The ordinance passed again, this time overwhelmingly.] In another key victory  for public health and the environment, last month residents in the small ocean-side community of Ogunquit, Maine (pop:~1,400) voted to become the first town in the state to prohibit the use of pesticides on public and private property for turf, landscape, and outdoor pest management activities. Ogunquit’s ordinance makes the town the second local jurisdiction in the United States in the last year  to ban pesticides on both public and private property, and the first to be passed by popular vote, 206 to 172. The ordinance, modeled in large part on the first private/public pesticide ban in Takoma Park, Maryland last year, was passed after a three-year education and awareness campaign, initiated by the town’s Conservation Commission. The law expands on  existing pesticide use restrictions on  town-owned property.
